RESOLUTION No. 19-20
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE A PORTION OF A UTILITY,
EASEMENT CO -SITUATE WITH LOT 4, BLOCK 1, LAKEMOOR COMMERCIAL SOUTH
SUBDIVISION, AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, GRH Lakemoor, LLC, represented by Sabrina Durtschi, with KM Engineering, LLP,
requested a vacation to the final plat of Lakemoor Commercial South Subdivision to remove a portion of a
utility easement co -situate with Lot 4, Block 1, Lakemoor Commercial South Subdivision; and
WHEREAS, On May 6, 2019, the Commission recommended approval of the vacation (VAC -02-
19), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on May 7, and May 17, 2019; and
WHEREAS, On May 28, 2019, the City Council held a public hearing on the proposed vacation
(VAC -02-19), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates a portion of the utility easement co -situate with Lot 4,
Block 1, Lakemoor Commercial South Subdivision as considered, heard and approved by the Council at its
May 28, 2019, public hearing for application number VAC -02-19 as described in Exhibit "A" and shown
on Exhibit "B".
This Resolution shall be in full force and effect immediately upon its adoption and approval.

the Northwest 1/4 of the Southwest 1/4 of Section 21, Township 4 North, Range 1 East, Boise
Meridian, City of Eagle, Ada County, Idaho and being more particularly described as follows:
Commencing at a found 5/8 -inch rebar marking the northwest corner of said Lot 4, which bears
N01°09'17"W a distance of 165.78 feet from a found 5/8 -inch rebar marking the southwest
corner of said Lot 4, thence following the northerly boundary line of said Lot 4, N90°00'OO"E a
distance of 71.70 feet to the POINT OF BEGINNING.
Thence following said northerly boundary line, N90°00'OO"E a distance of 28.32 feet to a found
1/2 -inch rebar marking the northeast corner of said Lot 4;
Thence leaving said northerly boundary line and following the easterly boundary line of said Lot
4, S01°09'17"E a distance of 165.19 feet to a found 1/2 -inch rebar on the northerly right-of-way
line of E. Eagles Gate Dr. and marking the southeast corner of said Lot 4;
Thence leaving said easterly boundary line and following said northerly right-of-way, 30.31 feet
along the arc of a circular curve to the left, said curve having a radius of 328.00 feet, a delta
angle of 5°17'43", a chord bearing of N88°29'32"W and a chord distance of 30.30 feet;
Thence leaving said northerly right-of-way line, N00°28'24"W a distance of 164.37 feet to the
POINT OF BEGINNING.
Said parcel contains 4,821 sq. ft. (Q.111 acres), more or less, and is subject to all existing
easements and/or rights-of-way of record or implied.
