Findings - DR - 2002 - DR-15-02 - Master Sign Plan For The Eagle River Development BEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION FOR) A DESIGN REVIEW FOR A MASTER SIGN PLAN) FOR THE EAGLE RIVER DEVELOPMENT ) FOR EAGLE RIVER LLC ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR-15-02 The above-entitled design review application came before the Eagle Design Review Board for their action on June 12, 2002. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Eagle River LLC, represented by Debbie Anderson with Idaho Electric Signs, is requesting design review approval of a master sign plan for the entire Eagle River Development. The site is located on the southeast corner of Eagle Road and State Highway 44. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on February 15,2002. C. NOTICE OF PUBLIC HEARING: Notice of this public hearing was mailed to property owners abutting the subject property in accordance with Eagle City Code on May 24, 2002. D. HISTORY OF RELEVANT PREVIOUS ACTIONS: On March 14, 2002, the Eagle Design Review Board reviewed the draft master sign plan for the Eagle River Development. On April 25, 2002, the Eagle Design Review Board remanded the master sign plan application back to staff for additional review per staff and the applicant's request. On April 10, 2001, the Eagle City Council approved a design review application for the common area landscaping and subdivision signage for Eagle River Development (DR- 70-00). E. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: (None) B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . The general theme of the Design Review Overlay District is to encourage the use of American Northwest and 1870 through 1930 architectural styles and the use of those materials, graphics and architectural designs set forth in the DR chapter. . Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. Signs are to provide effective and necessary business identification systems adapted to the building design. . Section 8-2A-8(K)(1) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. . Section 8-2A-8(C)(3) Monument signs, including the base of the sign, shall not exceed eight feet (8') in height (or 15 feet depending upon the location as defined in this Chapter) from the center line of the adjacent roadway or top of curb, if one exists. . Section 8-2A-8(C)(4) The total area of any sign attached to, or painted on the face of a building shall not exceed ten percent (10%) of the total surface area of the building face to which it is attached or painted, however five percent (5%) shall be the maximum surface area to be permitted by the Design Review Board if internal illumination is proposed and if such proposed internal illumination is subsequently approved by the Board. Whenever the Board approves an internally illuminated sign the Board must find that the proposed internally illuminated sign is in accordance with the provisions stipulated within subsection E of the Section, as well as any other applicable regulations stated within this Title. . Section 8-2A-8(C)(8) Each business within a single building shall be allowed one wall sign for every street it fronts and the entire building shall be permitted one monument sign for every street it fronts. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the Design Review Board. . Section 8-2A-8(C)(9) Any corner business within a multi-tenant building shall be allowed two (2) wall signs. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the Design Review Board. . Section 8-2A-8(E) Sign Illumination: 1. The Design Review Board must find that any internally-illuminated sign which may be permitted under the specific regulations within this Chapter shall be designed such that brightness levels shall be controlled to assure a soft subtle effective light in accordance with other City regulations intended to create and maintain the American Northwest 1870s'to 1930s' architectural appeal. A maximum of 430 milliamps may be permitted for any internally illuminated sign subject to Design Review Board approval. . Section 8-2A-8(F) Landscaping: Landscaping shall be provided at the base of all pylon, detached street signs, pole signs, and monument signs. The amount required shall be three (3) times the size of the largest exposed surface. . Section 8-2A-8(I)(13) Off-premises signs. No sign shall be permitted which is not related to the property upon which it is located, or to the activity being conducted thereon. The applicant is proposing a master sign plan for the entire Eagle River Development that will act as a guideline for all proposed signs within this development. This is a large development and the proposed uses and architectural style of buildings proposed within this development are unknown at this time. The applicant and staff anticipate that there is the possibility that this master sign plan will need to be modified to accommodate unforeseen circumstances and signage needs in the future. All buildings (including both single tenant and multi-tenant) will be required to submit a design review application for review and approval of all building wall signs by the Design Review Board (to be reviewed for compliance with Eagle City Code and this master sign plan document). However, it is the intent of this master sign plan to grant approval of the architectural ~ and general location of all monument signs within the entire development so as to comply with the guidelines of the master sign plan and Eagle City Code. Exhibit I shows the proposed locations for all monument signs (a maximum of thirty six (36) monument signs are shown). No additional monument signage will be allowed unless the City approves