EAGLE PLANNING AND ZONING COMMISSION
MINUTES OF THE OCTOBER 2, 1989 MEETING
The Eagle Planning and Zoning Commission met in regular session
on October 2, 1989 at 7:30 p.m. Chairman WATSON presiding.
Roll call showed the following members present:
TEWKSBURY, BENNETT, GERBER. Absent: EASON.
Motion by SINCLAIR and seconded by TEWKSBURY to approve the
minutes of the September 18, ,1989 meeting. ALL AYE: MOTION
CARRIED.

PUBLIC HEARING: C.L. House Subdivision
Moved by SINCLAIR and seconded by TEWKSBURY to move the public
hearing later in the agenda as the representative is not present
at this time. ALL AYE: MOTION CARRIED.
FINDINGS OF FACT/CONCLUSIONS OF LAW: St. Mathews Catholic
Church. Moved by SINCLAIR and seconded by TEWKSBURY to approve
the findings as presented. ALL AYE: MOTION CARRIED.
SCHEDULE OF DISTRICT REGULATIONS: The schedule was presented by
City Attorney, Mona Mack for consideration with the following
discussion and changes:

Page 2, Chapter 1, Zoning Interpretation and Definitions:
AGRICULTURE AND FOREST-strike dairying and viticulture.
AGRICULTURE AND FOREST-omit (B) and re-enter in 8-3-5, The
Schedule.
CEMETERY-omit in definitions and re-enter in 8-3-5.
AIRPORT-strike "jet" and add "aviation" before fuel.
Page 3, APARTMENT-add the word house.
AUCTION FACILITY-definition needed between facility and yard
Page 3, AUTOMOTIVE, MOBILE HOME, TRAVEL TRAILER AND FARM
IMPLEMENT SALES-strike automotive, and in the definition
strike "but not" to read farm implements, including repair.

Representative for C.L. House, Pat Tealey of Tealey Surveying
advised the Commission that even though the item was not included
in the public hearing, they would like consideration of a
"vacation" of Third Street, which would take away the financial
responsibility of ACHD's requirement for curb and gutter, plus
add 30 ft. to the property. City Hall would receive the other 30
feet that would have been the street. Since the City is the

adjoining owner, the proposal would need the City's consent.
Tealey stated that he believed that ACHD would require a
dedication of a culdesac. The issue would go to a separate
public hearing with the highway department. The plat was
presented with a proposed 3 lot split in the commercial area of
the property. There is no proposed development of the land at
this time.

There was no opposition.
Discussion involved the vacation of Third Street, which will have
to be addressed at another time, and the possibility of sewer
prior to development. The property is now on a septic system.
It was noted by SINCLAIR that a portion at the Northern portion
of the property is not commercial but residential. If
development is proposed that portion would have to be rezoned.
Moved by SINCLAIR and seconded by TEWKSBURY to approve the
application as presented. ALL AYE: MOTION CARRIED.

CABINET SHOP-C in all commercial zones, P in manufacturing.
FURNITURE MANUFACTURING-C in all commercial zones, P in
manufacturing.
CA ZONE-"Airport" only.
BAR-Mona will prepare a definition. C in all zones.
CHILD CARE FACILITY-substitute sustain for maintenance.
COMPREHENSIVE PLAN DEFINITION-changed to read the same in
Title 8 and 9. The two titles read differently at this
time.
(Mona will include in definitions)
DAIRY FARM-Agricultural zone as P.
ENTERTAINMENT FACILITIES-omit "Commercial". Strike
nightclubs, and cocktail lounges and add a sports arena.
Definitions of outdoor and indoor will provide the
deference.
LIVESTOCK FACILITY (concentrated) will be defined by City
Clerk.
PRIVATE RD-will be defined by Mona.
DRIVE WAY-definition "a two family dwelling".
The remainder of the schedule will be modified, where necessary,
by the City Attorney and resubmitted at the next meeting on
October 23, 1989.

ANNEXATION:
Planning and Zoning Chairman, Daryl Watson introduced letters
opposing area 3 in the annexation study from Lynne Sedlacek, Fred
Kunkler and Lois Kunkler.
Moved by SINCLAIR and seconded by BENNETT to forward the
recommendations attached and hereafter known as Exhibit "A" to
the City Council. The exhibit includes the recommendations of
the Planning and Zoning Commis~ion to the City Council on zoning
of the areas 1 through 7A as provided as a duty of the Planning
and Zoning Commission in Title 8, section 7-6, but to limit the
Commission to the zoning issue. AYE: SINCLAIR, BENNETT. NAY:
TEWKSBURY, GERBER. Chairman WATSON called upon to break the tie
vote. AYE: WATSON. MOTION CARRIED.
Moved by TEWKSBURY and seconded by SINCLAIR to adjourn the
meeting. The time was 10.35 p.m.
