MEETING MINUTES
September 23, 2025
1 PLEDGE OF ALLEGIANCE:
2. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m.
3. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME. Absent: A
quorum is present.
4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA
Zoning Administrator, Bill Vaughan states that the applicant and staff are requesting item 7H —
Reining Horse Subdivision be continued to the October 28`' meeting.
So moved by Gindlesperger. Seconded by May. ALL AYE...MOTION CARRIES.
5. REPORTS:
A. Mayor and Council: May asks that Rob Behunin with Clyde Capital Group be allowed to
speak to give an update on the fund-raising efforts for the Eagle Regional Athletic Park. Mr.
Behunin represents the owners of Valnova and is very happy to be part of the Eagle Community.
He was asked to be part of the Mayor's Blue Ribbon Committee, comprised of Mayor Pike, Council
President May and himself. The group has been working diligently for the last nine (9) months and
has secured commitments from numerous partners, stakeholders and friends in the amount of $7.3
million dollars for Phase 1 of the park, with only 1.5 million remaining needed for Phase 1. The
contracts and agreement for those donations will be brought forward to Council for final negotiation
and authorization in the upcoming months. Russell attended the Eagle Urban Renewal Agency
meeting and reports on the same. Kvamme reports on the Avimor CID and Parks Pathways
Recreation Commission meetings. Presentations were given by SWIMBA and Southwest Idaho
Trail and Distance Riders. Mayor Pike participated in the Domestic Violence Awareness event,
met with some new business owners in Eagle as well as created the Mayor's Minute for the week.
He encourages people to attend the State of the City event on Thursday at Eagle Nazarene Church.
The event is hosted by the Eagle Chamber of Commerce.
B. Department Supervisor:
1. Financial Report for the Month of August, City Treasurer. (LL)
Director of Long Range Planning and Projects, Nichoel Baird Spencer provides a status update on
Capital Projects, including the Heritage Park project and the Downtown Mobility project.
Director of Public Works, Eric Ziegnef iss reports on recent departmental activities. Reports that
the Idaho Broadband Coalition was awarded BEAD monies to expand services to underserved
areas in Eagle. Director Ziegenfuss has been having discussions with Ada County about trail
signage at the bike park, further information will be provided as staff works through those
matters. He recently presented to the City of Meridian Recreation Department to discuss recent
activities in Eagle. Leaf collection activities are being coordinated in preparation for the leaves
dropping.
City Clerk, Tracy Osborn notes that staff will be reaching out to discuss November meeting dates
as the first meeting in November falls on a holiday.
C. Eagle Police Department: Chief Ruby introduces Lt. Haines is introduced to the City Council
and his law enforcement experience. Chief Ruby reviews monthly statistics for the City of Eagle.

ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a Councilmember,
member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a
sequence determined by the City Council. Any item on the Consent Agenda which contains written

E. Professional Services Agreement Between the City of Eagle and Recite Me: An agreement
between the City of Eagle and Recite Me to provide web accessibility software in an amount not to
exceed $3,820.00. The agreement will begin October 1, 2025, and expire after 12-months. (TEO)
F. Prosecution Services Agreement - Ada County: An agreement between the City of Eagle
and the Ada County Prosecuting Attorney for prosecution services in those portions of the City of
Eagle located within Ada County. The agreement will not exceed $150,990.02 and will be in effect
from October 1, 2025 through September 30, 2026. (W)
G. Prosecution Services Agreement - Boise County: An agreement between the City of Eagle
and the Gem County Prosecuting Attorney for prosecution services in those portions of the City of
Eagle located within Boise County. The agreement will not exceed $9,000 and will be in effect
from October 1, 2025 through September 30, 2026. (W)
H. Prosecution Services Agreement - Gem County: An agreement between the City of Eagle
and the Gem County Prosecuting Attorney for prosecution services in those portions of the City of
Eagle located in Gem County. The agreement will not exceed $3,000 and will be in effect October