a modification to this master sign plan. It is proposed with this application that individual monument sign lettering may be reviewed and approved at staff level. Monument sign lettering must comply with Eagle City Code Section 8-2A-8(D)(2) and this master sign plan. On April 10, 2001, the Eagle City Council approved the common area landscaping within Eagle River Development (DR- 70-00). This approval also included the approval of five subdivision signs located at the two entrances on Eagle Road and the southeast corner of Eagle Road and State Highway 44. For the purpose of this application the applicant has provided the approved elevations (Exhibit A, B, and C) and has indicated on a site plan the approved location of these five signs. The applicant is proposing two new subdivision monument signs (Exhibit B) to be located on the east and west sides of the future north/south entrance to the development on State Highway 44. The monument signs are proposed to match the approved monument signs which are to be located on the north and south side of Eagle River Street at Eagle Road. The applicant should be required to provide a landscape plan showing the required landscaping around the base of the monument signs proposed at the future north/south entrance to the development on State Highway 44. The landscape plan should be reviewed and approved by staff and one member of the Design Review Board prior to issuance of a sign permit. A permit to construct these two signs should not be issued until and unless the future north/south roadway and intersection is completed. . . . The applicant is proposing a new subdivision monument sign (to be constructed at this time) at the east entrance into the development on Riverside Drive (Exhibit E). This monument sign is proposed to be constructed in a "V" shape to provide signage on Riverside Drive and State Highway 44. The overall height of this sign is proposed to be nine feet two inches (9' 2") high. This height exceeds the eight feet (8') maximum that is permitted per Eagle City Code. The square footage of the face of the sign is proposed to be sixty two (62) square feet. This square footage exceeds the fifty (50) square feet that is permitted per exposed surface of the sign. The applicant should be required to provide a revised elevation of the proposed "V" shaped sign located at the east entry showing that the overall height of the sign does not exceed eight feet (8') and showing the exposed surface of the sign does not exceed fifty (50) square feet. The revised sign elevations should be reviewed and approved by staff prior to issuance of a sign permit. The proposed master sign plan allows internally illuminated wall signs on ~buildings but prohibits internally illuminated wall signs on the professional office buildings and all other buildings within the development. Per Eagle City Code and this master sign plan, internally . The applicant is proposing to allow back lit (also called halo lit) signs on all monument signs and all building wall signs. A back lit building wall sign would be permitted to be constructed as a maximum of 10% of the total surface area of the building face if it is considered non-internally illuminated. It is staff's recommendation that back lit signs should be considered non-internally illuminated and be permitted for monument and building wall signs. The monument signs and building wall sings should be in compliance with Eagle City Code regarding the size of the monument face (maximum of 50-square feet) and percentage of the building wall sign (maximum of 10% of the surface area ofthe building face) for non-internally illuminated signs. This development has several proposed buildings that will not have street frontage on the interior streets of the Eagle River Development and several proposed buildings that will not have street frontage on Eagle Road or State Highway 44. Per Eagle City Code, each building is permitted one monument sign for every street it fronts and no signs are permitted to be located upon any property which is not related to the activity being conducted thereon. In a recent meeting City staff had with the applicant, it was proposed as part of the master sign plan process that buildings that do not have street frontage on an internal street within the development should be allowed to share a monument sign with a building that does have street frontage on the interior streets within the development (see attached site plan Exhibit J noting which buildings are to share a monument sign). . . The applicant has proposed seven (7) monument signs along State Highway 44 and three (3) monument signs along Eagle Road (not including entry signs) for business signage within the development. As part of this master sign plan the buildings or areas as noted on Exhibit K should be allowed to share a monument sign on Eagle Road or State Highway 44. All proposed signage for retail and office uses within the Eagle River Development shall comply with Eagle City Code and the attached document titled "Eagle River Master Sign Plan" stamped "ORIGINAL" and dated by the City on May 14,2002, including the modifications listed below. Staff recommends the following changes to the applicant's document titled "Eagle River Master Sign Plan" with strike thru text to be deleted and underlined text to be added. The applicant should be required to provide a revised master sign criteria outline. The revised master sign criteria should be reviewed and approved by staff prior to issuance of any sign permits. THE RULES Reverse plan channel backlit halo illuminated individual letter signs will be permitted on all entry signs located on Highway 44 and Eagle