WHEREAS, Dan Henderson requested a vacation to the final plat of Randall Acres Subdivision No. 15 to vacate the twelve -foot (12') wide public utilities and drainage easement (Exhibits "A" and "B") within Lot 21, Block 2 (Randall Acres Subdivision No. 15); and WHEREAS, On May 4, 2026, the Planning and Zoning Commission recommended approval of the vacation (VAC-2026-01), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on May 8, 2026, and May 10, 2026; and WHEREAS, On May 26, 2026, the City Council held a public hearing on the proposed vacation (VAC-2026-01), and voted to approve the vacation; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". WHEREAS, Relinquishment letters have been provided as required in Idaho Code 50-1306A. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the twelve -foot (12') wide public utilities and drainage easement (Exhibits "A" and "B") located on Lot 21, Block 2, of the final plat of Randall Acres Subdivision No. 15, as considered, heard, and approved by the Council at its May 26, 2026, public hearing for application number VAC-2026-01, and as shown on the attachments hereto. This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 9th day of June, 2026.
