(ELZ & BKP) Mayor Pike introduces the item. Gillis seeks additional clarification on the revenue sources for the project in order to ensure transparency and fiscal responsibility. He would like further information before taking action. It is his hope that after additional information and data is received that he can support moving forward. He is in favor of adding park facilities but wants to ensure a responsible decision is made. Mayor Pike and Council Member May discuss the funding aspect of the project. Both Merrill and Gillis desire to be "brought up to speed" on the history of the project and current activities associated with the same. Discussion. ZOA-2026-01 - Zoning Ordinance Amendment - City of Eagle: An ordinance of The City of Eagle, Ada County Idaho, repealing Title 8, Chapter 2, Article A, Section 8 "Sign Regulations" in its entirety; adding new Title 8, Chapter 2, Article A, Section 8 "Sign Regulations"; Providing A Severability Clause; And Providing An Effective Date. (WEV) Director of Development Services, Bill Vaughan introduces Mark Butler who will be presenting the zoning ordinance amendment. Mr. Butler has volunteered his time to rewrite this code section. Mark Butler, 1675 E Bishop Way Eagle, Idaho has been working over the last eight months to update this code section. I'd like to start by thanking you, Mayor Pike, for meeting with my husband and me and for your follow- up emails. I appreciate that you have taken our concerns seriously. I want to make it clear that we support the goal of water reuse. However, as a Farmers Union Ditch shareholder whose property borders an irrigation lateral with constant seasonal flow — and knowing that the City of Eagle is also a shareholder — I believe we need better transparency on the whole understanding of Class A water and specific local review before this project moves forward much further. ESD has already purchased and is installing its filtration equipment and is designing the pipeline. Although the project is advancing, ESD's Recycled Water Reuse Permit is still under review by the DEQ and has not yet been issued. ESD is using outdated outreach like the 2011 "Child at Play" flyer to claim PFOS is safe at 630 ug/l which equates to 630,000 ppt; to put that into perspective the current EPA standard for drinking water is only 4 ppt. Even the recent studies provided to us by ESD to prove Class A is safe, show Contaminates of Emerging Concern (CECs) appearing in edible crops after just two months of drip irrigation. Our local conditions are different because of flood irrigation, high water tables, and full - season exposure in canals and ponds. We have two requests: 1. That in the coming weeks the City Council schedule a dedicated Special Session on the Class A recycled water project. This would allow the City Council to review the latest science on CECs and PFAS as well as the required safety measures required by the IDEQ, and evaluate implications for the Eagle Comprehensive Plan, and determine what actions — if any— the City should take as a FUD shareholder. 2. That the City evaluate ESD's public outreach materials and investigate whether proper notification was given to all affected stakeholders, including downstream FUD shareholders and property owners whose water is conveyed by the canal. Those who will be directly impacted by this 25-year agreement should have received clear, timely information, just like a developer does for neighboring properties when a zoning change is requested. This isn't about stopping the project — it's about making sure it's done responsibly with full transparency and current science. Thank you for your time. Current Project Status • ESD has already purchased and is installing filtration equipment and is designing the pipeline to the Farmers Union Canal. • However, the Idaho DEQ Recycled Water Reuse Permit (submitted March 2025) is under review and has not yet been issued. • There is still time for thoughtful review. 2. Scientific Concerns from ESD's Own Studies Even the two recent studies provided by ESD raise important questions for our area: • Sammamish Valley Recycled Water Technical Memo (Oct2024): Detected CECs in edible portions of carrots and kale after just two months of irrigation. • Dennis et al. (2025): Detected 15 unregulated organic contaminants (including pharmaceuticals, methamphetamine metabolites, phthalates, and fragrances) in edible vegetables. (PFOA and PFOS were not included in the testing.) Critical Local Differences: • Studies used drip irrigation — many FUD Shareholder primarily use flood irrigation. • Water will be stored in canals and ponds for the entire irrigation season, year after year. • Many properties in the Eagle area have high water tables. 3. Compare Science and Commingled Class A Water Reuse with Comprehensive Plan • This review is requested for policies such as the following: o Chapter 4, Sections 4.6.2(A), 4.6.2(B), and 4.6.2(E) relating to groundwater quality, conservation, and water reuse; o Chapter 4, Section 4.7.3(1) regarding treatment of effluent for direct application; o Chapter 7, Section 7.1.1 regarding groundwater objectives; o Chapter 6, Section 6.14.2(K) regarding agricultural and community objectives; o Chapter 9, Section 9.3.3(F) regarding cost-effective park operations. • This review should also include code changes in regard to IDEQ requirements for Class A water usage. 