FINDINGS OF FACT
AND CONCLUSIONS OF
LAW
On June 18, 1990, pursuant to public notice and hearing
procedures set forth in Section 67-6509, Idaho State Code, Victor
Johnson, the applicant, came before the Eagle Planning and Zoning
for the City of Eagle, Idaho" requesting consideration for a
subdivision.
Based on testimony from the applicant and all interested parties,
together with all documentary evidence submitted concerning the
application, the Eagle Planning and zoning Commission finds the
following:
FINDINGS OF FACT AND CONCLUSIONS OF LAW:

The records in this matter indicate all notices, and
publications have Jccurred as required by law. the records
further reflect not,ice of the public hearing was sent to the
appropriate public: and private entities with responses to
the proposal being received in the City Clerk's office from
those entities;
On June 18, 1990 public hearing proceedings were conducted
by the Eagle Planning and Zoning Commission. Testimony
received was in favor of the project;

The application ~;ubmitted by Victor Johnson dba Empire
Estates for a subdivision failes to comply with the
requirements set forth in the Eagle City Code, Title 8 and 9
and the Eagle Comprehensive Plan;

Based upon the foregoing findings of facts the Eagle
Planning and zoning Commission concludes that the
application be denied.

On June 18, 1990, The Eagle Planning Commission voted to
recommend denial to the Eagle City Council based on the
following: (1) Eagle Comprehensive Plan, page 20, Policy and
Goals, Residential, which requires a subdivision with
densities of more than three single family dwelling units
per five acres be c:onnected to a central water system.
