ASSISTANCE TO THE CITY OF EAGLE, IDAHO
THIS MEMORANDUM OF UNDERSTANDING is entered into this iSi day of
August, 2019, by and between the Ada County Prosecuting Attomey, in her official capacity as the
duty elected prosecutor for Ada County ("ACPA"); and the Mayor of the City of Eagle, Idaho,
("Eagle") in his official capacity (collectively, "parties").
WHEREAS, the Mayor and City Council are responsible to appoint a prosecutor to
"prosecute those violations of county or city ordinances, state traffic infractions, and state
misdemeanors committed within the municipal limits" pursuant to Idaho Code § 50-208A; and
WHEREAS, the Ada County Prosecuting Attorney desires to assist Eagle on a temporary
basis in the exercise of its authority pursuant to Idaho Code § 50-208A; and
NOW, THEREFORE, it is agreed between the parties as follows:
1. The ACPA agrees to provide prosecution services for case number CR01-18-54303, State v.
Mary Curtis, under the terms of this Agreement until October 1, 2019, on behalf of Eagle.
2. Eagle agrees to authorize, through oath, deputies of ACPA to confer on them the authority
of the Eagle City Attorney as set forth in Idaho Code § 50-208A to the extent necessary for
ACPA to provide prosecution services set forth above.
3. This Memorandum of Understanding, and the authority conferred herein to ACPA and/or
her deputies is effective as of signing and expires October 1, 2019.
4. Attached hereto as Exhibit A is a true and correct copy of the oath given by Eagle to the
deputies of ACPA to exercise the authority necessary to provide prosecution services as set
forth above.
IN WITNESS WHEREOF, the parties have executed this Memorandum of Understanding
on the date and year written above.