I. Amendment No. 2 to Lease Agreement Between Eagle Community Food Bank Inc and
the City of Eagle: A Lease Agreement Amendment between Eagle Community Food Bank Inc.
and the City of Eagle. To extend the lease for an additional 12-months, with the new term beginning
October 1, 2025, and expiring on September 30, 2026. The City owned property leased is a total of
approximately 460 square feet within the Eagle Senior Center (interior) for an annual amount of
$6,000. (BKP)
J. Amendment No.1 to Lease Agreement Between Friends of Eagle Public Library, Inc and
the City of Eagle: A Lease Agreement Amendment between Friends of Eagle Public Library Inc.
and the City of Eagle. The amendment is to extend the lease for 12-months, with the new term
beginning October 1, 2025, and expiring on September 30, 2026. The total City owned property
leased is approximately 413 square feet within the Eagle Community Hall (interior), and Eagle
Public Library (interior and exterior), for an annual amount of $1.00. (BKP)
K. Cooperative Agreement Between the City of Eagle and Valley Regional Transit: A
Cooperative Agreement between Valley Regional Transit and the City of Eagle for Public

W. Permanent Pathway Easement Agreement Between the City of Eagle and Homestead
Owners Association for a Public Pathway within Lanewood Subdivision: Homestead Owners
Association is requesting approval of a permanent pathway easement agreement for public
pathways located within Lanewood Subdivision No. 5. The 1.26-acre site is located on the east side
of North Fountainhead Way between West Mansard Drive and West Braveheart Drive. (ASG)
X. Permanent Pathway Easement Agreement Between the City of Eagle and DFC Eagledale
LLC for a Public Pathway Within Everton Subdivision: DFC Eagledale, LLC is requesting
approval of a permanent pathway easement agreement for public pathways located within Everton
Subdivision. The 76.88-acre site is located on the northeast corner of State Highway 44 and North

Kvamme discusses the use of the city owned facility and perhaps the Friends of Eagle Public
Library Inc. could assist in the funding of the study that is identified as a capital project for the
library. Gindlesperger states that a joint meeting with the Library Board and the Friends, decided
the Friends of Eagle Public Library should hold off donating funds until the Library Facility study
is complete, so that perhaps the funds could have a larger impact. Gindlesperger states that it was
her recommendation that the rent be $1.00 due to all the activities the group does for their book
sales. Discussion.

8. PUBLIC HEARINGS:
Mayor Pike asks if there are disclosures of ex-parte contact and/or conflict of interest.
Kvamme states that regarding item 7F was one of the founding members of Drake Investments,
however, is no longer a member of Drake Investments. He is a partner with Drake Investments in
another project outside of Eagle City limits. Kvamme has no financial interest in this application.
He does not feel there is a conflict of interest and can make an unbiased decision on the application.
A. Ada County Jail Capital Improvement Plan and Development Impact Fee Study: The City
of Eagle is requesting approval of the Ada County Jail Improvement Plan and Development Impact
Fee Study dated May 24, 2024. (TEO)

Steve Rutherford, Chief Operating Officer and Richard Beck, Director of Ada County
Development Services provide an overview of Idaho Statues regarding development impact fees,
the County's process for review and proposal of the capital plan and the request for Eagle to adopt
the same. The intent is for new growth to pay for itself with the implementation and collection of
these fees.
Tracy Osborn, City Clerk states that the statutory requirements associated with the adoption of the
capital improvement plans have been followed. The City's Development Impact Advisory
Committee has reviewed the plans for coroner, jail and EMS and has forwarded a recommendation
of approval to the City Council. In addition, the fees proposed are those that correspond with the
Capital Plans for Ada County EMS, Coroner and Jail that publication requirements have been met.
Osborn notes that prior to the collection of these fees, an ordinance modifying Eagle City Code and
intergovernmental agreements for the collection of fees will need to be brought before Council at
a future date.

requesting conditional use permit approval for a horse boarding and training facility (riding
academy/stable) in the R-E (Residential Estates) zone including a Class C home occupation for
Sunset Stables, LLC. The 2.36-acre site is located approximately 330-feet east of the intersection

