MEETING MINUTES
August 18, 2026
1. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance.
2. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m.
3. ROLL CALL: Present: GILLIS, KVAMME, MAY MERRILL. A quorum is present
4. ADDITIONS. DELETIONS OR MODIFICATIONS TO THE AGENDA: None.
5. PRESENTATIONS:
A. Hardin Sanitation: An operations update will be provided by Site Manager Aaron Murphy.
Site Manager, Aaron Murphy provides a year-to-date review of the services provided in the City
of Eagle. Discusses the core values of Hardin Sanitation, which emphasizes safety training for
employees and customer service. Hardin Sanitation has partnered with the City on a variety of
community events, donating $19,000 worth of services so far this year. Murphy states that he
believes that Ada County landfill intends to request a $1.00 tipping fee increase. Hardin Sanitation
appreciates the partnership with the City and looks forward to a continued positive partnership.
B. McAlvain Companies Inc.: An update on the Eagle Regional Athletic Park.
Alex Dosell, the Project Manager with McAlvain Construction, reviews a brief history, and the
status of the park to date. The preliminary phase 1 schedule shows that as of today, 80% design
deliverables have been received. It is anticipated that in December the executed Phase 1 GMP and
notice to proceed will occur, with a tentative completion of Phase 1 in August of 2027.
6. REPORTS:
A. Mayor and Council:
May reports on COMPASS activities. They approved the 2027 unified planning work program
budget and also approved an amendment for the Communities in Motion 2050, as well as the FY
25-33 Transportation Improvement Plan.
Merrill met with Ada County Commissioner Davidson to discuss the rat problem throughout the
county.
Gillis attended the Fire District meeting and also went on a tour of the Avimor Development to
better understand the Avimor CID. It was an informative tour.
Mayor Pike reports on the Eagle Fire Department meeting, he met with ACHD President Gold, he
too attended the COMPASS meeting and met with potential donors for the Eagle Regional Sports
Park. Provides a status update on the joint shop/training facility.
B. Department Supervisor:
Laura Williams, Communication Specialist, reviews recent updates to the City's webpage to
improve the user experience and simplify navigation of the same, as well as reviews social media
statistic and trends over the last several months. She discusses upcoming projects and goals.
C. Eagle Police Department:
Chief Ruby introduces Deputy Newman and reviews his law enforcement experience. Chief Ruby
reviews the monthly statistics report.
7. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION
ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Mayor, a Councilmember, member of City

Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items

Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review
Board shall be adopted as part of the City Council's Consent Agenda approval motion unless
specifically stated otherwise.

F. Reappointment to the Eagle Urban Renewal Agency - Seat 4: In accordance with Resolution
24-05, Mayor Pike is requesting Council confirmation of the reappointment of Dale "Mac"
McOmber to the City of Eagle Urban Renewal Agency. Mr. McOmber will be continuing to serve
as Seat 4 for the Agency, the two (2) year term will expire in August 2028. (BKP)
G. Temporary Noise Ordinance Waiver Request: Brady Johnson is requesting a Temporary
Noise Waiver for a wedding event being held at The Cottage at Riverbend on August 29, 2026
between the hours of 3:00 pm and 12:00 am. (TEO)
H. Temporary Noise Ordinance Waiver Request: Ezekiel Gilbert is requesting a Temporary
Noise Waiver for a wedding event being held at The Cottages at Riverbend on September 9, 2026
between the hours of 4:00 pm and 11:30 pm. (TEO)
1. Temporary Noise Ordinance Waiver Request: Garrett Chadderdon is requesting a Temporary
Noise Waiver for the wedding event being held at The Cottage at Riverbend on September 12, 2026
between the hours of 3:00 pm and 11:00 pm. (TEO)
J. Call for Artists - "Art That's Small at City Hall": The Eagle Arts Advisory Committee is
seeking Council approval to publish a Call for Artists for "Art That's Small at City Hall" and to
authorize using EAAC funds for prize money and a reception in an amount not to exceed $1,500.00.

K. Independent Contractor Agreement Between the City of Eagle and Patricia Kruse:
Independent Contractor Agreement between the City of Eagle and Patricia Kruse to provide dance
classes for adults and youth aged 10+. Compensation shall be at a rate of 70% of the total revenue
generated by registration. (AMP)
L. Independent Contractor Agreement Between the City of Eagle and ENKIDS LLC:
Independent Contractor Agreement between the City of Eagle and ENKIDS LLC to provide
STEAM programs for youth aged 3-17. Compensation shall be at a rate of 70% of the total revenue
generated by registration. (AMP)
M. Live Performance Agreement Between the City of Eagle and Sam Henry Music LLC: Live
Performance Agreement between the City of Eagle and Sam Henry Music LLC to perform at Eagle
Harvest Fest on October 10, 2026. Compensation shall be at a rate of $1,000.00 for specified event.

