FINDINGS OF FACT
AND
CONCLUSIONS OF LAW
On October 15, 1990, pursuant to public notice and hearing
procedures set forth in Section 67-6509, Idaho State Code, <>,
the applicant, came before,the Eagle Planning and Zoning
Commission for the City of Eagle, Idaho, requesting
consideration for a re~:one from R-5 to R-16 for the purpose of
multi-unit residential construction and set back variances.
Based on testimony from the applicant and all interested parties,
together with all documentary evidence submitted concerning the
application, the Eagle Planning and zoning Commission finds the
following:
FINDINGS OF FACT AND CONCLUSIONS OF LAW:

The records in this matter indicate all notices, and
publications have occurred as required by law. the records
further reflect not~ice of the public hearing was sent to the
appropriate public and private entities with responses to
the proposal being received in the City Clerk's office from
those entities;
On October 15, :L990 public hearing proceedings were
conducted by the Eagle Planning and Zoning Commission.
Testimony was received from the public;

The application st,bmitted by Lyle Pope, representative, for
a rezone and variances complies with the requirements set
forth in the EaI;Jle City Code, Title 8 and the Eagle
Comprehensive Plan;

The granting of a rezone and variances will not violate the
Idaho Code nor nullify the interest or purpose of the Eagle
City Code, or Eagle Comprehensive Plan with the conditions
of recommended approval of the Eagle Planning and Zoning
Commission;

Based upon the :Eoregoing findings of facts the Eagle
Planning and Zoning concludes that the application for
rezone from R-5 tc R-16 on lots 4,5 and 6 be granted. And,
the set back vari,:lnces be granted on lot 6 only. The Eagle
Planning and zoning recommends denial of variances for lots
4 and 5.

On October 15, 1990, The Eagle Planning and Zoning, voted to
recommend approval for said rezone to the Eagle City

Council and that él set back variance be granted on lot 6 as
follows:
North to 10 feet
East to 15 feet
South to 10 feet
West to 20 feet
the commission recommended denial of any variance on lots 4 or 5.
ADOPTED by the Eagle Planning and Zoning of the City of Eagle,
Idaho.
