AN ORDINANCE AMENDING SECTION 1-7-4, EAGLE CITY CODE, TO PROVIDE
FOR THE ESTABLISHMENT BY RESOLUTION OF FEES FOR LAND USE PLANNING
ACTIONS; AND PROVIDING FOR EFFECTIVE DATE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO, that:
Section 1: Section 1-7-4, Eagle City Code, be amended, and
the same hereby is amended, to read as follows:
1-7-4: FEE SCHEDULE FOR LAND USE PLANNING ACTIONS:
A. Fee Schedule Established: The City Clerk, at the time of the
filing of the an application for a land use planning action
within the City limits, shall collect the fees -for
such land 113a planning -actions established through a
resolution of the City Council., requested of the City of
Eagle w% tkir the City limits together with any direct costs
incurred by the City in obtaining a review of the
application, by architects, engineers or other professionals
necessary to enable the City to approve or disapprove the
application in an informed manner:-_

B. Area of Impact Referrals: The City Clerk, upon receipt of
each referral to the City pursuant to Title 8, Chapter 8,
Eagle City Code, and the Area of Impact Agreement between
the City and Ada County shall collect from the applicant a
fee of twcnty five dollaro ($25.00) established through a
resolution of the City Council .together with any direct
costs incurred by the City in obtaining a review of the
referral by architects, engineers or other professionals
necessary to enable the City to approve or disapprove the
application in an informed manner.
C. Payment of Fees Prior to Action by the City: Until all fees
charged and expenses established by this Section have been
paid in full, no action shall be taken by the City on any
application or referral to which this Section applies.
D. Refunds: Fees charged pursuant to this Section shall not be
refundable.
E. Waivers: The City Council shall have the authority, in its
sole discretion, to waive, in whole or in part, the
foregoing fees, for good cause shown, in cases of financial
hardship.
Section 2: That this Ordinance shall take effect and be in
force from and after its passage, approval, and one (1)
publication of this Ordinance, or a summary thereof, in
conformance with Section 50-901A, Idaho Code, in the official
newspaper of the City of Eagle d '

A RESOLUTION ADOPTING A FEE SCHEDULE PURSUANT TO SECTION 1-7-4 OF
THE EAGLE CITY CODE, TO PROVIDE FOR THE ESTABLISHMENT BY
RESOLUTION OF FEES FOR LAND USE PLANNING ACTIONS; AND PROVIDING
FOR EFFECTIVE DATE
WHEREAS, the Eagle City Code passed Ordinance #181 for the
establishment of fees by resolution for land use planning
actions, amending section 1-7-4 of the Eagle City Code, on March
12, 1991;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF EAGLE, IDAHO:
Section 1: that said schedule attached hereto as Exhibit A and
incorporated herein by this reference, is hereby approved;
Section 2: that the Mayor and City Council are hereby authorized
to execute said schedule for and on behalf of the city of Eagle;
Section 3: that this Resolution shall be in full force and
effect immediately upon its adoption and approval.
ADOPTED by the Eagle City Council, Eagle, Idaho.
