Findings - DR - 2002 - DR-70-01 MOD - Sign Plan Eagle Medallion Professional Center & Wall Signs For Customedica / Clinic At Eagle & American Express BEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION FOR A MODIFIED DESIGN REVIEW FOR A MASTER SIGN PLAN FOR EAGLE MEDALLION PROFESSIONAL CENTER INCLUDING BUILDING WALL SIGNS FOR CUSTOMEDICA PHARMACY, THE CLINIC AT EAGLE, AND AMERICAN EXPRESS FINANCIAL ADVISORS FOR EAGLE VILLAGE LLC ) ) ) ) ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR- 70-01 MOD The above-entitled design review modification application came before the Eagle Design Review Board for their action on December 12,2002. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Eagle Village LLC, represented by Debbie Anderson with Idaho Electric Sign Co., is requesting design review approval to modify the master sign plan for the Eagle Medallion Professional Center. This application includes the approval of three building wall signs for CustoMedica Pharmacy, The Clinic at Eagle, and American Express Financial Advisors. The site is located on the north side of State Street approximately 300-feet west of Palmetto Avenue at 600 and 700 East State Street. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on November 7, 2002. C. NOTICE OF PUBLIC HEARING: Notice of this public hearing was mailed to property owners abutting the subject property in accordance with Eagle City Code on November 22, 2002. D. HISTORY OF RELEVANT PREVIOUS ACTIONS: On April 13, 1999, the Eagle City Council approved two professional office building for this site (DR- 7-99). On January 11, 2000, the Eagle City Council approved two monument signs for the Eagle Medallion Professional Center (DR-42-99). On January 8, 2002, the Eagle City Council approved a design review application for the master sign plan for Eagle Medallion Professional Office buildings (DR- 70-0 I). E. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: (None) B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . The general theme of the Design Review Overlay District is to encourage the use of American Northwest and 1870 through 1930 architectural styles and the use of those materials, graphics and architectural designs set forth in the DR chapter. Signage for any project shall provide for business identification and minimize clutter and . Signs are to provide effective and necessary business identification systems adapted to the building design. Section 8-2A-8(K)(1) . No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. Section 8-2A-8(C)(5) . Sign materials and overall appearance shall compliment with the building architecture and colors as determined by the Design Review Board. Section 8-2A-8(C)(9) . Any comer business within a multi-tenant building shall be allowed two (2) wall signs. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the Design Review Board. Section 8-2A-8(L)(7) Temporary Sign In Lieu Of Permanent Wall Sign: A business identification banner, or similar sign, may be permitted on a temporary basis, not to exceed one hundred twenty (120) days, during approval and construction of any wall sign for a new business. Said sign shall not be larger than the wall sign that would be permitted per this Title, shall only be located on the face of the building where the wall sign would be permitted per this Title, and shall be removed when the permanent sign is installed, not to exceed one hundred twenty (120) days. C. DISCUSSION: . The applicant is proposing to construct a sign band area to be located in the gable over the entry doors to each tenant space. The sign band area is proposed to be constructed of a thirteen foot nine inch (13' 9") wide by two foot (2') high by two millimeter (2mm) thick dibond material attached to the existing metal frame. Decorative vinyl graphics are proposed to be installed on the face of the sign band area. A three-fourth inch (3/4") thick MDX (high density wood product) material with the address in vinyl and centered horizontally is proposed to be mounted at the top of the sign band. Each tenant sign is proposed to be constructed of three-fourth inch (3/4') thick MDX material with vinyl text and logos adhering to the face ofthe MDX material. On January 8, 2002, the Eagle City Council approved a master sign plan for the Eagle Medallion Professional Center (DR-70-01). The master sign plan criteria date stamped by the City on October 30, 2001, required tenant signs to be dimensional (i.e.: no painted plywood). The materials permitted to be used in the construction of the signs were carved wood, high-density urethane, metal or other similar industrial materials. The revised master sign plan criteria date stamped by the City on November 7, 2002, still requires tenant signs to be dimensional (i.e.: no painted plywood) and constructed of the same materials as previously required. As City staff reviewed the elevation plans submitted with the modification to the master sign plan criteria it became apparent that the proposed modifications to the master sign plan do not provide much horizontal dimension on the sign band area or on each individual tenant building wall sign. The City does not consider vinyl a dimensional material. However, if the City determines that the proposed sign band area and the individual tenant building wall signs are acceptable the applicant should delete the word "dimensional" from the master sign plan criteria. The applicant should be required to provide a revised master sign criteria outline. The revised master sign criteria should be reviewed and approved by staff prior to the City accepting any sign permits for this site. Staff recommends the following changes to the applicant's document titled "Master Sign Plan for Eagle Professional Center 600 and 700 East State Street, Eagle Idaho, November 7, 2002" with strike thru text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. 