ZONING ORDINANCE PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
c.
.
Eagle City Code Section 8-2-3 states in part that City approval of a conditional use
permit is required for the use of a mobile office/classroom.
Eagle City Code Section 8-2-3 (F) Effect Of Issuance On Other Conditional Uses: A
conditional use permit shall not be considered as establishing a binding precedent
to grant other conditional use permits.
.
DISCUSSION:
On July 24, 200 I, the City Council approved a conditional use permit to install two 1,200-
square foot mobile offices (portable classroom buildings) at Eagle Middle School. The
proposed addition of two portable buildings to the already existing portables emphasizes that
Eagle Middle School is currently over capacity, but the continual installation and use of
portable buildings in lieu of constructing permanent facilities is not the most desirable measure
to overcome the situation. Yet, a lack of adequate school space may be more detrimental in
the long term with regard to educational instruction than permitting portable classrooms on a
temporary basis. Therefore, consideration should be given to placing a time limit on the
existence of the portable classrooms at the school site in order to avoid an abundance of
portables. A maximum time limit should be placed on the length of stay allowed under this
permit, with the expectation that newer permanent structures will be constructed to
accommodate increased enrollment.
.
Staff has reviewed the particular facts and circumstances of this proposed conditional use and, in
terms of Eagle City Code Section 8-7-3-2 "A thru I" (required findings for approval of a
conditional use), has made the following conclusions:
.
The proposed conditional use;
A.
Will, in fact, constitute a conditional use as established in Section 8-2-3 of Eagle
City Code Title 8 for the PS zoning district since a school is a permitted use in the
PS zone and since the definition of a mobile office within Section 8-1-2 requires a
conditional use permit;
B.
Will be harmonious with and in accordance with the general objectives or with
any specific objective of the Comprehensive Plan and/or this title (Eagle City
Code Title 8) since there are no inconsistencies with the Comprehensive Plan and
since the development will be required to meet conditions of a design review
application;
C.
Will be designed, constructed, operated and maintained to be harmonious and
appropriate in appearance with the existing or intended character of the general
vicinity and that such use will not change the essential character of the same area
since the development will be required to meet the City's design review
requirements;
D.
Will not be hazardous or disturbing to existing or future neighborhood uses since
the area is currently being used as a school (Eagle Middle School) and since the
Page 5 of 11
K:\Planning Dept\Eagle ApplicationsICU\2003ICU-03-03 ccfdoc
facilities are to be buffered from any residential uses;
E.
Will be served adequately by essential public facilities such as highways, streets,
police and fire protection, drainage structures, refuse disposal, water and sewer
and schools; or that the persons or agencies responsible for the establishment of
the proposed use shall be able to provide adequately any such services as noted is
responses received by agencies providing the public services or as represented by
the applicant's architect.
F.
Will not create excessive additional requirements at public cost for public
facilities and services and will not be detrimental to the economic welfare of the
community since the middle school has already been reviewed and approved;
G.
Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare
by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
H.
Will have vehicular approaches to the property which are designed as not to create
an interference with traffic on surrounding public thoroughfares as previously
approved for the school site; and
I.
Will not result in the destruction, loss or damage of a natural, scenic or historic
feature of major importance since none are apparent on this site.