Melissa and Tyler Layfield 1852 Hereford Dr. Eagle Idaho representing Sunset Stables LLC
reviews the application. They initially believed that this the stables would be an allowed use as it
was zoned agricultural and thus additional permitting would not necessary. However, upon
notification that a conditional use permit was required, they began working through the appropriate
process. They are requesting two waivers associated with the conditional use permit.

intent of the subdivision was to have agricultural activities associated within the subdivision. He is

Joel Anderson 1424 Hereford Dr. Eagle, Idaho. Mr. Anderson lists concerns associated with the

traffic safety, manure droppings from the animals being walked around the road, and the number
of trash containers on site. She states that she has witnessed public urination. Ms. Anderson
requests Council deny the application.
Patrick Cartright 1648 Hereford Dr. Eagle, Idaho. Mr. Cartwright is in favor of the application.
His property is directly adjacent to the Layfield's and does not have issue with the placement of
the fencing. This is the third meeting he has attended regarding the application, and this is the first
opposition he has heard. He does rent pasture to the Layfield's and enjoys watching the animals
graze.
Mariah Cartwright 1648 Herford Dr. Eagle, Idaho. Ms. Cartwright has not experienced any
negative impact from the proposed boarding facility. The applicants have been proactive and
communicative when issues may have arisen. She is in favor of the approval of the application.

Melissa and Tyler Layfield rebut testimony. They had implemented a policy too that if horses are
to walked on the streets the boarders are to clean them up. There is a porta-potty on site for horse
owners to utilize and have never witnessed clients urinating in public. They are currently planning
on installing sprinklers to mitigate dust on site and have also purchased a site dumpster to use in
lieu of the 16 garbage cans that had been previously used.

• Early 2019 —Ada County began exploring its ability to collect Development Impact Fees.
• Late 2020 — Galena Consulting hired to develop Capital Improvement Plans (CIPs) and
Development Impact Fees for Ada County Sheriff, Jail, EMS, and Coroner.
• Spring of 2021 — CIPs and Fee Structure completed and recommended for approval by Ada
County Development Impact Fee Advisory Committee.
• Summer of 2021—Summer of 2022 — Ada County Development Services contacted City
partners to review CIPs/Development Impact Fees and discuss next steps for adoption.
• Spring of 2023 — at the request of a few City partners, Ada County Development Services
contracted with TischlerBise to review/update the CIPs and Development Impact Fees
prepared by Galena Consulting.
• Spring of 2024 — Updated CIPs and Development Impact Fees completed and
recommended for approval by Ada County Development Impact Fee Advisory Committee.
• Summer of 2024 — Ada County Development Services reengaged City partners to review
updated CIPs/Development Impact Fees and discuss next steps for adoption.
Purpose
Per Idaho Code 67-8202(1-4), it is the intent of Ada County to:
1. Collect impact fees to ensure that adequate public facilities are available to serve new growth and development;
2. Promote orderly growth and development by establishing uniform standards by which local governments may
require that those who benefit from new growth and development pay a proportionate share of the cost of new
public facilities needed to serve new growth and development;
3. Establish minimum standards for the adoption of development impact fee ordinances by government entities;
4. Ensure that those who benefit from new growth and development are required to pay no more than their
proportionate share of the cost of public facilities needed to serve new growth and development and to prevent
duplicate and ad hoc development requirements.
Impact fees represent new growth's fair share of capital facility needs. By law, impact fees can only be
used for capital improvements, not operating or maintenance costs. Impact fees are subject to legal
standards, which require fulfillment of three key elements: need, benefit and proportionality.

2. A fence permit is required prior to construction.
3. The proposed fence shall not be constructed within any part of the 10-foot-wide
irrigation and utility easement as noted on the plat of Banbury Subdivision No. 6.
4. The fence shall be constructed with a similar appearance (height, color, finish,
and pattern) and alignment as the previously approved fences along the north
side of East Chinden Boulevard. The applicant shall be required to submit a
product cutsheet, with specifications and proposed location adjacent to East
Chinden Boulevard, to the City prior to receiving a fence permit.
