Minutes - 2026 - City Council - 08/11/2026 - RegularEAGLE CITY COUNCIL MEETING MINUTES August 11, 2026 1. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance. 2. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m. 3. ROLL CALL: Present: GILLIS, KVAMME, MAY MERRILL. A quorum is present 4. ADDITIONS. DELETIONS OR MODIFICATIONS TO THE AGENDA 5. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding topics of general interest or concern. Comments regarding Public Hearing and land use items are to be made during the open public hearing for said item(s)in accordance with Idaho Code. We desire to have all interactions between the public, staff and elected officials to be conducted in a professional and civil manner. Therefore, comments are to addressed solely to the Council as a whole, and focus on the issue, avoiding personalized debate, and shall not make personal, impertinent, slanderous or profane remarks to any member of the Council, staff or other members of the public. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. No one chooses to speak. 6. REPORTS: A. Mayor and Council: Gillis continues to work with Ada School District to arm the schools and protect them within the district. He attended the joint meeting with the Urban Renewal Agency. Gillis expresses his condolences to the victims of the Twin Falls shooting; he spent time with some of the first responders and some of the victims that were involved. He offers his support to the emergency responders and the communities they serve. Merrill was out of the country when she heard of the shooting, and it was taken aback to have something like that happen in Idaho. May provides an update on the Linder Road project. Discusses changes to Highway 44 and 16 traffic patterns. She also attended the Joint URA meeting, and it was quite productive. May compliments Chief Ruby on his conduct and leadership of the Eagle Team. Kvamme reports that the Urban Renewal Agency has passed their new budget and discusses other contracts underway to improve the downtown. Mayor Pike attended National Night Out in a couple Eagle subdivisions. He attended a ribbon cutting for a new bank in town. Mayor also spent time at the Eagle Senior Center talking and interacting with them. He met with President Gold with ACHD and discussed current and upcoming projects. Public Works Director, Eric Ziegenfuss briefly reviews the references for the roofing contractor for City Hall. Council had requested additional information at a previous meeting. The owner of the company states that he would personally address any warranty issues. Provides updates on a variety of projects under Public Works Department purview. 7. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. A. Claims Against the City. B._Service Maintenance Agreement Between the City of Eagle and DataWorks Plus: Staff is requesting Council to authorize the Mayor to execute the maintenance agreement between the City of Eagle and DataWorks Plus for the fingerprinting system to run FBI background checks. The term of the agreement is 12-months and shall not exceed $780.00. This is a budgeted item. (DNG) C. Agreement Between the City of Eagle and Cities Digital, Inc. (CDI): A software and services purchase agreement between the City and CDL CDI provides software, maintenance and services with Laserfiche software. The total cost shall not exceed $27,162.20. Resolution No. 26-14 - Vacation to the Final Plat of Valnova Kirkhills Subdivision No. 2: A Resolution of the City of Eagle, Ada County, Idaho, vacating a 10-foot (10') wide public and private utilities, irrigation, and lot drainage easement located within Lots 36 and 37, Block 5, Valnova Kirkhills Subdivision No. 2. (RLB) E. Findings of Fact and Conclusions of Law for the Approval of A-2025-05/RZDA-2025- 07/CUP-2025-06/PPUD-2025-06/PP-2025-07 - Annexation, Rezone with a Development Aareement, Conditional Use Permit, Planned Unit Development, and Preliminary Plat for the Mabury Subdivision - Sterling Homes Inc.: Sterling Homes Inc, represented by David Sterling with Ardurra, is requesting annexation, rezone from RUT (Rural Urban Transition — Ada County designation) to R-3-DA-P (Residential with a development agreement - PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Mabury Subdivision, a 13-lot (10-buildable, 3-common [2-open space, 1-shared drive]) residential planned unit development. The 5.95-acre site is located on the north side of East Chinden Boulevard, approximately 400-feet east of South Eagle Road, at 3314 East Chinden Boulevard. (ASG) G. Findings of Fact and Conclusions of Law for the Approval of RZDA-2021-07-MOD 1/CUP- 2025-14/PPUD-2025-08/PP-2025-12 - Development Agreement Modification, Conditional Use Permit, Preliminary Development Plan, and Preliminary Plat for Kody Corner Subdivision - MJV Properties, LLC: MJV Properties, LLC, represented by Rodney Evans + Partners, LLC, is requesting development agreement modification approval to establish a new termination date, along with conditional use permit, preliminary development plan, and preliminary plat approvals for Kody Corner Subdivision, a 20-lot (19-buildable; 1-common) residential planned unit development. A-2026-02/RZDA-2026-02/CUP-2026-06/PPUD-2026-02/PP-2026-02 - Annexation Rezone with a Development Agreement, Conditional Use Permit Preliminary Development Plan, and Preliminary