CITY OF EAGLE In the Matter of: ) ) SSe OUR FAMILY RESTAURANT ) Conditional use permit for ) serving beer and wine in a ) bar ) FINDING OF FACTS AND CONCLUSIONS OF LAW On May 21, 1990, pursuant to public notice and hearing procedures set forth in Section 67-6509 of the Idaho State Code, this matter came before the Eagle Planning and Zoning Commission for the City of Eagle, 141aho. The hearing was requestHd by Harlen Jensen, owner of Our Family Restaurant, for a Conditional Use Permit in order to establish the use of beer and wine in the bar and restaurant. Based on testimony froDI the applicant and interested parties, together with all docUDtuntary evidence submitted concerning the applicant, the Eagle Planning and Zoning Commission finds the following; FINDINGS OF FACTS AND CrniCLUSIONS OF LAW: 1. The records in this matter indicate all notices, and publications have occurred as required by law. The records further reflect notice of the proposed conditional use permit was sent t'D the appropriate public and private entities with no re!sponses objecting to the proposal being received from those entities; 2. On May 21, 1990 public hearing proceedings were conducted with Eagle Planninq and Zoning Commission. Testimony was favorable. 3. The application b~, Harlen Jensen for a Conditional Use Permit complies with the Eagle City Code Title 8, Section 7- 3-2, the General Stélndards for Conditional Use. The granting of the Conditional Use Permit will not violate the Idaho Code nor nullify the interest or purpose of the Eagle City Code or Eagle Comprehensive Plan. Based upon the forE!going Findings of Facts and Conclusions of Law the Eagle Planning and Zoning Commission recommends that the Conditional Use Permit for Our Family Restaurant be granted.
