Findings - PZ - 1990 - Cup - Cup CITY OF EAGLE IN THE MATTER OF HI VALLEY, AN APPLICATION FOR A CONDITIONAL USE PERMIT ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW On August 6, 1990, pursuant to public notice and hearing procedures set forth in Section 67-6509, Idaho State Code, Wayne Freedman the applicant, came before the Eagle Planning and Zoning Commission for the City of Eag~e, Idaho, requesting consideration for a Conditional Use Pe,rmi t . Based on testimony from the applicant and all interested parties, together with all documentary evidence submitted concerning the application, the Eagle Planning and zoning Commission finds the following: FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. 2. The records in this matter indicate all notices, and publications have occurred as required by law. the records further reflect no1:ice of the public hearing was sent to the appropriate public and private entities with responses to the proposal being received in the City Clerk's office from those entities; On August 6, 1990 public hearing proceedings were conducted by the Eagle Planning and Zoning Commission. Testimony was received; 3. The appl ication embmi t ted by the representatives for Hi Valley RV Park for a Conditional Use Permit complies with the requirements flet forth in the Eagle City Code, Title 8- 7-3-5 and the Eagle Comprehensive Plan; 4. The granting of a Conditional Use Permit will not violate the Idaho Code nor nullify the interest or purpose of the Eagle City Code, or Eagle Comprehensive Plan; 5. Based upon the :Eoregoing findings of facts the Eagle Planning and Zoning concludes that a recommendation for the application be ç'ranted be forwarded to the Eagle City Council with the following conditions: 1. must be hooked to city sewer 2. water system must be installed property and must hook up city water as soon as available 3. must meet with the Design Review Committee to approve plans 6. On August 6, 1990, The Eagle Planning and Zoning Commission voted to recommend approval to the Eagle City Council with the above noted conditions. ADOPTED by the Eagle City Planning and Zoning of the City of Eagle, Idaho. This day of September , 1990.
