EAGLE PLANNING AND ZONING COMMISSION
MINUTES OF THE DECEMBER 18, 1989 MEETING
The Eagle Planning and Zoning Commission met in regular session
on December 18, 1989 at 7:30 p.m. Chairman SINCLAIR presiding.
Roll call showed the following members present: SINCLAIR,
GERBER, EASON, TEWKSBURY,WATSON. Absent: BENNETT.
Moved by GERBER and seconded by EASON to approve the minutes of
the December 4, 1989 meeting. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/EAGLE RIM ESTATES: Request for Variances on lots
1-7, 11-14, 16-23 and 33-36, excluding 25 -32. Representative
and developer, Walt Wanner, spoke in favor of the variance
request.
Mr. Wanner advised the commissioners that all the requested
variances are on lots that do not impact anyone else in the
perimeter.

Public Hearing closed at 8:10 p.m.
Moved by WATSON and seconded by TEWKSBURY to approve the
variances on individual merit. ALL AYE: MOTION CARRIED.
Moved by WATSON to grant variances on the following lots only:
lot 34 to 20 ft. rear set back, lot 35 to 18 ft. rear set back,
lot 36 to 20 ft rear set back and lot 5 to 5 ft set back for both
sides. Motion seconded by EASON. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/CITY OF EAGLE ANNEXATIONS: Request made by the
City of Eagle on 8 areas of study for the purpose of annexation.
Read into record letters and forms returned to city hall.

Moved by EASON and seconded by GERBER that if consent for
annexation is obtained or it is otherwise determined that the
property is legally annexable the following zoning is
recommended:
Area 1: C-1 (Design Review) with the exception of the existing
subdivision. The subdivision to be zoned a compatible zone to
what it is now.
Area 2: Agricultural
Area 3: Agricultural
Area 4: Agricultural
Area 5: C2 (Design Review)
Area 6: North of McGraph Rd. C-1 (Design Review)
On highway C-2 (Design Review)
Toward river M-2 (Design Review)
On river M-3 (Design Review)
C-1 (Design Review)

Orderly development of the city would indicate that annexation is
desirable, refer to city code 1-10-2 and the Idaho Land
Development act dated 1975.

MOTION CARRIED.
PUBLIC HEARING/HIGHWAY 55 ANNEXATION: Representative Carlyle
Briggs spoke on behalf of the property owners requesting
annexation. Those property owners are:
B2L2, Eagle Land Co.,Carl Raasch, Bannock Paving (Ray Dowding)
and A. B. West.
In favor:
Al Lance: For the record wants commissioners to know that he
requests annexation only with the approve of a M zone and does
not want to have development held up by a moratorium.

Moved by EASON and seconded by GERBER that if consent for
annexation is obtained or it is other wise determined that the
property is legally annexable the following zoning is
recommended:

Area 4: M-3 check with highway

Area 5: M-3 (Design Review)