N. Live Performance Agreement Between the City of Eagle and Edward Coughenour: Live
Performance Agreement between the City of Eagle and Edward Coughenour to perform at the
Eagle Gazebo Concert Series on September 24, 2026. Compensation shall be at a rate of $1,600.00

O. DR-2023-08-MOD1 - Modification to the Common Area Landscaping within Shingle
Creek Subdivision - Cook Brothers Construction: Cook Brothers Construction, represented by
Mike Cook, is requesting design review approval to modify the common area landscaping within
Shingle Creek Subdivision, specifically the addition of a composite fence on top of the berm along
State Highway 44. The 4.41-acre site is located on the north side of State Highway 44
approximately 400-feet west of the intersection of West State Street and State Highway 44 at 2500
West State Street. (ERF)
P. DR-2024-14-MOD4 - Common Area Landscaping within Torrente Secco Subdivision
(Phases 10 & 12) - Toll Brothers: Toll Brothers, represented by Brian Garrett with Brian Garrett
Architecture and Design, PLLC, is requesting design review approval for the common area
landscaping within Torrente Secco Subdivision (Phases 10 & 12). The 19.36-acre site is located on

the south side of West Beacon Light Road approximately 1,260-feet east of North Palmer Lane at

Q. DR-2026-47 - One Townhome Building (4-Units) Within Valnova Subdivision No 2 -
Tresidio Homes: Tresidio Homes, represented by Rich Brown, is requesting design review
approval for one townhome building (4-units). The 0.17-acre site is located on the southwest corner
of North Newbank Way and West Alderman Lane at 5833, 5839, 5845, and 5857 West Alderman
Lane within Valnova Subdivision No. 2 (a re -subdivision of Lots 22, Block 1, Spring Valley
Subdivision No. 1) (Lots 35-38, Block 6). (BAW)

A. Claims Against the City.
Council Member Merrill inquires on four expenditures listed on claims against the City. City Clerk
Osborn states the expenditures in question were approved by Department Supervisors other than
herself, and therefore she doesn't know the particulars associated with them. She suggests that the
approval of those expenditures be withheld until the next Council meeting, to give those
Supervisors the opportunity to provide clarification.
Merrill moves to approve claims against the City exclude items 250945, 250944, 10264, 10264.
For the provision of additional details regarding those expenditures. Seconded by May.

E. Minutes of July 28, 2026. (TEO)
City Clerk Osborn, requests item 7E be tabled to an uncertain date to allow time for further review.

F. Reappointment to the Eagle Urban Renewal Alzency - Seat 4: In accordance with Resolution
24-05, Mayor Pike is requesting Council confirmation of the reappointment of Dale "Mac"
McOmber to the City of Eagle Urban Renewal Agency. Mr. McOmber will be continuing to serve
as Seat 4 for the Agency, the two (2) year term will expire in August 2028. (BKP)
Kvamme is pleased with the reappointment of Mr. McOmber, he is a great asset to the Agency.
Kvamme moves to reappoint to the URA Seat 4 Dale McOmber. Seconded by May. ALL
AYE ... MOTION CARRIES.
8. UNFINISHED BUSINESS:
A. ACTION ITEM: RZ-2021-03-MOD1 - Modification to the Development Agreement for
Carrara Estates Subdivision - Toll Southwest, LLC: Toll Southwest, LLC, represented by
Becky McKay with Engineering Solutions, LLP, requests approval of a rezone with development
agreement modification to replace the required architectural elevations and amend the fencing
standards within the development agreement for Carrara Estates Subdivision. The 66.00-acre site
is located on the north side of West Floating Feather Road, approximately 2,280-feet west of North
Eagle Road. This item was continued from the July 14, 2026 City Council meeting. (HSD)

