FINDINGS OF FACT AND CONCLUSIONS OF LAW
CASE NUMBER DR-44-03
The above-entitled design review application came before the Eagle Design Review Board for their action
on September 11,2003. The Board continued the item to November 13, 2003, and made their decision at
that time. The Eagle Design Review Board having heard and taken oral and written testimony, and having
duly considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
David Waldron, represented by Tony Meade with Idaho Electric Signs Inc., is requesting design
review approval of a master sign plan for six office buildings within Cottonwood Creek
Subdivision. The master sign plan includes a total of two (2) monument signs for all six (6) office
buildings and building wall signage for each of the office buildings. The site is located on the
west side of Eagle Road, approximately 3,500-feet north of Chinden Boulevard at 2421 North
Eagle Road.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on August 7,2003.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On April 9, 2002, the Eagle City Council approved a comprehensive plan amendment from
Residential Two to Mixed Use and a rezone with development agreement from A-R to L-O-DA-P
for this site.
On September 10, 2002, the Eagle City Council approved a conditional use permit, preliminary
development plan, and preliminary plat for Cottonwood Creek PUD Subdivision (CU-5-02/PPUD-
1-02/PP-2-02).
On August 27, 2002, the Eagle City Council approved a design review application for the six
office building and common area landscaping within Cottonwood Creek (DR-38-02).
On April 8, 2003, the Eagle City Council approved the final development plan and final plat for
Fresh Creek PUD Subdivision (formerly Cottonwood Creek PUD Subdivision) (FPUD-I-03 &
PF-I-03).
On August 27, 2003, the Eagle City Council approved a design review sign application for the two
monument signs for Cottonwood Creek Subdivision (DR-43-02).

The general theme of the Design Review Overlay District is to encourage the use of American
Northwest and 1870 through 1930 architectural styles and the use of those materials, graphics and
architectural designs set forth in the DR chapter.

Signage for any project shall provide for business identification and minimize clutter and
confusion on and off the site. Signs are to provide effective and necessary business identification
systems adapted to the building design.

No signs shall be erected or maintained in any district as established by the Zoning Ordinance
except those signs specifically enumerated in this Chapter, The number and area of signs as
outlined in this Chapter are intended to be maximum standards which do not necessarily
ensure architectural compatibility. Therefore, in addition to the enumerated standards,
consideration shall be given to a sign's relationship to the overall appearance of the subject
property as well as the surrounding community. Compatible design, simplicity and sign
effectiveness are to be used in establishing guidelines for sign approval.
Section 8-2A-8(C)(5)
Sign materials and overall appearance shall compliment with the building architecture and
colors as determined by the Design Review Board.
C. DISCUSSION:
.
The developers of Cottonwood Creek Subdivision received approval from the City Council on
August 27, 2003, for two monument signs at the entrance to Cottonwood Creek Subdivision (DR-
43-02), The applicant is proposing with the subject application to locate a monument sign on the
east side of the meandering sidewalk on Eagle Road. There are several factors regarding the
placement of this proposed monument sign that have raised concerns with City staff. First, as
shown in the approved landscape plan for Cottonwood Creek Subdivision, a three inch (3")
Parkway Maple tree is to be located approximately twenty three feet (23') north of the proposed
monument sign. Second, the tenant panels on the monument sign are proposed to be six inches
(6") high by two feet, four inches (2' 4") wide. Finally, the speed limit for the section of Eagle
Road abutting this site is 55 MPH. It is staffs opinion that the high vehicular speeds on Eagle
Road, the small size of the tenant panels, and the location of the Parkway Maple tree would make
it difficult for passing motorists to read the tenant panels on the monument sign. In addition, the
subdivision monument signs, which were previously approved for Cottonwood Creek Subdivision,
are located on the north and south side of the entrance to the subdivision providing sufficient
signage for this development. For the above mentioned reasons, staff believes that the monument
sign on Eagle Road is not needed nor will it provide adequate identification for the individual
tenants and should not be constructed.
The applicant is proposing to construct two (2) eight foot (8') high monument signs for tenants to
place their name on for identification, It appears that the face of the monument sign is monoplane
with vinyl graphics. The proposed monument signs are lacking any architectural relief and do not
compliment the architecture of the six (6) office buildings within Cottonwood Creek Subdivision.
Pursuant to past action by the Design Review Board and City Council, monument sign faces have
not been permitted to be merely monoplane with vinyl graphics. Further, Eagle City Code requires
sign materials and overall appearance to compliment the building architecture and colors. The
applicant should be required to provide revised elevations of the monument signs showing
additional dimension on the face of the sign by using raised graphics and letters and additional
architectural relief by the use of materials so as to compliment the architecture of the buildings,
The revised elevations should be reviewed and approved by the Design Review Board prior to the
City accepting any sign permits for this site,

The applicant should be required to provide a revised master sign criteria outline addressing the
aforementioned items. The revised master sign criteria should be reviewed and approved by staff

prior to the City accepting any sign permits for this site. Staff recommends the following changes
to the applicant's document titled "Master Sign Plan Cottonwood Creek" with strike thru text to be
deleted and underlined text to be added to be in compliance with Eagle City Code:
This master sign criteria program is intended to provide a visually coordinated, balanced and
appealing signage environment for the project.

will be "Optima", copy color to be black on white background.
3, Building sign age will consist of cast metal letters identifying the building by letter (Le.: A.
B. C. etc.) with wall plaques at the left and right of doorways beneath the letter for tenant
identification. The font to be used by the tenants on the wall plaques shall be "Optima
Semi-Bold". No other building signage will be permitted with the exception of window
vinyls.
4. Window vinyls are limited to brushed silver vinyl~ aBly indicating the name of the business
and hours of operation only and shall comply with Eagle City Code.
5. The monument ¡\ll prof1oseà signs æ:e-te shall be externally flood illuminated by ground
mounted light fixtures.
ST AFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site
specific conditions of approval and the standard conditions of approval provided within the staff
report.
PUBLIC MEETING OF THE BOARD:
A. A meeting was held on the application before the Design Review Board on September 11, 2003. The
application was continued to November 13, 2003, at which time the Board made their decision.
B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one.
C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DECISION:
The Board voted 5 to 1 (Floegel against, Christensen absent) to approve DR-44-03 for a design
review application for a master sign plan for six office buildings within Cottonwood Creek
Subdivision for Cottonwood Creek, with the following staff recommended site specific conditions
of approval and standard conditions of approval with text shown with strike thru to be deleted by
the Board and text shown with underline to be added by the Board.

5. A sign permit is required prior to any signs being constructed within this development.
6. Interior illumination is not permitted for monument signs.
STANDARD CONDITIONS OF APPROVAL:
1. A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from the Design Review Board approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the
Commission and/or Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for
review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, will require submittal of an application for modification and
approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application.

shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
1. The application for this item was received by the City of Eagle on August 7, 2003.
2. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-44-03) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
