A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE ONE FOOT (l') OF THE FIVE-
FOOT -WIDE (5'W) PUBLIC UTILITIES, DRAINAGE, AND IRRIGATION FACILITIES EASEMENT
LOCATED ON LOT 8, BLOCK 5, OF THE AVIMOR BOISE COUNTY PHASE 1 SUBDIVISION AS
SHOWN ON THE ATTACHMENT HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, TH Holdings 2022, LLC, requested a vacation to the final plat of Avimor Boise
County Phase 1 Subdivision to vacate one foot (l') of the five -foot -wide (5'W) public utilities, drainage,
and irrigation facilities easement (Exhibit "A") on Lot 8, Block 5 (Avimor Boise County Phase 1
Subdivision); and
WHEREAS, On November 17, 2025, the Planning and Zoning Commission recommended
approval of the vacation (VAC-2025-03), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho
Statesman on November 26, 2025, and November 28, 2025; and
WHEREAS, On December 16, 2025, the City Council held a public hearing on the proposed
vacation (VAC-2025-03), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions
of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City
Code, "Vacations and Dedications".
WHEREAS, Relinquishment letters have been provided from all utility providers identified in
Idaho Code 50-1306A.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE,
IDAHO.
The Eagle City Council hereby vacates one foot (1') of the five -foot -wide (5'W) public utilities,
drainage, and irrigation facilities easement (Exhibit "A") located on Lot 8, Block 5, of the final plat of
Avimor Boise County Phase 1 Subdivision, as considered, heard and approved by the Council at its
December 16, 2025, public hearing for application number VAC-2025-03, and as shown on the attachments
hereto,
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 13th day of January, 2026.
