Resolution - 2026 - 26-12 - Restriction On The Use Of Fireworks In The Areas That Constitute A Severe Fire Threat. - 06/23/2026RESOLUTION NO.26-12 A RESOLUTION OF THE EAGLE CITY COUNCIL PURSUANT TO IDAHO CODE SECTION 39-2609(4), DECLARING A RESTRICTION ON THE USE OF FIREWORKS IN AREAS THAT CONSTITUTE A SEVERE FIRE THREAT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Idaho Code Section 39-2609(4) makes it unlawful for any person to use fireworks in an area that constitutes a severe fire threat based on the vegetative conditions during the current fire season as determined by the Eagle City Council; and WHEREAS, Idaho Code Section 39-2609(4) authorizes a determination by the Eagle City Council that a severe fire threat exists during current fire season; WHEREAS, the current fire season is the period between June 1 and October 31 of any given year; WHEREAS, Idaho Code Section 39-2602(3) defines "fireworks" as any combustible or explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible effect by combustion, explosion, deflagration, or detonation. Fireworks include items classified as common or specific fireworks by the United States bureau of explosives or contained in the regulations of the United States department of transportation and designated as UN 0335 1.3 or UN 0336 1.4G. The term "fireworks" shall not include any automotive safety flares, toy guns, party poppers, "pop - its", or other devices which contain twenty-five hundredths (0.025) of a grain or less of explosive substance; and WHEREAS, Idaho Code Section 39-2612 authorizes the City to enforce Idaho Code Section 39- 2609(4). NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby deems it appropriate under the current conditions to declare a severe fire threat sufficient to institute a fireworks restriction during the current fire season in the areas designated as "Wildland-Urban Interface Overlay District' (WUI) and "Additional Severe Fire Threat Area" on the attached map (Exhibit A) that is made a part hereof. This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 23rd day of June, 2026.
