CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m. 3. ROLL CALL: Present: GILLIS, KVAMME, MAY MERRILL. A quorum is present. 4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA: May moves to make a motion to move item 10A to be 9A immediately following the Consent Agenda item. Seconded by Merrill. ALL AYE ... MOTION CARRIES. 5. PRESENTATION: A. Desiree Keeney, Deputy Director of Ada County Weed, Pest and Mosquito Abatement. Deputy Director Desiree Keeny provides a presentation regarding services provided by Ada County Weed, Pest and Mosquito. She provides an overview of noxious weeds specifically to Eagle in addition to data regarding mosquitos. 6. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding topics of general interest or concern. Comments regarding Public Hearing and land use items are to be made during the open public hearing for said item(s)in accordance with Idaho Code. We desire to have all interactions between the public, staff and elected officials to be conducted in a professional and civil manner. Therefore, comments are to addressed solely to the Council as a whole, and focus on the issue, avoiding personalized debate, and shall not make personal, impertinent, slanderous or profane remarks to any member of the Council, staff or other members of the public. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. No one in the audience chooses to provide public comments. 7. REPORTS: A. Water Easement Agreement Between the City of Eagle and Madden Homes LLC for City of Eagle Water Svstem Improvements within Hollyhock Subdivision: Maddyn Homes LLC is requesting approval of a Water Easement Agreement for water system improvements located within the Hollyhock Subdivision. The 6.72-acre site is located on the east side of North Lanewood Road approximately 770-feet north of the intersection of West Floating Feather Road and North Lanewood Road at 2220 North Lanewood Road. ACTION ITEM- Agreement Between the City of Eagle and Alliance Consulting LLC: Approval of AIA B 133-2019 contract for Design Professional Services for Eagle Regional Athletic Park. This item was discussed at the June 9, 2026, meeting. (ELZ & BKP) Public Works Director, Eric Ziegenfuss, provides an overview of the agreement and stands for questions. Council Merrill expresses that she received clarity from the additional information that was provided since this was originally on an agenda. It is a solid contract and appreciates the history. Council Gillis has concerns with the funding, in addition to the park balance, which will be reimbursed through park impact fees collected from new development within Valnova. Rob Buhumiem, with Clyde Capital Group, expresses that building parks in communities is something that Clyde Capital Group is used to. Relative to the funding, there have been commitments, knowing the City has contracted with CM, GM and Design, it gives more commitment and seriousness to donors. Alex Dosell is the Eagle Regional Athletic Park Project Manager with McAlvain and is aware that this project will be a phased approach and is on a 10-month construction schedule for phase 1. Bryan McMartin, Director of External Relations for McAlvain Construction, expresses that their focus is on the fundraising side and making sure this is a community project. James Hammell, with Alliance Consulting, is the Design Engineer, they have been involved in this project since the beginning and look forward to working with the City and getting kids playing on the ball fields. VAC-2026-04 - Vacation to the final plat of Eagle Hills West Subdivision No 1 - Christopher Wright: Christopher Wright, represented by Macy Lui with the Land Group, Inc., is requesting to vacate the five-foot (5') wide drainage easement along both sides of the shared lot line between Lot 20 and Lot 21, Block 1, of the Eagle Hills West Subdivision No. 1 final plat. RZ-2021-03-MOD1 - Modification to the Development Agreement for Carrara Estates Subdivision - Toll Southwest, LLC: Toll Southwest, LLC, represented by Becky McKay with Engineering Solutions, LLP, requests approval of a rezone with development agreement modification to replace the required architectural elevations and amend the fencing standards within the development agreement for Carrara Estates Subdivision. The 66.00-acre site is located on the north side of West Floating Feather Road, approximately 2,280-feet west of North Eagle Road. (HSD) Mayor Pike introduces that item and opens the Public Hearing. Becky McKay with Engineering Solutions reviews the updates to the Development Agreement. Martin Taylor with Toll Brothers explains that their intent was always to offer 5 home styles. Buyers have walked away due to only having three styles. Planner Hailey Durham provides an overview of the staff report. Mayor opens the public testimony. Travis Chase, 70 West Floating Feather Road, Eagle, is opposed to this modification specifically the two-story home elevations. Anna, 1622 North Sand Springs Way, Eagle, Idaho, resides in the subdivision, and is worried that the new elevations will not go with the existing homes and there will be no continuity. Jim Richardson is the President of Corrente Bello. There has been a lack of integrity with the developer and have not been a good neighbor. There are also issues with fencing and Toll Brothers did not comply with the fencing agreement that was initially approved by Eagle City Council. Sharon Benson 1343 North Coleen Bellow Way, Eagle allotted time to Jim Richardson. David McEllen, 1318 North Coleen Bellow Way, Eagle, allotted time to Jim Richardson. Melissa Myers, 3297 S. Eagle Road, Lane, Eagle, Idaho, is in support of additional elevations and it will make the community more aesthetically pleasing. She is an employee of Toll Brothers and purchased a lot within the development in hopes of building one of the new elevations. General discussion amongst the Council regarding clarity on the number of elevations