WHEREAS, the Owners are the owners of record of certain real estate identified as Ada County parcel numbers R2597570100, R2597570200, R2597570300, R2597570400, R2597570500, R2597570600, R2597570700, R2597570800, and R2597570900 ("Property"), as specifically defined in the attached legal description (Exhibit A), which is subject to an application for modification of development agreement, identified as Eagle Rezone Modification Application No. RZ-2021-11 -MOD 1; and WHEREAS, the proposed development agreement modification includes properties within an area currently zoned R-2-DA (Residential with a development agreement); and WHEREAS, all provisions with the Development Agreement recorded under Instrument No. 2022- 070566 are in, and shall remain in full force and effect, except that condition of development #3.11 shall be amended as stated herein; and WHEREAS, the Owners have provided the City with an affidavit agreeing the submit the Property to a Development Agreement Modification (Exhibit 111-117) pursuant to Eagle City Code Section 8-10-1(C)(1) and be bound by same; and WHEREFORE, the Owner and the City of Eagle desire to resolve the issues and concerns that have arisen and for and in consideration of the mutual covenants contained in the Development Agreement recorded under Instrument No. 2022-070566, each Party represents, covenants and agrees to the modification as follows: AGREEMENT 1. Recitals. All recitals contained in this Development Agreement Modification are true, correct, material and are hereby incorporated herein as if set forth in full. 2. Changes to Section 3.11 Conditions on Development. Enforceable Provisions. The original Development agreement, Instrument No. 2022-070566, remains in full force and effect except as modified in Article I herein. 4. Effective Date. This Development Agreement Modification shall be effective after delivery to each of the parties hereto of a fully executed original of this Development Agreement Modification.