City Planner, Hailey Durham reviews the application and items for special consideration
Martin Taylor, 3103 W. Channel Dr. Meridian, Idaho, representing Toll Brothers. Mr. Taylor
discusses architectural options, lots with no building permits issued to date, perimeter fencing and
other options.
Discussion. Kvamme is in favor with what was presented with the exception of the mid-century
modular. It doesn't seem compatible with the other architectural styles.
Merrill moves to approve RZ-2021-03-MOD1- Modification to the Development Agreement
for Carrara Estates Subdivision - Toll Southwest, LLC I with the following changes or
approvals would be for all of the proposed styles as proposed except for the modern century
that we would approve the composite fence entirely around the subdivision that would match
all the way through that we would look at the single story on the two lots as proposed with
the chase on lot number 15 and lot number 5 I believe are the two and that we would approve
those. Seconded by Gillis. Discussion. Merrill clarifies that it is the mid-century architecture
that would be excluded. Second concurs. ALL AYE ... MOTION CARRIES.
B. ACTION ITEM- Ordinance No. 942 - Police Regulations: An ordinance of the City of Eagle,
Ada County, Idaho, amending Title 1, "Administrative," Chapter 4, "General Penalty", Section 1;
amending Title 4, "Public Health and Safety", Chapter 2, "Garbage and Rubbish", Section 8, and
Chapter 9, "Loud Amplification Devices Noise Ordinance", Sections 3 and 4; adding a new title
block and new Chapter 12, "Streetlight Maintenance"; amending Title 5, "Police Regulations",
Chapter 1, "Minors", Section 1, and adding a new Section 2; amending Chapter 2, "Miscellaneous
Offenses", Section 1, and adding Sections 8, 9, and 10; amending Chapter 3, "Prohibited Parking",
Sections 4, 5, 6, 7, and 9, and Chapter 8, "Disorderly Conduct", Section 2; amending the title block
for Chapter 10, "Speed Limits", and amending Chapter 10, adding Sections 4 and 5; adding the title
block for Chapter 12, "Transportation of Uncovered Loads", and adding Sections 1, 2, and 3; and
providing a Severability Clause and providing an Effective Date. (WEV) This item was continued
from the July 28, 2026 City Council Meeting.
Mayor Pike introduces the item.
Director of Development Services, Bill Vaughan reviews the ordinance and items that Council
wanted to revisit from the July 28' meeting.
Gillis expresses concern with section 5-3-6 citing every two hours for parking violations seems
oppressive, the timeline for is too strict snow removal in 5-2-10, 5-1-2 Juvenile curfew is overreach,
5-2-1 political advertising is not addressed, 5-10-4 turn lanes is addressed at the state level, and
why should it be addressed in City Code. He is unable to move this forward until these concerns
are addressed. Merrill concurs with the concerns the snow removal timeline. Discussion regarding
enforcement, current code and proposed changes.
Gillis moves that item number 8B unfinished business Ordinance 942 police regulations be
remanded back to staff for additional work on verbiage contained therein. Seconded by May.

9. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION
ITEMS.
A. Resolution No. 26-05 - Penalty Violation Fee Schedule: In accordance with Idaho State Code
63-1311A, a public hearing for the purpose to consider public testimony regarding a proposal to
establish new fees and to increase existing fees in excess of five percent for the City of Eagle
infraction violation fees, as well as the violation of police regulations as stated in Eagle City Code
Title 1 and Title 5. (WEV) This item was continued from the July 21, 2026 City Council Meeting.

of police regulations as stated in Eagle's City Code Title 1 and Title 5. Seconded by May.

10. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public
are excluded may be held, but only for the purposes and only in the manner set forth in this section.
The motion to go into executive session shall identify the specific subsections of this section that
authorize the executive session. There shall be a roll call vote on the motion and the vote shall be
recorded in the minutes. An executive session shall be authorized by a two-thirds (2/3) vote of the
governing body. An executive session may be held:
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications of
and legal options for pending litigation, or controversies not yet being litigated but imminently
likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy
this requirement;

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF EAGLE, IDAHO:
Section 1: That the newly established, increased or removed fees with altered text shown with
underline and strikethrough attached hereto as Exhibit A and incorporated herein by reference,
is hereby approved.
Section 2: That the Mayor and City Council are hereby authorized to execute said fees for and
on behalf of the City of Eagle.
Section 3: That this resolution shall be in full force and effect immediately upon its adoption and
approval.

A. It shall be unlawful for any person to possess a shopping cart outside the premises of a
business establishment without the express prior written approval of its owner, unless the
person is in the process of immediately returning the shopping cart to the owner. Written
permission to remove a shopping cart shall be valid for a period not to exceed 72
consecutive hours.
Section 13: That Title 5, Chapter 2, Section 9 of the Eagle City Code is hereby added to
read as follows with underline text to be added:
5-2-9: UNLAWFUL POSSESSION OF A CATALYTIC CONVERTER:
A. It shall be unlawful to possess any catalytic converter that is not attached to a vehicle
unless the possessor has documentation or other proof to verify they are in lawful
possession of the catalytic converter.
B. For purposes of this section. "lawful possession" includes being the lawful owner of
the catalytic converter or in possession of the catalytic converter with the lawful owner's
written consent. It is not required to prove the catalytic converter was stolen to establish
the possession is not a "lawful possession."
C. For purposes of this section "documentation of other proof' means written
document(s) that clearly identify the vehicle from which the catalytic converter
originated and includes but is not limited to the following document types: bill of sale
from the original owner with photographs documentation from an automotive repair
shop proving the owner relinquished the catalytic converter to the automotive repair