2.) Maximum display~ height on the sign band area shall not exceed 18"-.h.iih x 5'~ unless a single business uses the entire entrance in which case the siJlll area may be 18" high by 10' wide. All displays will be installed vertically and horizontally centered on the sign band area at a consistent bottom height 'llith others. 3.) Wording will be limited to trade names and descriptions of the business~ with-a maximum length to be determined accordißg to lease frontage and City code restriction. 7.) Miscellaneous: a.) Monument signs to coordinate with entrance eave signs and will be installed on a consistent background color to match the color of the siJlll band area. c.) All penetrations of the sign band area building structure required for sign installation shall be neatly sealed in a watertight condition upon removal of signs. e.) Upon removal of the signs or termination of the lease, Tenant shall leave the ~ band area fa56ia and/or the tenant panels of the monument sign in good condition, reasonable wear and tear expected. Without limitations, Tenant shall be specifically required to fill in, in a workmanlike manner, any holes in the ~ band area fa56ia and repaint to approximate siJlll band area building color. g.) Banner signs will be used temporarily awaiting permanent approval and/or announcing certain promotional features (i.e.,: flu shots, senior physicals) in accordance with the City of Eagle requirements for temporary siJllls and special portable siJllls guidelines. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC HEARING OF THE BOARD: A. A public hearing on the application was held before the Design Review Board on December 12, 2002, at which time testimony was taken and the public hearing was closed. The Board made their decision at that time. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant). SITE SPECIFIC CONDITIONS OF APPROVAL: 1. The sign band area shall be considered the thirteen foot nine inch (13' 9") wide by two foot (2') high by two millimeter (2mm) thick dibond material attached to the existing metal frame in each gable area. All building wall signs shall be installed on the sign band area in compliance with the "Master Sign Plan for Eagle Professional Center 600 and 700 East State Street, Eagle, Idaho, November 7, 2002" (attached hereto) and Eagle City Code. 2. The dentistry sign for Dr. Donald E. Larson, DMD, is not proposed with this application. Dr. Donald E. Larson, DMD, shall be required to submit detailed elevation plans showing the construction of a building wall sign in compliance with the "Master Sign Plan for Eagle Professional Center 600 and 700 East State Street, Eagle, Idaho, November 7, 2002" and Eagle City Code. The detailed elevation plans shall be reviewed and approved by staff prior to the City issuing a sign permit to Dr. Donald E. Larson, DMD. 3. Provide a revised master sign criteria outline showing the following changes to the applicant's document titled "Master Sign Plan for Eagle Professional Center 600 and 700 East State Street, Eagle Idaho, November 7, 2002" with strike thru text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. 2.) The detailed mounting information shall be reviewed and approved by staff upon submittal of a sign permit for this site. S. A sign permit is required prior to a sign being constructed on this site. Provide a revised elevation plan showin2 the sign band area (l14-inch thick dibond) profile sculpted to be identical to the p"een accent band shown on page 1 of the elevations plans date stamped by the City on November 7.2002. The revised elevation plan shall be reviewed and approved by staff prior to the City accepting a sign permit for this site. 8. Individual banner signs that are currently displayed shall be removed prior to the installation of a building wall sign for each tenant. 9. Provide documentation that the size (hei~ht and width) of the buildinll identity of "600" and "700" East State Street are in compliance with Ea~le City Code (includinll both the Uniform Buildinll Code and the Uniform Fire Code). The documentation shall be reviewed and approved by staff prior to the City accepting a sign permit for this site. 10. Provide a revised elevation plan showing the buildinll wall sign for American Express Financial Advisors being increased in size vertically to a maximum height of ei~hteen inches (18") and horizontally to a maximum width of five feet (5') to be in better proportion with the other signs proposed with this application. The revised elevation plan shall be reviewed and approved by staff prior to the City acceptinll a sign permit for this site. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. The application for this item was received by the City of Eagle on November 7,2002. 2. Notice of this public hearing was mailed to property owners abutting the subject property in accordance with Eagle City Code on November 22, 2002. 3. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-70-01 MOD) with regard to the Eagle City Code Title 8, Chapter 2, Article A. DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan.
