Eagle Road BEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION FOR A DESIGN REVIEW FOR A MASTER SIGN PLAN FOR SMITH'S EAGLE CHEVRON FOR RICK AND SANDY SMITH ) ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR-68-03 The above-entitled design review application came before the Eagle Design Review Board for their action on December 11, 2003. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Rick and Sandy Smith, represented by Neil Caldwell with Idaho Electric Signs Inc., are requesting design review approval of a master sign plan for Smith's Eagle Chevron. The site is located on the west side of South Eagle Road within Channel Center Subdivision at 503 South Eagle Road. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on November 17, 2003. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On February 12, 1998, the Eagle Design Review Board approved a design review sign application for the signage the Smith's Eagle Chevron convenience store with fuel island canopy (DR-02-98). On February 22, 2000, the Eagle City Council approved a modification to the design review sign application for the Smith's Eagle Chevron convenience store with fuel island canopy to allow internal illumination (DR-02-98 MOD). On September 18, 2001, the Eagle City Council approved a design review sign application for the Emissions Testing Service located within the car wash facility of the Smith's Eagle Chevron convenience store with fuel island canopy (DR-56-01). On November 11, 2003, the Eagle City Council approved a conditional use permit to allow a building expansion to the Smith's Eagle Chevron convenience store with fuel island canopy (CU- 09-03). D. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING TillS PROPOSAL: . Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". . Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. . Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. . Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. . Eagle City Code Section 8-2A-8(C)(l) Sign materials and overall appearance shall compliment the building architecture and colors as determined by the Design Review Board. . Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the Design Review Board and City Council to be consistent with the Eagle Architecture theme. . Eagle City Code Section 8-2A-8(E)(2) Prohibited illumination: . a. Eagle City Code Section 8-2A-8(K)(1) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. . Eagle City Code Section 8-2A-8(L)(9) Other PortablelTemporary Signs: A-frame, sandwich board, sidewalk. banner. pennant and similar signs shall be permitted for a maximum of thirty (3) days (days need not be consecutive) within any three (3) calendar months if the following criteria .is complied with. C. DISCUSSION: . On February 12, 1998, the Eagle Design Review Board approved a design review sign application (DR-2-98) for the monument sign and non illuminated building wall and canopy signs for the Smith's Eagle Chevron. On February 22,2000, the Eagle City Council approved a modification to the design review sign application (DR-2-98 MOD) to allow the building wall and canopy signs to be internally illuminated. Upon approval of the modification to the design review sign application, the applicant modified the Food Mart sign on the convenience store, the Chevron sign on the fuel island canopy, and the Chevron cabinet sign on the fuel island canopy to internally illuminated signs. The car wash sign was permitted to become internally illuminated; however, the sign was never changed to an internally illuminated sign. Because the applicant does not desire to change the illumination of the car wash sign, the sign is to remain externally illuminated until January 1. 2007, at which time the sign will be required to comply with the master sign plan and Eagle City Code which requires the sign to be halo illuminated or illuminated with exposed neon. Since the applicant is not proposing any changes to the Food Mart sign on the convenience store or the fuel island canopy signs, the signs may remain as internally illuminated building wall signs until January 1, 2007, at which time the signs should be required to comply with the master sign plan and Eagle City Code which requires the signs to be halo illuminated or illuminated with exposed neon. . On September 18, 2001. the Eagle City Council approved a design review sign application for one (1) special portable sign and one (1) building wall sign for the Chevron Emissions Testing Service located within the car wash facility. Currently, the applicant is utilizing the following signs: Special portable sign located on the pathway adjacent to Eagle Road - "Emission Test Open". Building wall sign located near the southeast comer of the site - "Emission Test" stating hours of operation. Sidewalk sign located at the entrance to the emission testing drive thru - "Emission Test Here". Banner sign located on the man door of the emission testing facility - "Emission Test Open". Per Eagle City Code, other portable/temporary signs are permitted for a maximum of thirty (30) days within any three (3) calendar months. The banner sign hanging on the man door of the emission testing facility and the sidewalk sign located at the entrance to the emission testing drive thru have exceeded the thirty (30) days permitted within any three (3) calendar months. On October 28, 2003, the Eagle City Council approved the use of the red Emission Testing van for sign age for this facility. The applicant should be required to remove the banner sign hanging on the man door of the emission testing facility and the sidewalk sign located at the entrance to the emission testing drive thru. The signs should be removed prior to the City issuing a zoning certificate for this site. . The applicant is proposing to construct a community event/information reader board building wall sign on the south elevation of the car wash facility. The size of the reader board area complies with Eagle City Code with regard to the size and is to be used to promote community events (i.e.: school functions or games, Eagle Fun Days, etc.). The reader board area is not permitted to be used to promote or advertise the sale of products or services provided at this site. The applicant should be required to provide a revised master sign criteria outline. The revised master sign criteria should be reviewed and approved by staff prior to the City accepting any sign permits for this site. Staff recommends the following changes to the applicant's document titled "Master Sign Program, Eagle Road Chevron, December 2003", with strike thru text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. Master Sign Plan Program Eagle Road Chevron December 2003 . This master sign plan progt"aIB is for the purpose of establishing criteria for a multi-tenant use of the property and to ensure consistency and harmony regarding the signage. 