DEVELOPMENT AGREEMENT MODIFICATION
This Development Agreement Modification, made and entered into on the date as indicated herein,
by and between the CITY OF EAGLE, a municipal corporation in the State of Idaho ("Eagle" or the
"City"), CORE BUILDING COMPANY, and FENG-LING WANG (collectively "Owners").
WHEREAS, the Owners are the owners of record of certain real estate identified as Ada County
parcel numbers R3683000101, S0506120610, and S0506120700 ("Property"), as specifically defined in
the attached legal description (Exhibit A), which is subject to an application for modification of
development agreement, identified as Eagle Rezone Modification Application No. RZ-2021-15-MOD2;
and
WHEREAS, the proposed development agreement modification includes properties within an area
currently zoned R-E-DA (Residential Estates with a development agreement); and
WHEREAS, all provisions with the Development Agreement recorded under Instrument No. 2022-
035086 are in, and shall remain in full force and effect, except that condition of development #3.10 shall be
amended as stated herein; and
WHEREAS, the Owners have provided the City with an affidavit agreeing the submit the Property to
a Development Agreement Modification (Exhibit B) pursuant to Eagle City Code Section 8-10-1(C)(1) and
be bound by same; and
WHEREFORE, the Owners and the City of Eagle desire to resolve the issues and concerns that
have arisen and for and in consideration of the mutual covenants contained in the Development Agreement
recorded under Instrument No. 2022-035086, each Party represents, covenants and agrees to the
modification as follows:
AGREEMENT
1. Recitals. All recitals contained in this Development Agreement Modification are true, correct, material
and are hereby incorporated herein as if set forth in full.
2. Changes to Section 3.10 Conditions on Development. Section 3.10 of the Development Agreement is
hereby deleted in its entirety and replaced with the following:
3.10 A landscape buffer area, located within an easement, shall be required along all Beacon
Light Road and Ballantyne Lane frontages. The easement along both frontages shall be 35 feet in

width and shall include a 4 foot tall berm height with a 34 foot tall split rail fence on top. The
frontage along Beacon Light Road and Ballantyne Lane shall be landscaped in accordance with
Eagle City Code 8-2A-7(J)(4)(a), with the exception of the frontage within the Lateral 78 irrigation
easement, which shall be permitted to be landscaped with reduced planting requirements in
accordance with the conditions of the Lateral 78 license agreement (Ada County Instrument No.
2024-050654). The buffer area impacted by the Lateral 78 easement shall include a minimum of
18 conifers, 14 shade trees, 7 flowering trees, and 175 shrubs. The owner shall submit a design
review modification application that includes the entirety of the buffer area for City review and
approval of the revised landscape plan prior to the issuance of a notice to proceed with construction
letter.
3. Enforceable Provisions. The original Development agreement, Instrument No. 2022-035086, remains
in full force and effect except as modified in Article I herein.
4. Effective Date. This Development Agreement Modification shall be effective after delivery to each of
the parties hereto of a fully executed original of this Development Agreement Modification.
