Box 477, Eagle, Idaho 83616, (Grantee), non-exclusively for use by the general public, a permanent greenbelt easement that could include a paved path for non-motorized vehicles, horses and pedestrian use, reserving to the Grantor any use that does not conflict with the easement purposes herein granted. There are no implied easements across the Grantor's land to access this easement nor does either Grantor or Grantee guarantee any access to this easement. A parcel of land lying north of the North Channel of the Boise River situate in Government Lot 6, Section 15, Township 4 North, Range 1 East, Boise Meridian, Ada County, Idaho, more particularly described as follows: A strip of land twenty-five (25.00) feet wide, lying northerly of and along the following described survey line and lying northerly of the ordinary high water mçtrk of the Boise River: Commencing at the northwest corner of said Section 15, thence South along the westerly line of said Section 15 a distance of 2,645.15 feet to a brass cap monumenting the West 'v4 corner of said Section 15; thence along the East-West center-of-section line of said Section 15, North 89°49'57" East, a distance of 1,321.82 feet to the northwest corner of Government Lot 3 of said Section 15; thence South 0°15'12" West, a distance of 1,610.63 feet, along the westerly boundary of Government Lots 3 and 6 (E%SW'V4) of said Section 15 to a set steel pin, said pin being the REAL POINT OF BEGINNING; thence leaving the westerly line of Government Lot 6 of said Section 15 and traversing along the ordinary high water mark the following courses and distances: South 51°00'44" East, 333.89 feet to a set steel pin; thence South 45°08'07" East, 478.18 feet to a set steel pin; thence South 67°10'36" East, 277.27 feet to a set steel pin; thence North 80°49'42" East, 474.77 feet to a set steel pin on the easterly line of Government Lot 6 of said Section 15, said steel pin being the terminus of said survey line and easement, the above described area containing 0.90 of an acre, more or less. State of Idaho Amended Acquired Easement No. 181 Page 2 of 2 TO HAVE AND TO HOLD the said easement unto CITY OF EAGLE, for the purposes herein above described, its successors and assigns forever. If for any reason the easement fails to be used for its intended use as a greenbelt for the benefit of the general public, this easement shall revert to the State of Idaho for the purpose of an unimproved public access easement. NOTE: This easement is being amended to change the purpose of the easement from an unimproved pedestrian pathway to an improved greenbelt easement.
