5. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding topics
not on the agenda of general interest or concern. This is not the time slot to give formal testimony on a public
hearing matter or comment on a pending application or proposal. Public Hearing and land use testimony is to
be made during the open public hearing for said item(s)in accordance with Idaho Code. We desire to have all
interactions between the public, staff and elected officials to be conducted in a professional and civil manner.
Therefore, comments are to addressed solely to the Council as a whole, and focus on the issue, avoiding
personalized debate, and shall not make personal, impertinent, slanderous or profane remarks to any member
of the Council, staff or other members of the public. Out of courtesy for all who wish to speak, the City
Council requests each speaker limit their comments to three (3) minutes.

7. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTIONITEMS. Consent
Agenda items are considered to be routine and are acted on with one motion. There will be no separate
discussion on these items unless the Mayor, a Councilmember, or a member of City Staff, requests an item to
be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed
on the Regular Agenda in a sequence determined by the City Council. Any item on the Consent Agenda which
contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission,
or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion
unless specifically stated otherwise.

Donation Agreement between the City of Eagle and Mac McOmber for a monetary contribution of
$15,000 towards the Eagle Regional Athletic Park for naming rights of 10 years for a dugout located at
the Eagle Regional Athletic Park. (TEO)
C. Findings of Fact and Conclusions of Law for the ADDroval of A-2026-02/RZDA-2026-02/CUP-
2026-06/PPUD-2026-02/PP-2026-02 - Annexation. Rezone with a Development Agreement,
Conditional Use Permit. Preliminary DeveloDment Plan. and Preliminary Plat for Hartlev Cove
Subdivision - Ravello Development, LLC: Ravello Development, LLC, represented by South Beck &
Baird, is requesting annexation, rezone from RUT (Rural -Urban Transition — Ada County designation)
to R-1-DA-P (Residential with a development agreement — PUD), conditional use permit (for the request
to waive the requirement for common area open space (ECC 8-6-5-2)), preliminary development plan
and preliminary plat approval for Hartley Cove Subdivision, a 6-lot (5-buildable, 1-common [1-private
street]) residential planned unit development. The 5.74-acre site is located on the west side of North
Hartley Road, approximately 1,000-feet north of West Beacon Light Road. (ASG)

D. FP-2026-10 - Final Plat for Sintra Subdivision - Todd Campbell Custom Homes: Todd Campbell
Custom Homes, represented by Mary Wall with Professional Engineering Solutions, is requesting final
plat approval for Sintra Subdivision, a 10-lot (8-buildable, 2-common) residential development. The
9.66-acre site is generally located on the west side of North Park Lane, approximately 1,780-feet south

8. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS. Public
Testimony will be taken on items listed in this section.
• Public Hearings are legally noticed hearings required by state law. The public may provide formal testimony regarding the
application or issue before the City Council. This testimony will become part of the hearing record for that application or
matter.
• Public hearing testimony time limits: Individuals testifying are allotted three (3) minutes for non -repetitive testimony

A. CUP-2026-16 - Industry (Custom) and Industry (Limited) - Gunsmithing Equipment for Eagle
Distribution. LLC - KLand. LLC: Michael Kahn with KLand, LLC, is requesting approval of a
conditional use permit to allow Industry (Custom) and Industry (Limited) within the MU (Mixed Use)
zoning district for the operation of a gunsmithing business (Eagle Distribution, LLC) within the
Parkinson Mixed Use Condominiums. The 0.74-acre site is generally located on the northwest corner of
East State Street and South Parkinson Street at 1093 South Parkinson Street, Unit C100. (HSD)

B. RZDA-2025-13-MOD6 - Modification to the Development Agreement for Legacy Planned
Development - Red Butte, LLC: Red Butte, LLC, represented by Jessica Krueger with Ardurra, is
requesting a modification to the rezone with a development agreement for Legacy Planned Development
to establish building setbacks for the commercial lots within Snoqualmie Basin Subdivision. The 12.84-
acre site is generally located on the southwest corner of West Broken Arrow Street and North Palmer

9. NEW BUSINESS:
A. ACTIONITEM.• Request for Annexation Reevaluation for A-2026-01/RZDA-2026-01/CPA-2026-
01/CUP-2026-05/PPUD-2026-01/PP-2026-01— Wellspring Subdivision — Rob R. Nash: Rob R.
Nash, represented by Dave Yorgason with Tall Timber Consulting, is requesting annexation and rezone
from RUT (Rural -Urban Transition — Ada County Designation) to R-1-DA-P (Residential with a
development agreement — Planned Unit Development), a comprehensive plan map amendment to
change the land use map designation from Estate Residential to Large Lot Residential, conditional use
permit, preliminary development plan, and preliminary plat approvals for Wellspring Subdivision, a 49-
lot (43-buildable, 6-common [5-open space, 1-private street]) residential planned unit development. The
45.88-acre site is comprised of two (2) parcels (R8123020011 and R8123020060) and is generally
located north of Trout Road, approximately 2100-feet east of South Linder Road. The applicant is
requesting City Council reevaluation of the annexation application (with associated applications) to
provide the applicant the opportunity to address four items for change: 1) Elevation of building pads, 2)
Density, 3) Snow removal and snow storage, 4) Pathway easement along the Boise River. If the City
Council approves the request for reevaluation, this matter will be scheduled for a public hearing in the
month of September 2026. (WEV)

B. ACTION ITEM: Orville Jackson House: Discussion and Possible Action on Letter of Intent (LOI)
Terms between the Eagle Urban Renewal Agency and the City of Eagle Regarding the Property Located
at 127 South Eagle Road (commonly referred to as the Orville Jackson House). (BKP)
C. ACTION ITEM- Ordinance No. 975 - Rezone Ordinance - Eagle Marketplace: An ordinance
changing the zoning classification of a portion of the property from C-1-DA (Neighborhood Business
District with a development agreement) to C-2-DA (General Business District with a development
agreement), and; amending the zoning map of the City to reflect said change; providing a severability
clause; and providing an effective date. The 1.40-acre site is located on the north side of East Chinden
Boulevard, approximately 400-feet east of South Eagle Road, on a portion of Parcel #S0521336400.

Ordinance No. 975 - Rezone for Eagle Marketplace
D. ACTION ITEM: Cost Share Agreement Between the City of Eagle and Ada County Highway
District: A cost share agreement between the City of Eagle and Ada County Highway District for
enhanced landscaping within the right-of-way along North Linder Road, from State Highway 44 to West
Floating Feather Rpad. The City's contribution is not to exceed $713,962.50. (ASG)
E. ACTIONITEM: Discussion Regarding Potentially Supporting Ada County Creating an
Emergency Abatement District to Address the Rat Issue County -Wide: Items to address 1) Is the
City of Eagle able to contribute funding if Ada County forms an emergency abatement district? 2) Is the
City willing to commit personnel time and effort to assist in implementing the duties of the abatement

10. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are excluded may
be held, but only for the purposes and only in the manner set forth in this section. The motion to go into
executive session shall identify the specific subsections of this section that authorize the executive session.
There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive
session shall be authorized by a two-thirds (2/3) vote of the governing body. An executive session may be
held:
(c) To acquire an interest in real property which is not owned by a public agency;
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal
options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated.
The mere presence of legal counsel at an executive session does not satisfy this requirement;