Road (similar to Exhibits F. G, and H). The building signs on the office buildings may be halo illuminated (similar to Exhibits F. G. and H) or flood lit. 4) Internal loop signs will be permitted in the locations shown on the attached site plan titled "Ea~le River Development Master Si~ Plan" for @aeH fJare@l to identify Tenants and Users within the sub development areas. The internalloo.p si pls are permitted to move no more than 50-feet from the approved location as shown on the attached site plan but shall be in compliance with Ea~le City Code Section 8-2A- 8(D)(2) re~ardin~ spacin~ and placement of monument si pls. Those signs must adhere to the materials and design elements of the attached designs. Signs will be permitted on the north side of the walkway along Highway 44 in the approximate locations shown on the site plan titled "Ea~le River Development Master Si jpl Plan" subject to staff review and approval. Signs for the retail building are permitted at 15' height, all others 8' on Eagle Road and Highway 44 as indicated on the site plan. The buildin~s ~enerally shown on Exhibit K in areas 1. 2. 3. 4. 5. 6. 7. 8, 9. and 10 shall be required to share a monument si~ located on State Hi~hway 44 or Ea~le Road. 18) Directional signs shall be permitted subject to Eagle River and City approval and verification of location and shall be consistent with material and design elements as per Exhibit D and are shown on the site plan titled "Ea¡le River Development Master Si~ Plan" Per Eagle City Code, landscaping is required at the base of all monument signs to be three (3) times the size of the largest exposed surface of the sign. All proposed monument signs should be required to provide a landscape plan showing the required landscaping at the base of all the proposed monument signs (three (3) times the size of the largest exposed surface of the sign). The landscape plan should be reviewed and approved by staff and one member of the Design Review Board prior to issuance of a sign permit. . No ground-mounted lights have been proposed to illuminate the monument signs within this development. The applicant should be required to provide details of any ground-mounted lights to be used to illuminate the monument signs showing the type of lighting (i. e. low pressure sodium or high pressure sodium) and wattage. The light fixture to be used should be the same fixture to be used throughout the entire development to illuminate any monument signs to provide similarity in lighting as has been proposed with the construction of monument signs within the development. The light detail should be reviewed and approved by the Design Review Board prior to issuance of any sign permits. Staff defers comment regarding design and color of all proposed signs to the Design Review Board. . STAFF RECOMMENDATION PROVIDED WITIDN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC HEARING OF THE BOARD: A. A public hearing on the application was held before the Design Review Board on March 14,2002, at which time testimony was taken and the public hearing was closed. On April 25, 2002, the Board remained this item back to staff. A public hearing on the application was held before the Design Review Board on June 13, 2002, at which time testimony was taken and the public hearing was closed. The Board made their decision at that time. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant). SITE SPECIFIC CONDITIONS OF APPROVAL: 1. Each individual building and multi-tenant building proposed within this development shall be required to submit a design review application to be reviewed and approved by the Design Review Board. 2. No additional monument signage will be allowed unless the City approves a modification to this master sign plan. Individual monument sign lettering may be reviewed and approved at staff level. Monument sign lettering shall comply with Eagle City Code Section 8-2A-8(D)(2) and the Eagle River Development Master Sign Plan. 3. The buildings generally shown on Exhibit J in areas 1, 2, 3, 4, 5, 6, and 7 shall be required to share an internal monument sign. 17) Perimeter pad site monument signs will be permitted along Eagle Road and the Highway 44. Those signs must adhere to the materials and design elements of the attached designs. Signs will be permitted on the north side of the walkway along Highway 44 in the approximate locations shown on the site plan titled "Eagle River Development Master Sign Plan" subject to staff review and approval. Signs for the retail building are permitted at 15' height, all others 8' on Eagle Road and Highway 44 as indicated on the site plan. The buildings generally shown on Exhibit K in areas 1,2,3,4,5,6, 7, 8, 9, and 10 shall be required to share a monument sign located on State Highway 44 or Eagle Road. 18) Directional signs shall be permitted subject to Eagle River and City approval and verification of location and shall be consistent with material and design elements as per Exhibit D and are shown on the site plan titled "Eagle River Development Master Sign Plan" 22) Buildings which are designed with mansard roofs will be permitted the same allowances as those with standard walls or sign bands as approved by the City of Eagle. 12. Provide a landscape plan showing the required landscaping at the base of all the proposed monument signs (three (3) times the size ofthe largest exposed surface of the sign). The landscape plan shall be reviewed and approved by staff and one member of the Design Review Board prior to issuance of a sign permit. 