EAGLE PLANNING AND ZONING COMMISSION
MINUTES OF THE DECEMBER 4, 1989 MEETING
The Eagle Planning and Zoning Commission met in regular session
on November 6, 1989 at 7:30 p.m. Vice Chairman SINCLAIR
presiding. Chairman WATSON absent.
Roll call showed the following members present:
BENNETT, GERBER, EASON. Absent: TEWKSBURY.
SINCLAIR,
Moved by EASON and seconded by ,BENNETT to approve the minutes of
the November 6, 1989 meeting. ALL AYE: MOTION CARRIED.
ELECTIONS: Nominations are SINCLAIR, EASON. Moved by GERBER and
seconded by BENNETT for nominations to cease. ALL AYE: MOTION
CARRIED. GERBER nominated SINCLAIR for Chairman, seconded by
BENNETT, by voice vote all aye, BENNETT nominated EASON for Vice
Chairman, seconded by GERBER, by voice vote all aye.
1990 EAGLE COMPREHENSIVE PLAN AMENDMENT PROPOSAL:

2. Page 11, (4) delete "flood plains", insert "floodway".
Delete "provided however, industrial use shall be allowed in a
limited area as specified by the Industrial policies of the Land
Use section of this Plan."
3. Page 14 (5) delete all.
4. Page 20 (3) delete the word "large" in the first sentence and
change paragraph to read: ~ " All new subdivisions, PUD'S,
commercial/industrial developments with densities of more than
three single family dwelling units per five acres shall be
required to: ( A.) be connected to a central sewer system,
defined as a system that connects all units to a central
treatment plant in a subdivision and prohibits all septic tanks.
All sewer systems must meet central District Health standards,
(B.) A central water facility which is defined as a water
system defined as a water system approved by the Central District
Health and the Eagle City Standards and meets the requirements
of fire protection provided in the Unifòrm fire code as adopted
by the City of Eaqle."

ADA COUNTY TRANSMITTAL 89-31-PDC/89-26-ZC: Moved by EASON and
seconded by GERBER to recommend to council that this transmittal
be returned to Ada County with the following comments:
1. Entrances and exits must be onto Edgewood, not State Street,
and meet county highway standards, intersection prohibited on to
State Street, per Eagle Comprehensive Plan, page 9, paragraph 12.
2. Property is included in the proposed area of annexation in
Eagle, the proposed zoning in that area is C-2. Zoning would be
appropriate for the request of this transmittal. In the event of
annexation the Eagle City Code, Title 9, chapter 3, section 2-
l(f) states "Frontage Roads: Where a subdivision abuts or
contains an arterial street, it shall be required that there be
frontage roads approximately parallel to and on each side of
such arterial street; or, suc~ other treatment as is necessary
for the adequate protection of residential properties and to
separate through traffic from local traffic." Further, Title 9,
chapter 3, section 2-2(b) "access from a frontage road onto an
arterial street shall be limited to 1,500 feet between points".

ADA COUNTY TRANSMITTAL 89-32-PDR/89-27-ZC: Moved by GERBER and
seconded by EASON to recommend to council that compliance with
the Eagle Comprehensive Plan be met in accordance to Page 20,
paragraph 3 which states that all new subdivisions with densities
of more than three single family dwelling units per five acres
shall be required to be connected to a central sewer system and a
central water facility which is defined as a water system
approved by Central District Health and Eagle City Standards and
meets the requirements of fire protection. It is suggested that
(1) reduce the lots by one, or (2) require central sewer and
water. .

MOTION CARRIED.
AGRICULTURAL REPORT: SINCLAIR attended the Ada County meeting
regarding the Agricultural amendments and found them favorable.
Also included in the meeting was conversation regarding the 1,900
acres being purchased by Boise for a sludge plant. The
prevailing winds in this valley are from 280 degrees, down wind.
It would cause pollution of the air. Moved by GERBER and
seconded by EASON to recommend to council a letter be written to
the City of Boise objecting to the purchase and operation of this
plant, for said purpose, on the grounds that it would cause air
pollution and create a detrimental environmental impact to the
citizen of Eagle. ALL AYE: MOTION CARRIED.
PUBLIC HEARING: SCHEDULE OF DISTRICT REGULATIONS/ There was no
public testimony in favor or opposed. Moved by EASON and
seconded by GERBER to approv~ the Schedule of District
Regulations as written. ALL AYE: MOTION CARRIED.
Moved by GERBER and seconded by EASON to adjourn the meeting.
