ORDINANCE NO. 959
AN ORDINANCE CHANGING THE 'ZONING CLASSIFICATION OF ► E REAL
ROPERTY DESCRIBED HEREIN FROM RUT (RURAL-URBAN TRANS ' ON — ADA
\ UNTY DESIGNATION) TO R-1-DA (RESIDENTIAL WITH A D' ELOPMENT
AG' EMENT); AMENDING THE ZONING MAP OF THE CITY OF EAG TO REFLECT
SAID CHANGE; PROVIDING A SEVERABILITY CLAUSE; AND 'ROVIDING AN
EFFEC VE DATE.
WHEREAS, •e City of Eagle, Idaho is a municipal corporation org. zed and operating under
the laws of the ate of Idaho; and
WHEREAS, pursu..,t to Chapter 65, Title 67, Idaho Code, the C. of Eagle has the authority to
adopt, establish and a •end a Zoning Ordinance; and
WHEREAS, the owner . the real property situated withi the City of Eagle and particularly
described in Exhibit"A" . ' shown on Exhibit`B" of thi ordinance has requested, in writing, a
rezone from RUT (Rural-Urb. . Transition — Ada Co Designation) to R-1-DA (Residential
with a Development Agreement), . d
WHEREAS, the property describe. -n Exhibit "A" s located at 2257 North Park Lane, Eagle
Idaho 83616; and
WHEREAS, the Planning and Zoning . sion of the City, pursuant to public notice as
required by law, held a public hearing on : gust 18, 2025, as required by Section 67-6509,
Idaho Code, and made a recommendation t• - Mayor and Council; and
WHEREAS, the Eagle City Council, p uant to .ublic notice as required by law, held a public
hearing on September 23, 2025, on th= .roposed zo'ing for the real property described in Exhibit
"A" as required by Section 67-6 49, Idaho Code, made findings and determined that the
requested zoning classification o -1-DA (Residentia ith a Development Agreement) for the
property described in Exhibit "• ' is appropriate to meet .•e requirements of Idaho Code, Eagle
City Code and the Eagle Com. 'hensive Plan and is hereby _.anted.

NOW THEREFORE, B T ORDAINED BY THE MAYOR A D COUNCIL OF THE CITY
OF EAGLE, IDAHO, • FOLLOWS:
Section 1: The Ci Council hereby finds and determines that the eal property particularly
described in Exhi. t "A" and shown on Exhibit "B" be removed from he RUT (Rural-Urban
Transition — A.. County Designation) zoning classification and inc ded in the R-1-DA
(Residential w' a Development Agreement) zoning classification purs. .nt to the Zoning
Ordinance o the City of Eagle. The City Council further finds and determ •,-s that said zone
change is i► accordance with the Eagle Comprehensive Plan and relevant City C►des.
