Findings - PZ - 1990 - Eagle Ranch Subd#5/ - Application For Subdivision CITY OF EAGLE IN THE MATTER OF EAGLE RANCH SUBDIVISION 15, APPLICATION FOR A SUBDIVISION ) ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW On June 18, 1990, pursuant to public notice and hearing procedures set forth in Section 67-6509, Idaho State Code, Robert DeShazo, the applicant, came b~fore the Eagle Planning and Zoning for the City of Eagle, Idaho, requesting consideration for a subdivision. Based on testimony from the applicant and. all interested parties, together with all documentary evidence submitted concerning the application, the Eagle Planning and Zoning Commission finds the following: FI~DINGS OF FACT AND CONCLUSIONS OF LAW: 1. The ~ecords in this matter indicate all notices, and publications have occurred as required by law. ,the records further reflect notice of the public hearing was sent to the appropriate public and private entities with responses to the proposal being received in the City Clerk's office from those entities; 2. On June 18, 1990 public hearing proceedings were conducted by the Eagle Planning and Zoning Commission. Testimony from property owners was received. 3. The application submitted by Robert DeShazo and Rowland Jones for a subdivision complies with the requirements set forth in the Eagle City Code, Title 8 and 9 and the Eagle Comprehensive Plan, with the exception of the streets, which 'do not appear to meet Eagle Ci~y standards to comply with Ada County Highway District policies. 4. The granting of a subdivision will not be possible at this time based on the status of the Homeowner Association's interest in the property has not been established and resolved. Legalities over property ownership should be resolved through the court system prior to recommendation by the Eagle Planning and Zoning Commission. 5. Based upon the foregoing findings of facts the Eagle Planning and Zoning Commission concludes that the application be denied. On June 18, 1990, 'rhe Eagle Planning and Zoning Commission voted to recommend denial of the application to the Eagle City Council. 6.
