RESOLUTION No. 19-21
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE A PORTION OF A UTILITY,
EASEMENTS CO -SITUATE WITH LOT 8, BLOCK 1, LAKEMOOR COMMERCIAL SUBDIVISION,
AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, GRH Lakemoor, LLC, represented by Sabrina Durtschi, with KM Engineering, LLP,
requested a vacation to the final plat of Lakemoor Commercial Subdivision to remove a portion of a utility
easements co -situate with Lot 8, Block 1, Lakemoor Commercial Subdivision; and
WHEREAS, On May 6, 2019, the Commission recommended approval of the vacation (VAC -02-
19), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on May 7, and May 17, 2019; and
WHEREAS, On May 28, 2019, the City Council held a public hearing on the proposed vacation
(VAC -02-19), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates a portion of the utility easements co -situate with Lot 8,
Block 1, Lakemoor Commercial Subdivision as considered, heard and approved by the Council at its May
28, 2019, public hearing for application number VAC -02-19 as described in Exhibit "A" and shown on
Exhibit "B".
This Resolution shall be in full force and effect immediately upon its adoption and approval.

A portion of Lot 8, Block 1 of Lakemoor Commercial Subdivision, situated in a portion of the
West 1/2 of Section 21, Township 4 North, Range 1 East, Boise Meridian, City of Eagle, Ada
County, Idaho and being more particularly described as follows:
Commencing at a found 1/2 -inch rebar marking the southwest corner of said Lot 8, which bears
589°52'35"W a distance of 211.77 feet from a found 5/8 -inch rebar marking the southeast
corner of said Lot 8, thence following the westerly boundary line of said Lot 8, NOO°06'06"W a
distance of 28.92 feet to a found 1/2 -inch rebar and being POINT OF BEGINNING 1.
Thence following said westerly boundary line the following two (2) courses:
1. S89°52'33"W a distance of 21.50 feet to a found 1/2 -inch rebar,
2. NOO°13'42"W a distance of 51.18 feet to a point hereinafter referred to as "POINT A";
Thence leaving said westerly boundary line, N89°52'33"E a distance of 21.61 feet;
Thence 500'06'06"E a distance of 51.18 feet to POINT OF BEGINNING 1.
Said parcel contains 1,103 sq. ft. (0.025 acres), more or less.
Together With:
Commencing at a point previously referred to as "POINT A", thence N09°29'50"W a distance of
212.24 feet to a found 1/2 -inch rebar on the northerly boundary line of said Lot 8 and being POINT
OF BEGINNING 2.
Thence following said northerly boundary line the following two (2) courses:
1. N44°05'OO"E a distance of 34.44 feet to a found 1/2 -inch rebar;
