Findings - PZ - 2000 - ZOA-4-00 - Zoning Amendment For Pud/Allow For Increased Densities/55-Older BEFORE THE EAGLE PLANNING AND ZONING COMMISSION IN THE MATTER OF AN APPLICATION FOR A ZONING ORDINANCE AMENDMENT TO ALLOW INCREASED DENSITIY FOR SENIOR HOUSING RESIDENTIAL PLANNED UNIT DEVELOPMENTS ) ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER ZOA-4-00 The above-entitled zoning ordinance amendment application came before the Eagle Planning and Zoning Commission for their recommendation on October 16, 2000, and was continued to December 4, 2000. The Eagle Planning and Zoning Commission having heard and taken oral and written testimony in this matter makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. ZONING ORDINANCE AMENDMENT SUMMARY: David Roylance and Ron Bath are requesting a zoning ordinance amendment to change the text within Chapter 6 of Title 8 of the Eagle City Code for Planned Unit Developments. The substance of the amendment is to allow for increased residential densities for planned unit developments designed for older person aged 55 and over. B. APPLICATION SUBMITTAL: On September 12, 2000, this application was received by the City of Eagle. On November 16, 2000, revisions to this application were received by the City of Eagle. C. NOTICE OF PUBLIC HEARING: Notice of Public Hearing on the application for the Eagle Planning and Zoning Commission was published in accordance for requirements of Title 67, Chapter 65, Idaho Code and the Eagle City ordinances on September 30,2000. D. The complete text of the proposed zoning ordinance amendment is attached hereto as Exhibit A. E. COMPANION APPLICATIONS: None STAFF RECOMMENDATION: Based upon the information provided to staff to date, staff made no recommendation on the proposed zoning ordinance amendment. A public hearing on the application was held before the Planning and Zoning Commission on October 16, 2000, at which time testimony was taken. The Commission continued the public hearing to December 4, 2000, at which time additional testimony was taken and the public hearing was closed. B. Oral testimony in opposition to this proposal was presented to the Planning and Zoning Commission by no one. C. Oral testimony in favor of this proposal was presented to the Planning and Zoning Commission by no one (not including the applicant/representative). COMMISSION DECISION: The Commission recommended denial (three to zero, two absent) of ZOA-4-00 for a zoning ordinance amendment to Subsection 5 of Section 5 of Chapter 6 of Title 8 of the Eagle City Code because the City is currently considering general revisions to the planned unit development section of the City Code, of which this amendment is a part. The Commission believes it would be better to wait until the City begins that revision and to consider the proposed concept at that time so as to ensure consistency in the amended provisions and to limit the possibility of including provisions at this time that may need to be revised. The applicant may submit the proposed changes at that time. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on September 12, 2000. On November 16, 2000, revisions to this application were received by the City of Eagle. 2. Notice of Public Hearing on the application for the Eagle Planning and Zoning Commission was published in accordance for requirements of Title 67, Chapter 65, Idaho Code and the Eagle City ordinances on September 30,2000. a. The Commission reviewed the particular facts and circumstances of this proposed zoning ordinance text amendment (ZOA-4-00) with regard to Eagle City Code Section 8-7-5 "Action by the Commission and Council", and based upon the information provided concludes that the proposed zoning ordinance text amendment may be compatible with the current zoning code, however, in light of the proposed modifications anticipated by the Commission in the future, the amendment should be considered at that time.
