RESOLUTION NO.26-11
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE TEN -FOOT (10') WIDE
PUBLIC AND PRIVATE UTILITIES, IRRIGATION, AND LOT DRAINAGE EASEMENT
LOCATED ALONG THE SHARED PROPERTY LINE OF LOTS 15 AND 16, BLOCK 3 (VALNOVA
ESTATES SUBDIVISION NO. 1) AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Lisa Bachman with Bachman Custom Homes requested a vacation to the final plat
of Valnova Estates Subdivision No. 1 to vacate the ten -foot (10') wide public and private utilities,
irrigation, and lot drainage easement (Exhibits "A" and "B") along the shared property line of Lots 15
and 16, Block 3 (Valnova Estates Subdivision No. 1); and
WHEREAS, On May 4, 2026, the Planning and Zoning Commission recommended approval of
the vacation (VAC-2026-03), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on May 29, 2026, and May 31, 2026; and
WHEREAS, On June 9, 2026, the City Council held a public hearing on the proposed vacation
(VAC-2026-03), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
WHEREAS, Relinquishment letters have been provided as required in Idaho Code 50-1306A.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the ten -foot (10') wide public and private utilities,
irrigation, and lot drainage easement (Exhibits "A" and "B") located along the shared property line of
Lots 15 and 16, Block 3, of the final plat of Valnova Estates Subdivision No. 1, as considered, heard, and
approved by the Council at its June 9, 2026, public hearing for application number VAC-2026-03, and as
shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 23rd day of June, 2026.

being situate in the southeast quarter of the northwest quarter of Section 23, Township 5 North, Range 1
West, Boise Meridian, City of Eagle, County of Ada, State of Idaho, also being more particularly described
as follows:
Commencing at a 1/2-inch rebar marking the southwesterly corner of said Lot 16;
thence from said Point of Commencement, South 79°04'49" East, coincident with the southerly line of said