4. Concerns About Public Outreach & Notification • ESD's survey questions regarding future planning do not appear to be neutral (e.g., repeated use of "like surrounding areas do" on the questionnaire, question 9 has 2 of the 5 items listed that would lead to the same treatment level.) • FUD shareholders and downstream property owners received no direct notice before the ESD-FUD contract was signed. • This is inconsistent with how the City requires other important community changes like when developers are required to notify neighboring properties regarding zoning change requests. • Outdated Public Outreach Materials ESD continues to use 2011 materials (copyrighted 15 years ago) on their website and in public communications, including the "Child at Play", "Landscaper", and "Golfer" flyers. The "Child at Play" Flyer image is displayed on the Water Reuse tab of eaglesewer.org website. These materials significantly overstate safety levels based on current science. 5. Recommendations As a FUD shareholder itself, the City of Eagle has a direct interest in this project. I respectfully request: 1. That the City Council schedule a dedicated Work Session or Special Session in the coming weeks on the Class A recycled water project. This session would allow Council to review the latest science on CECs and PFAS, evaluate implications for the Eagle Comprehensive Plan, and determine appropriate next steps. 2. Recycled Water ChildExposure Scenario at Play The child is 33-pounds and plays on the grass at a playground one day per week immediately following irrigation with tertiary -treated recycled water, which occurs six months of the year (26 days). He/she plays for one hour each day and his/her entire hands, forearms, and lower legs are wet with re- cycled water for the entire hour. The child indirectly ingests 10 milliliters of re- cycled water during each play session, which is estimated to be 1/5 the amount of water ingested by a child who swims for an hour. The exposures evaluated include absorption through the skin and incidental ingestion. This is a high estimation of the amount of water to which a typical child at play could be exposed. This is done purposely to build extra margins of safety into the risk assessments in this study (see reverse). The scenario not only represents a child on a playground, but also at the park or on a school athletic field. Explaining the Chart: The chart on the reverse is divided into four columns: column 1 lists ten Pharmaceuticals & Personal Care Products (PPCPs); column 2 explains a little about what these compounds are and how one might come into contact with them in the normal course of daily life; column 3 compares "acceptable"' concentrations of these PPCPs to what is actually measured2 in tertiary- or secondary -treated recycled water. Finally, using actual concentrations of PPCPs found in recycled water, column 4 shows the number of years that it would take, under the above scenario, for the child to be exposed to the equivalent of a dose (or normal daily intake) of the compound from conventional uses. Interpreting the Numbers: Let's put it all together, using Ibuprofen as our example. Ibuprofen is an over-the-counter (OTC) non -steroidal anti-inflammatory pain reliever (column 2), such as Advil. Acceptable (safe) concentrations of Ibuprofen in recycled water used to irrigate landscaping, such as a park or school playground, have been calcu- lated to be 890 micrograms per liter (ug/1) (column 3); actual concentrations measured in tertiary- or secondary -treated recycled water systems are typically less than or equal to 1/2 microgram per liter, which is far below levels considered safe. At actual concentra- tions, the child could enjoy playing, under the above exposure scenario, for 67,000 years before being exposed to the equivalent of one Advil tablet (column 4). I bring this statement up because it shows that there is over double the CECs in the recycled water. This is somewhat consistent with the water testing done by the City of Boise in 2020, however the Boise City water only had just over 40 PFAS and the FUD water had 7. Since the Eagle Sewer District has not stated the amount of PFAS in their water, this is an unknown factor that makes comparisons difficult. o Study provided by ESD - "Investigation of organic contaminants in recycled water Dennis et al. 2025" ■ The two compounds that are regulated by the EPA, PFOA and PFOS, were not listed anywhere in the study. It seems as though they were not included in the testing. ■ The abstract does state, "Using validated UPLC-ESI-MS2 methods, 15 UOCs were detected in edible tissues at concentrations ranging from 2.10 to 994 ng/g dry weight." This is consistent with the Sammamish Valley study and confirms our concerns about the uptake in vegetation. • I would like to add that both of these studies are in regard to single season crops; I am looking to see if I can find any studies regarding the long-term accumulation of the CECs in crops that are perennials such as asparagus and rhubarb. In addition, 1'd like to find some studies regarding the use of class A water in orchards. • This study also noted that, "Cannabinoids, metha mpheta mine, phthalates, and fragrances were most frequently detected." Many have stated that septic water has PFAS, but I can pretty much guarantee that our septic water does not contain methamphetamines, so the introduction of Class A water has the high probability of containing "pharmaceuticals" that