1. All wall signs shall be internally illuminated and of individual channel letter design wi-#¡. the exeeptioB of possiBle 13l:1llet eabiRets to iRcorporate a grapHic or deseriptioR of the aøtivity. All internal illumination shall consist of halo illumination or open channel letter design (exposed neon). 2. No free-standing signs other than the monument sign on Eagle Road will be permitted for tenant identification with the exception of a special portable sign for the emission testing tenant. 3. A non-illuminated public service sign map will be permitted on the car wash building to promote information for the visiting public. The reader board area is not permitted to be used to promote or advertise the sale of products or services provided at this site. 4. Banners, window vinyls and seasonaUcommunity event advertisements are permitted by shall comply with Eagle City Code. 5. The background color of all tenant panels on the monument sign are required to be Chevron Grey. Individual text style and color are permitted. . Staff defers comment regarding design and color of all proposed signs to the Design Review Board. PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on December 11, 2003, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 3 to 0 (Floegel, McCullough, Stanger, and Zastrow absent) to approve DR-68-O3 for a design review application for a master sign plan for Smith's Eagle Chevron for Rick and Sandy Smith, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with strike thru to be deleted by the Board and text shown with underline to be added by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. The "Food Mart" and two fuel island canopy signs shall remain internally illuminated until January I, 2007, at which time the signs shall be required to comply with the master sign plan and Eagle City Code which requires the sign to be halo illuminated or illuminated using exposed neon. 2. The "Car Wash" sign shall remain externally illuminated until January 1. 2007, at which time the sign shall be required to comply with the master sign plan and Eagle City Code which requires the sign to be halo illuminated or illuminated using exposed neon. 3. The banner sign hanging on the man door of the emission testing facility~ aøtl the sidewalk sign located at the entrance to the emission testing drive thru, and the special portable sign located adjacent to Eal!le Road shall be removed prior to the City issuing a zoning certificate for this site. 4. The size of the reader board area complies with Eagle City Code with regard to the size and shall be used to promote community events (i.e.: school functions or games, Eagle Fun Days, etc.). The reader board area is not pennitted to be used to promote or advertise the sale of products or services provided at this site. Provide elevation plans showing the Community Eventllnformation Reader Board sign located on the south building elevation of the car wash facility. 5. The applicant shall be required to provide a revised master sign criteria outline. The revised master sign criteria shall be reviewed and approved by staff prior to the City accepting any sign pennits for this site. Master Sign Plan Eagle Road Chevron December 2003 This master sign plan is for the purpose of establishing criteria for a multi-tenant use of the property and to ensure consistency and harmony regarding the signage. 1. Provide a revised elevation plan showing the "Car Wash" sign to be non illuminated. The revised elevation plan shall be reviewed and approved by staff prior to the City issuing a zoning certificate for this site. 7. The floodlights used to illuminate the monument sign shall be screened or located so they do not shine onto the roadway or onto any nearby property. The light fixtures shall be concealed or screened with perimeter landscaping providing a 12 month screen of sufficient height and density to conceal such fixtures. 8. Interior illumination is not permitted for monument signs. 9. The elevation plan showing the "New York Burrito - Gourmet Wraps". date stamped by the City on December 11, 2003, is approved. 10. The elevation plan showing two additional tenant panels at the base of the monument sign located adjacent to Eagle Road, date stamped by the City on December 1. 2003, is approved. 11. Only the emission testing building wall sign located on the south building elevation of the car wash facility and to the east of the man door is approved. The applicant may modify the existing building wall sign to include additional information regarding this business. A revised elevation plan showing how the additional information will be incorporated shall be reviewed and approved by staff prior to the City issuing a zoning certificate for this site. 12. The red traffic cones that are currentlv used on the south side of the emission testing drive thru lane shall be removed and only utilized during times of inclement weather when the striping on the asphalt is not visible. Provide a site striping plan showing the emission testing drive thru lane clearly striped (i.e.: arrows, enter, exit, etc.). The site striping plan shall be reviewed and approved by staff prior to the issuance of a zoning certificate for this site. 13. The elevation plan of the Community Events/Information Reader Board date stamped by the City on November 21. 2003, is approved with the elimination of the AmeriGas logo from the propane tank and the addition of an arrow indicating the tank location. Provide a revised elevation plan showing the elimination of the AmeriGas logo from the propane tank and the addition of an arrow indicating the propane tank location. The revised elevation plan shall be reviewed and approved by staff prior to the City issuing a zoning certificate for this site. 14. The red emission testing van may be utilized during business hours. During non-business hours the emission testing van shall be removed from the site. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. Approval shall expire without notice to the applicant on the date of expiration of this Design Review. as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on November 17, 2003. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-68-03) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 3. The Design Review Board recommends that this site be monitored by the City Code Enforcement Office to insure compliance with said requirements within this report and with Eagle City Code.