13. Provide details of any ground-mounted lights to be used to illuminate the monument signs showing the type of lighting (i. e. low pressure sodium or high pressure sodium) and wattage. The light fixture to be used shall be the same fixture to be used throughout the entire development to illuminate any monument signs to provide similarity in lighting as has been proposed with the construction of monument signs within the development. The light detail shall be reviewed and approved by the Design Review Board prior to issuance of any sign permits. 14. The light fixtures shall be concealed or screened with perimeter landscaping providing a 12 month screen of sufficient height and density to conceal such fixtures. 15. Interior illumination is not permitted for monument signs. 16. A sign permit is required prior to any signs being constructed within this development. 17. The first buildin~ desi~ review a1>plication for one of the multiple multi-tenant buildin~s shall be req!lired to submit a desi~ review si~ aJ>plication for the monument si~ that is to be located alon~ State Hi~hway 44 (as shown on the attached Exhibit K) simultaneously with the first desi~ review buildin~ aJ>plication. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on February 15,2002. 2. Idaho containing various Sub Devdopments areas and varied uses. The intent of this master sign plan is to accommodate the different uses. provide signage for less exposed sites, allow for good directional signing all with the highest quality materials. lighting, size, and location to provide a high grade coordinated and unifonn sign criteria, without creating a dull, uninteresting and ineffective result. THE RU LES 1) It is the intent of the Master Sign plan to provide the guidelines necessary to achieve a visually coordinated, balanced and appealing signage environment for the project. 2) Reverse pan channel backlit halo illuminated individual letter signs will be pennitted on all entry signs located on Highway 44 and Eagle Road. The building signs on the office buildings may be halo illuminated or flood lit- Individual plex face intemally lit neon signs will be prohibited in the professional building areas, yet permitted in the retail areas. Retail areas are defined as multi-tenant or an individual retail building. "Can" Signs will be prohibited. Signs with exposed raceways will be prohibited. Other than for limited temporary identification, no paper, canvas, painted wall signs, banners or painted wooden signs would be pennitted (real estate marketing signs excepted). Sculptured cabinets will be permitted when used in conjunction with pan channel letters. Hanging or under canopy signs will be pennitted in the multi-tenant retail buildings. 3) Any and all signs must be submitted to Eagle River for approval prior to erecting. 4) Internal loop signs will be permitted for each parcel to identifY Tenants and Users within the sub development areas. These signs in some cases will be located on other than the users site in order to overcome inferior street exposure or to satisfY a need for direction or identification of the tenant I user. 5) Compliance with this sign criteria shaI1 be rigorously enforced and any non- conforming signs shall be removed by a tenant or purchaser (the "User~') or his sign contractor at their expense upon demand of the Owner or the Eagle River Owners Association through it's Architectural Control Committee or their representatives ('"Eagle River"). 6) Eagle River shall retain full rights of approval in the project, subject to the City of Eagle (the "City") approval. The Eagle River Owners Association shaD be responsible for the entry and directional signs. 9) The User upon approval by Eagle River shall obtain all necessary City and local pennits prior to installation. 10) Internally and Flood lit wall signs within this project in sizes permitted by City code will be pennitted subject to architectural approval by Eagle River. 11 ) AU signs referred to on Exhibits ~ B, C. &. D have been previously approved by the City under DR- 70-00, dated April 23. 2001. 12) Loop road monument signs wiD be pennitted as indicated on the approved site plan for each individual pad site and/or multi-tenant building as per City code. but must adhere to the design and material requirements as is shown in Exhibit D subject to approval by Eagle River. 13) Additional entrance signs at the Highway 44 access point will be permitted on the east & west side using the same materials & general design as Exhibit B. 14) One additional sign at the most eastern point of the development will be permitted using the same materials and general designs as Exhibit E. Sign not to exceed 8' in overaD height. 15) Main Entry signs are identified on Exluòits A, B and C. Interior loop road monument signs are identified on Exhibit D. 16) Main Entry sign locations are identified on the attached site plan and interior loop road monument signs are identified at approximate locations subject to staff review and approval. 17) Perimeter pad site monument signs will be permitted along Eagle Rd. and the Highway 44. Those signs must adhere to the materials and design elements of the attached designs. Signs will be pennitted on the north side of the walkway along Highway 44 in the approximate locations shown on the site plan subject to staff review and approval. All single tenant buildings will be permitted two wall signs. Multi-tenant buildings are allowed wall signs for two elevations per tenant maximum. In cases where multi-tenant buildings have entrances on all sides. one sign will be allowed over each entrance. 22) Buildings which are designed with mansard roofs will be permitted the same allowances as those with standard walls or sign bands. 23) Additional signs and designs are subject to City and Eagle River approval.
