The above -entitled design review application came before the Eagle Design Review Board for their action
on April 25, 2019. The Eagle Design Review Board having heard and taken oral and written testimony,
and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Great Scott, represented by Daniel Conlin with Idaho Electric Signs, is requesting design review
approval for two monument signs, one building wall sign, and three fuel island canopy signs. The
0.93 -acre site is located on the southeast corner of East Hill Road and SH -55 at 2805 and 2809 East
Hill Road.
B. APPLICATION SUBM1'i'TAL:
The City of Eagle received the application for this item on March 13, 2019. Revised materials were
received by the City on April 10, 2019 (landscape plan) and April 12, 2019 (flood lighting cut sheet,
fuel island canopy sign elevation, justification letter).
C. HISTORY OF RELEVAN 1 PREVIOUS ACTIONS:
On November 9, 1999, the City Council approved a comprehensive plan amendment from Industrial to
Commercial for this site (CPA -06-16).
On January 11, 2000, the City Council approved a rezone from R-4 (Residential) and M -1A (Industrial
Park District) to C -3 -DA (Highway Business District with a development agreement) for Sharon
Patterson (RZ-06-99).
On October 11, 2016, the City Council approved a development agreement modification to allow a
right -in only access from SH -55 and to remove Condition of Development 2.5 which states the project
shall be submitted under a conditional use permit (RZ-06-99 MOD).
On March 9, 2017, the Design Review Board approved a design review application fora 4,128 -square
foot convenience store (with up to two sub tenants) with fuel service and a 2,730 -square foot fuel
island canopy (DR -04-17).
On March 9, 2017, the Design Review Board approved a design review application for a master sign
plan for a convenience store (with up to two sub tenants) with fuel service and a fuel island canopy
(DR -OS -17).
On April 25, 2017, the City Council denied an appeal of the Design Review Board's decision
regarding the height of the monument sign adjacent to SH -55 (AA -04-17).
On February 20, 2019, the City approved a modification to a design review application for a

convenience store to add a 120 -square foot storage building adjacent to the northeast corner of the
building (DR -04-17 MOD).

STAF'F ANALYSIS PROVIDED WITHIN THE STAFF' REPORT:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
• Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. MAS'I'ER SIGN PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:

6. Fuel Island Canopy Sign materials may consist of cast metal, fiberglass, plastic, acrylic (or sim.)
and shall be a minimum of '/z" thick and a maximum of 4" thick. Overall thickness (to be
measured including letters/logo, sign layers, and inches pegged off the face of the fuel island
canopy) shall not exceed 8" thickness. Fuel Island Canopy Sign may be surface -mounted or
pegged off the face of the building.
C. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
• Eagle City Code Section 8 -2A -2(B)
The general theme of the Design Review Overlay District is to specify desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment for
residents and visitors alike. The architectural designs, materials, and graphics set forth in this
article are compiled to create a theme unique to the area called "Eagle Architecture".

Signage for any project shall provide for business identification and minimize clutter and
confusion on and off the site.
a. The "overall sign concept" for multi -tenant business centers to assure that it addresses the
continuity between tenant sign design and building design;
e. The size, location, design, color, texture, lighting, landscaping, and hours of operations of all
permanent signs and outdoor advertising structures or features to ensure that any such
proposals do not detract from the function of, or design of, buildings, structures, surrounding
properties, neighborhoods, or streets.
• Eagle City Code Section 8 -2A -8(A) Applicability:
4. Materials and Appearance: It is the intent of this article to encourage interesting, creative,
readable, effective, uncluttered, and well-maintained signage. Sign materials and appearance
shall be complementary to the building architecture and colors. The exhibits provided in the
EASD book are examples of the type of sign designs envisioned for the Eagle architecture
theme.
D. DISCUSSION:
• The applicant is proposing to construct two monument signs, one building wall sign, and three fuel
island canopy signs for Great Scott. The justification letter states that the monument signs
incorporate the architectural elements from the main building to include matching the stone and
decorative wood elements. Staff defers comment regarding the monument signs, building wall
sign, and fuel island canopy signs to the Design Review Board.
• The sign elevation for the fuel island canopy signs shows the letters with five -inch returns.
Pursuant to the master sign plan, the letters area required to be a minimum of '/z" thick to a
maximum of 4" thick. The applicant should be required to provide a revised sign elevation
showing the letters on the fuel island canopy signs at a maximum of 4" thick. The revised sign
elevation should be reviewed and approved by staff prior to the issuance of a sign permit.
• The sign elevation for the State Highway 55 monument sign shows the words "Regular" and
"Diesel" next to the automated pricing, however, the elevation does not identify materials, colors,
dimension, or illumination type. In addition, the sign elevation does not provide information
regarding materials, colors, dimensions, or illumination for the "Fuel Technology Synergy" tenant
panel. The applicant should be required to provide a revised sign elevation for the State Highway
55 monument sign identifying the materials, colors, dimensions, and illumination type for the
words "Regular," "Diesel," and "Fuel Technology Synergy" tenant panel. The revised sign
elevation should be reviewed and approved by staff and one member of the Design Review Board
prior to the issuance of a sign permit.