our family actively avoids. • Study I found entitled "PFAS in water environments: recent progress and challenges in monitoring, toxicity, treatment technologies, and post -treatment toxicity" from Springer Nature Link site. o To assist with the "more current science" aspect of our discussion, I'm sharing this article that I found from 2025 on the National Library of Medicine's website; here is the shorter Springer link directly to the study that was re -published on the NLM website: https:Hlink.springer.com/article/10.1186/s40O68-025-00411-9. o What I especially appreciate about this study is the chart illustrating the research progress on PFAS use and treatment. I mention this because I firmly believe that if we waited a few more years before implementing Class A water reuse in our irrigation that the cost of wastewater treatment required to remove PFAS would become far more manageable. The large expense of advanced filtration was a major point ESD emphasized during its public outreach efforts with its patrons and mentioned several times during the City Council meeting this last April. o This study also points out the severity of long term PFAS exposure, "Recent studies have revealed changes in human embryonic stem cells and maternal biomarkers, underscoring the severity and unpredictable outcomes associated with long-term exposure to PFAS." ■ The studies you provided do not seem to address the long-term exposure issues that this 25-year contract could cause. Our property, for example, will be exposed to the commingled Class A water for approximately 6 months a year for the duration of the 25-years and this is only if ESD does not pursue the winter discharge that it mentioned during the 2025 Annual FUD meeting. • During the April City Council meeting, ESD referenced a survey sent to patrons regarding wastewater reuse options and that the patrons were in favor of this reuse plan. However, it seems that some important context may not have been included in the information provided to respondents. o For example, it was stated that upgrading the treatment facility to a higher standard could cost nearly $100 million versus the $20 million for upgrading to the Class A level of filtration, but there was no mention of potential grants or funding opportunities that could significantly offset those costs. Presenting the higher figure without discussing available financial assistance would naturally influence responses toward the lower -cost option. During the 20-year master planning efforts in 2023-2024, multiple surveys, open houses, public hearings, presentations, booths at Eagle Fun Days, etc were held to discuss both the costs and the funding mechanisms. These topics were discussed at length and the Eagle Sewer District Board of Directors determined that they had good information and feedback upon which they made their decision on how to move forward. I apologize, but I am not seeing the answer to my question in this response. Let me be more specific: did ESD include wording to the patrons about the available grant funding when they were informed of the cost difference between the current Class A level filtration system and the higher level filtration system? Could you please provide documentation showing any literature given to the public or patrons stating this information about the grants? o I ask because the literature I've been able to locate is missing this key element in the charts. In addition, some of the materials resemble the images like those in the attached image regarding from the pages from document entitled "Eagle Fun Days Survey." It is our understanding that purple pipe is the universally recognized standard —and code requirement —for reclaimed or Class A water identification. Considering that Resolution 19, adopted by the City of Eagle last fall, established even stricter standards for Public Works construction, could they clarify why a lesser standard would appear to be acceptable for reclaimed water infrastructure? • When questions were raised during the Council meeting regarding PFAS levels in the wastewater, the responses seemed somewhat unclear. We have also heard concerns from others that ESD may not currently be testing for PFAS. o Can ESD clarify: ■ Whether PFAS testing has been conducted; if so what the current PFAS levels are? ■ If testing has not been completed, why not; and whether there is a timeline for such testing to occur? • Is the amount ESD pays the City of Boise for wastewater processing based on the concentration or amount of sewage contaminants in the water? If so, would cleaner Class A water result in reduced processing charges? I believe the other questions and concerns we mentioned during the meeting would not fall under the purview of ESD. There is no easement to this area. Such catch pond significantly fills up as is during moderate to heave rains. • Not only digging for the basement is a major concern, but also how the proposed new home is in very close proximity to the property line and the roof pitch/angles design will lead water towards my home. 3. Two current residents reported their builders recommended not including basements in their home designs for similar reasons. • The Ada County approved drainage patterns when the Cove was designed in 2016-18 did not assume and/or account for (1) the removal of the natural/constructed barrier between lots and/or (2) the excavation of Lot 70's pad beyond a crawl space.