Plat for Hartley Cove Subdivision - Ravello Development, LLC: Ravello Development, LLC, represented by South Beck & Baird, is requesting annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R-1-DA-P (Residential with a development agreement — PUD), conditional use permit (for the request to waive the requirement for common area open space (ECC 8-6-5-2)), preliminary development plan and preliminary plat approval for Hartley Cove Subdivision, a 6-lot (5-buildable, 1-common [1 -private street]) residential planned unit development. The 5.74-acre site is located on the west side of North Hartley Road, approximately 1,000-feet north of West Beacon Light Road. (ASG) Mayor Pike introduces the item and opens the public hearing. Mike Williams, 2002 S. Vista Boise, Idaho with South Beck & Baird, representing Ravello Development LLC, reviews the application and waivers requested. City Planner, Andrew Glaspell, reviews the staff report and items for special consideration, including the waivers the applicant is requesting. Mayor Pike opens public testimony. Deborah Jackson, 2625 N. Synergy Ave, Eagle, Idaho. Ms. Jackson is in favor of the development. The traffic impact will be minimal, and the development will complement other developments in the area. Mayor Pike closes public testimony. Discussion. Mike Williams addresses the pressurized irrigation waiver being requested. And provides clarification that the waiver is that the irrigation water be supplied from existing groundwater rather than surface water rights. To address some of the concerns expressed during discussion, the applicant would be willing to add additional conditions to state that the groundwater rights may not be sold to take a point of diversion off site or without written consent of the City. Brent Thompson expresses his desire to develop this high end subdivision and explains his vision for the development. Discussion amongst the Council. Kvamme likes the proposal, however with the exceptions that curve curbing be required, that the elevations presented tonight should be included in the development agreement, and that the water rights cannot be sold or diverted without city approval. Merrill concurs with Kvamme. Gillis agrees with the conditions relating to water but is not as concerned with the curbing issue. Fiscal Year 2026-2027 Budeet Hearing: An Ordinance for Fiscal Year 2027 commencing on October 1, 2026, and ending September 30, 2027, appropriating sums of money to defray all necessary expenses and liabilities of the City of Eagle for said Fiscal Year. (LL) Mayor Pike introduces the item and opens the public hearing. City Treasurer, Lori Lord. I am pleased to present something we've been working toward for quite some time, the finished City budget. It represents months of planning, discussion, careful consideration, and thoughtful decisions about the future of our community. All of those pieces have come together to create the final budget we have before you tonight. Treasurer Lord reviews the budget for fiscal year 2026-2027 and stands for questions. Gillis recognizes the amount of work that was put into the budget by the Treasurer and Deputy Treasurer, as well as Department Heads. From the beginning of the budget process, he has been extremely concerned about the law enforcement contract. With the increase in geographic area and call volume, response times increase. Though there was a request to increase the staffing in the contact Council was not able to grant the request this year. Though this budget is moving forward the challenges remain for the funding of the law enforcement contract next year to address additional staffing and level of service concerns. Mayor Pike praises staff for coming back with additional budget reductions amounting to approximately $735,000. These reductions were made without cutting services nor personnel; some matters will be addressed at a later date as revenue and funding allows. With the recent ordinance addressing enforcement matters, the city needs law enforcement personnel to enforce those laws in order to make them effective. The law enforcement contract is important, and the enforcement of laws would address some unsafe conditions. Law enforcement needs staffing to address some of the unsafe traffic violations on our roads. Mayor Pike closes public testimony. B.1. A Public Hearing to Consider the City of Eagle's Intent to Recover One Percent (1%) of the City's Forgone Property Tax Balance. (LL) Mayor Pike introduces the item and opens the public hearing. Mayor Pike opens public testimony. Mark Butler, 1675 E. Bishop Way, Eagle, Idaho. Mr. Butler had recently conducted an analysis of levy rates. Eagle's levy rate is half of what it was in 2005. He encourages Council to take the 3% foregone or the City will be in a more dire financial situation if the levy continues to fall. Eagle doesn't receive support for traffic enforcement on major highways from the State police or Ada County Sheriff unless it is to render aid for accidents. So, it is a difficult situation. The state has handcuffed cities to generate the revenue needed to operate. Bob Van Arnem, 3490 S. Whitepost Way, Eagle, Idaho. Mr. Van Amem clarifies that he is in support of taking the foregone if it were to be directed to law enforcement services. Traffic enforcement and individual accountability is needed in Eagle.