• The sign elevations for the two monument signs show tenant panels (Great Scotts, Fuel
Technology Synergy, Exxon, blank) that vary in color including red, blue, white, and sage green.
Past action by the Board and City Council has required monument sign tenant panels to have a
consistent background color on monument signs that include more than one tenant panel. The
applicant should be required to provide revised monument sign elevations showing all tenant panel
backgrounds to be one consistent color. The revised sign elevations should be reviewed and
approved by staff and one member of the Design Review Board prior to the issuance of a sign
permit.

STAFF RECOMMENDATION PROVIDED WITHIN THE STAFF REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site specific
conditions of approval and the standard conditions of approval provided within the staff report.
PUBLIC MEETING OF THE BOARD:
A. A meeting to consider the application was held before the Design Review Board on April 25, 2019, at
which time the Board made their decision.
B. Oral testimony in opposition to the application was presented to the Design Review Board by no one.
C. Oral testimony in favor of the application was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DELIBERATION: (Granicus time 10:50)
Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that:
• The Board affirms the design, materials, and colors of the signage with the site specific conditions of
approval and has added site specific condition no. 6 to ensure the materials proposed on the monument

signs are consistent with the building materials.
BOARD DECISION:
The Board voted 4 to 0 (Baer, Germano, Koci absent) for a design review application to construct two
monument signs, one building wall sign, and three fuel island canopy signs for Great Scott, with the
following staff recommended site specific conditions of approval and standard conditions of approval with
text shown with underline to be added by the Board.
SITE SPECIFIC CONDITIONS OF APPROVAL:
1. Comply with all applicable conditions of DR -OS -17.
2. Provide a revised sign elevation showing the letters on the fuel island canopy signs at a maximum of
4" thick. The revised sign elevation shall be reviewed and approved by staff prior to the issuance of a
sign permit.
3. Provide a revised sign elevation for the State Highway 55 monument sign identifying the materials,
colors, dimensions, and illumination type for the words "Regular," "Diesel," and "Fuel Technology
Synergy" tenant panel. The revised sign elevation shall be reviewed and approved by staff and one
member of the Design Review Board prior to the issuance of a sign permit.
4. Provide revised monument sign elevations showing all tenant panel background to be one consistent
color. The tenant panel background colors shall either all be white or all be Garden Sage. The revised
sign elevations shall be reviewed and approved by staff and one member of the Design Review Board
prior to the issuance of a sign permit.
5. A sign permit is required prior to the installation of any signs on this site.
6. Provide revised monument sign elevations showing the 4" square tube supports and roof face on the
roof cladding overlaid with fiber cement board (Woodstone River Rock) to match the building. The
revised monument sign elevations shall be reviewed and approved by staff and two members of the
Design Review Board prior to the issuance of a sign permit.
NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of
Approval contained herein the Site Specific Condition of Approval shall control.
STANDARD CONDITIONS OF APPROVAL:
1. A building permitlzoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City
Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and the City Council for review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, will require submittal of an application for modification and
approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory

and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
1. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR -23-19) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
2. The Board reviewed the particular facts and circumstances of the proposed design review in terms of
Eagle City Code 8-2A-13(B)(2)(i), and has concluded:
i. The monument signs, building wall sign, and fuel island canopy signs will be harmonious with the
architectural design of the convenience store building (with inclusion of the site specific conditions
of approval required herein) and will not cover not detract from desirable architectural features.
