Ordinance - 2025 - 957 - Amending Title 6 Chapter 5 - Water Customer Deposit Refunds - 10/14/2025ORDINANCE NO.957 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AMENDING TITLE 6, "PUBLIC WAYS AND PROPERTY", CHAPTER 5 "WATER SYSTEM", SECTION 5 "APPLICATION FOR SERVICE", PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho, is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, the City of Eagle, Idaho, desires to change the method of refunding water customer deposits; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section 1: That Title 6, Chapter 5, Section 5 "Application for Service" be and is hereby amended, in part, to read as follows with underline text to be added and strike -through text to be deleted: 6-5-5: ^ DDT rr 6rFIO.i FOR INITIATION OF SERVICE: A. ^ pp'ioa4ion FormInitiation of Service: To initiate water service shall sign aflappheation t6fm „ ided the applicant shall contact theme city hall giving the date of applieation.. and provide the location of premises to be served, the date applicant desires services to begin, purpose for which services are to be used, the address for mailing of the billings, the elass .,n the size of'the meter ser-viee and such other information as the water department may reasonably require. in signing the applieation With the request to initiate service the applicant agrees to abide by the rules and regulations of the water department. Deposits shai! be held t6 one year 4vo`m the ate of deposit. A deposit will be included in the customer's first water bill for the establishment of water service. The deposit will be noted on the customer's account The City will not pay interest on any deposits. 1. Deposit Requirements And Establishment Of C *: With each any -application for water service to be supplied through the water system of the city, there may be a deposit required by the city clerk, or its designee, a sum in cash, the amount to be determined by resolution of the city council upon the trpent1ie passage of this chapter and reviewed at least annually and updated by resolution of the council. 2. Deposits: a) Application of Deposit: Deposits will be applied to the account after the City has received twelve (12) consecutive on -time payments. Section 4: This ordinance, or a summary thereof in compliance with Idaho Code §50-901A, shall be published once in the official newspaper of the City, and shall be in full force and take effect immediately upon its passage, approval, and publication.
