Findings - PZ - 1990 - Comp Plan changes - Proposed Amendments CITY OF EAGLE IN THE MATTER OF: ) ) EAGLE COMPREHENSIVE PLAN 1990) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW FINDINGS OF FACT: l. On February 26, 1990, the Eagle Planning and Zoning held a public hearing regarding the changes to the Eagle Comprehensive Plan, 1990. Notice of hearing was published on February 7, 1990 as required by Section 67-6509, Idaho Code. 2. There was no public testimony in favor or opposition given. A letter was received by Ada County Development indicating no opposition to proposed amendments to the plan. CONCLUSIONS OF LAW: l. The application for changes to the comprehensive plan complies with the requirements of law. 2. Public hearing was held in order to receive testimony of the public regarding any changes. 3. Eagle Planning and Zoning recommended the changes to Eagle City Council. 4. The changes recommended are attached as exhibit "A". 5. The Planning and Zoning Commission voted to recommend the changes to Eagle City Council, and to be presented to the City Council at the Council meeting scheduled March 13, 1990. Page 2, (2) delete "and other more severe areas" in the sentence. 2. Page II, (4) delete "flood plains", insert "floodway". Delete "provided ho'wever, industrial use shall be allowed in a limited area as specified by the Industrial Policies of the Land Use section of this plan." 3. Page 14 (5) delete ,all. 4. Page 20 (3) delete the word "large" in the first sentence and change paragraph to read: 1. "All new subdivision, PUD'S, commercial/industrial developments with densities of more than three sinqle family dwelling units per five acres shall be required t,o : (A.) be connected to a central sewer system, defined as a system that connects all units to a central treatment plant in a subdivision and prohibits all septic tanks. All sewer systems must meet Central District Health standards, (B.) A central water facility which is defined as a water system approved by the Central District Health and the Eagle City Standards and meets the requirements of firE! protection provided in the Uniform fire code as adopted by 1:he City of Eagle. "
