WHEREAS, GRH Lakemoor, LLC, represented by Sabrina Durtschi, with KM Engineering, LLP, requested a vacation to the final plat of Lakemoor Commercial South Subdivision to remove a portion of a utility easement co -situate with Lot 4, Block 1, Lakemoor Commercial South Subdivision; and WHEREAS, On May 6, 2019, the Commission recommended approval of the vacation (VAC -02- 19), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on May 7, and May 17, 2019; and WHEREAS, On May 28, 2019, the City Council held a public hearing on the proposed vacation (VAC -02-19), and voted to approve the vacation; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates a portion of the utility easement co -situate with Lot 4, Block 1, Lakemoor Commercial South Subdivision as considered, heard and approved by the Council at its May 28, 2019, public hearing for application number VAC -02-19 as described in Exhibit "A" and shown on Exhibit "B".