already available and the type of elevations. Kvamme makes a motion to continue item 10B B RZ-2021-03-MOD1 - Modification to the Development Agreement for Carrara Estates Subdivision - Toll Southwest, LLC to come up with a definite set of elevations to include a consistent fence alignment and also require single leveled lots that were previously talked about and schedule for August 18 City Council meeting. A-2025-06/RZDA-2025-08 - Annexation and Rezone with a Development Agreement in Lieu of A Conditional Use Permit for Stor-It Self Storage - C. W. Hurless with Stor-It Self Storage, LLC: C. W. Hurless with Stor-It Self Storage, LLC, represented by Tamara Thompson with The Land Group, is requesting annexation and rezone from RUT (Rural -Urban Transition — Ada County Designation) to MU-DA (Mixed Use with a Development Agreement) for Stor-It Self Storage, an indoor commercial storage facility including one (1) single-family home. The 9.84-acre site is located at the northwest corner of North Hartley Road and West Beacon Light Road at 6814 West Beacon Light Road. Michael Letam, 3600 North Hope Valley, Eagle, Idaho is not in favor of this project and feels that this project is out of place and worries that if the Council approves this project, then other industrial uses will be approved. Lori Wilkie, 5065 West Piaffe Drive, Eagle, Idaho, is not in favor of this project and expresses that this project is in the wrong location. Robert Camchecq, 7892 West Rock Haven Drive, Eagle, Idaho, is not in favor of the application and this project does not belong next to one of Eagle's premier communities. Ryan Lunstrum, 3544 North Hartley Road, Eagle, Idaho, does this annexation and rezone fit this location and is it the vision of this area. He requests denial of this application. This project does not meet the comp plan vision. Craig Lund, 6055 West Ridlon Drive, Eagle, Idaho is requesting denial of this application and sites Eagle City code regarding rezoning and principal use structures. Roy and Natasha Flook, 3292 North Hartley Road, Eagle, Idaho, is not in favor of this project and requests denial of this application. Natasha Flook, 3292 North Hartley Road, Eagle, Idaho, states that this does not meet the comprehensive plan and does not provide a mix of uses. This location is not appropriate. Greg Nelson, 7054 West Founders, Eagle, Idaho requests denial of this application. This project does not fit the community setting and asks to protect the beautiful Beacon Light corridor. Karla Nelson, 7054 West Founders, Eagle, Idaho, is not in favor of this project and that this in the wrong location. Beacon Light is a gateway to Eagle. Tyson Hints, 3403 North Mayberry Way, Eagle, Idaho, has concerns with traffic and safety issues and requests Council deny this application. Megan Hints, 3403 North Mayberry Way, Eagle, Idaho, is not in favor of this project and believes it does not meet the Comprehensive Plan vision. Mary Jo Mcgarvin, 4144 West House Land Court, Eagle, Idaho, is not in favor of this project and states that this project is not compatible with current and future development. This will set a precedence to future development on Beacon Light. Brent Thompson, 7068 West Founders Street, Eagle, Idaho, has adjacent property and went through the development process through the City and complied with the Comprehensive plan. This application has a lot of misleading items. Kenny Pittman, 5252 West Braveheart Drive, Eagle, Idaho, decisions made today will make an effect on the future. Mike Williams, 2002 South Vista Avenue, Boise, Idaho, is not in favor of the project and sites Eagle City Code sections pertaining to this project and why it shouldn't move forward. Jordan Walker, 2286 North Birthstone Place, Eagle, Idaho, is not in favor of this project and does not think that this is the location for a storage facility. This does not fit the design of the community and there are concerns with traffic safety. Colette Castillo, 1079 North Foudy Lane, Eagle, Idaho, is not in favor of this project, she does not feel that this project fits in at this location and requests denial of this application. Ryan Siker resides in Terra View and is not in favor of this project and has safety concerns and echoes what everyone else has stated. Monica Braun, 5096 West Estuary Street, Eagle, Idaho, is on the HOA Board for Homestead, echoes everyone's concerns and requests denial of this application. John Mackle, 2551 North Bernese Avenue, Eagle, Idaho, echoes the concerns brought forward tonight. Hurless, 435 East Shore Drive, Eagle, Director of Operations for Stor-It and an Eagle resident provides a rebuttal to the comments made tonight. Tamara Thompson with the Land Group provides a rebuttal to the testimony. Merrill is not in favor of this application, and this is not compatible for the area. Gillis is support for property rights but within reason. This project is not conducive to the area and is a safety concern and does not support this project. Kvamme believes that storage units are a good business model, but this does not fit the Village Center. The 18.58-acre site is located on the south side of Riverside Drive, approximately 1,600-feet west of the intersection of Riverside Drive and South Edgewood Lane. (HSD) Mayor introduces the item. The applicant reviews that application. City Attorney explains the reason for setting a 5-year expiration date on a Development Agreement. This morning a construction truck coming from the Carera Estates neighborhood violated the building agreement and drove through our neighborhood down Cherry Bello to exit the property. It then proceeded to drive in the opposite direction of our one-way rotary road and drove directly over one of the traffic control islands directly south of the fountain. It destroyed the island. 1 personally heard the loud crash as it careened over the concrete barrier. It continued to drive off without any attempt to investigate the damage.
