Resolution - 2025 - 25-26 - Vacation To The Final Plat Of Ashbury Commercial Sub - 10/28/2025Ada County Recorder Trent Tripple 2026-036123 Boise, Idaho Pgs= 6 asteele 05/19/2026 03:31:35 PM CITY OF EAGLE $0.00 Electronically Recorded RESOLUTION NO.25-26 A RESOLUTION OF THE EAGLE CITY COUNCIL TO PARTIALLY VACATE THE CROSS -ACCESS AND CROSS -PARKING EASEMENT LOCATED ON LOT 4 AND LOTS 7-9, BLOCK 1, ASHBURY COMMERCIAL SUBDIVISION, AS SHOWN ON THE ATTACHMENT HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Funnel Properties LLC requested a vacation to the final plat of Ashbury Commercial Subdivision to vacate a portion of the cross -access and cross -parking easement (Exhibits "A", "B", and "C") on Lot 4 and Lots 7-9, Block 1, Ashbury Commercial Subdivision; and WHEREAS, On September 2, 2025, the Planning and Zoning Commission recommended approval of the vacation (VAC-2025-02), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on September 26, 2025, and September 28, 2025; and WHEREAS, On October 14, 2025, the City Council held a public hearing on the proposed vacation (VAC-2025-02), and voted to approve the vacation; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". WHEREAS, Relinquishment letters have been provided as required in Idaho Code 50-1306A. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the portions of the cross -access and cross -parking easement (Exhibits "A", a`B", and "C") located on Lot 4 and Lots 7-9, Block 1, of the final plat of Ashbury Commercial Subdivision, as considered, heard and approved by the Council at its October 14, 2025, public hearing for application number VAC-2025-02, and as shown on the attachments hereto. This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 28th day of October, 2025.
