EAGLE CITY COUNCIL MEETING MINUTES August 12, 2025 1. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance. 2. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m. 3. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME. A quorum is present. 4. ADDITIONS. DELETIONS OR MODIFICATIONS TO THE AGENDA: None 5. PRESENTATION: A. Jackson House Study Presentation: JUB Engineering will present the Jackson House Adaptive Reuse Study for acceptance by the City Council. Director of Long -Range Planning and Projects, Nichoel Baird Spencer provides a quick overview of the Jackson House Adaptive Reuse Study and how the City got to where we are today. Sherry with JUB Engineering provides a summary of the Jackson House Adaptive Reuse Study and provides the top three options. The options are: 1) owned phase approach 2) Public -private lease and sale, and 3) private sale/development with deed restriction. The completed report is available on the City's website. Baird Spencer requests the next step to hold a workshop with the Council. 6. REPORTS: A. Mayor and Council: Gindlesperger states that the Fire Commission met last month to meet 10 new recruits and they updated the Policy Code for the Fire Department. The summer library program was up, and the Friends of the Library received a $5,000 grant that allows them to purchase books to be provided to the Eagle Food Bank to give away. Russell attended the VRT Board meeting. There were contract updates, the funding for elderly has decreased which could affect our seniors, they will be meeting with the Cities and Counties to help increase this. The URA met to approve the FY26 budget, and the public hearing is August 19 at 9 a.m. Russell attended the Avimor meeting, Pam Giess provided a meeting with the Avimor residents to provide the residents with taxing information. May states that ITD is permanently closing three lanes along Eagle Road as a pilot project, ITD is also beginning micro surfacing within Eagle. ACHD had an incident with underground water lines on Floating Feather which is now fixed and re -opened. The section between Palmer and Linder will be closed next week. Attended a Workshop by Tax Commission as well as the Avimor meeting. Attended the Compass executive meeting to discuss legislative matters. Kvamme attended the Parks, Pathways, Recreation Commission meeting and they reviewed the RFP for the Master Plan for Parks and Open Space and felt comfortable with what was presented. The Eagle Sewer District cleaned 15.7 miles of main sewer line, and they passed their 2026 budget and voted to increase connection fees as well as excel aerate the water reuse project by adding additional funding. The City helped kick off the first annual Chamber Bingo Bash. Pike attended numerous staff meetings and discussions with the public who came in to talk. The Open House on the 24t' was a good turnout. B. Department Supervisor: 1. City Treasurer, Financial Reports for the month of June 2025 and for the Quarter Ending June 30, 2025. (LWL) Nichoel Baird Spencer, states that the Capital Plan Open House results were provided on the dais tonight. Council may review and ask questions. There is an Open House for the Crowfoot Range on August 14. Should there be changes to the proposed Capital Plan, a special meeting can be held to discuss potential changes. The City received bid results for the Sports Complex road, and it came back lower than expected. Tomorrow at noon ACHD will be presenting their five-year work plan. C. Eagle Police Department: Chief Travis Ruby introduces Trevor Mangan and provides an overview of his law enforcement career and accomplishments. Ruby reviews monthly statistics and discusses the resources available for mental illness and the crisis hotline. 7. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. A. Claims Against the City. B. Memorial Bench & Donation Request for the Dobkins Family: Request for Council approval for a memorial bench to be located on the Eagle Greenbelt in dedication to David M. Dobkins. (ELZ) C. Rental Agreement Between the City of Eagle and Turf Tank: A Rental Agreement between the City of Eagle and Turf Tank to utilize a line marking machine for City of Eagle sports programs in an amount not to exceed $7,600 annually. (LKB) D. Joint Powers and Participation Agreements Between Idaho Independent Intergovernmental Authority (III -A) and the City of Eagle for Health Benefit Coverage: Staff is seeking Council approval and authorization of the Mayor to execute the Joint Powers Agreement (JPA) and the Participation Agreement. (SNH & LWL) E. National Opioid Settlement Participation: The State of Idaho has reached a new agreement with Purdue Pharma L.P. & Sackler Family participate in the nationwide opioid settlement. Staff is requesting authorization for the Mayor to sign a Subdivision Participation Form for a new National Opioids Settlement. Funds will continue to be reallocated to Central District Health per previous Council action. (TEO & LWL) F. ACHD Cost Share Agreement for Linder Road-SH-44 to Floating Feather: Approval of the Cost Share Agreement between the City of Eagle and ACHD for the City requested improvements (enhanced sidewalks, street trees, median, irrigation, and enhanced landscaping), in amount not to exceed $2,000,000. (NBS) G. Independent Contract Agreement Renewal Between the City of Eagle and Ying Williams: An Independent Contractor Agreement between the City of Eagle and Ying Williams to provide educational and recreational opportunities. Findings of Fact and Conclusions of Law for the Denial of VAC-2024-04 — Vacation to the Final Plat of Eagle Ranch Subdivision No. 2 — Robert DeShazo, represented by Stephanie Hopkins with KM Engineering LLP: Robert DeShazo, represented by KM Engineering LLP, is requesting a vacation of a plat note applicable to Lot 2, Block 3, of the Eagle Ranch Subdivision No. 2 final plat. The applicant requests the word PLAYGROUND be vacated to allow for the development of a future single-family residential dwelling on the property formerly entitled as a common lot. The 0.98-acre lot is located on the south side of E. Ranch Drive, approximately 1,000- feet east of the Eagle Road intersection. (ASG) J. Planning and Zoning Administrator, Bill Vaughan provides a quick overview of the application. Justin Martin, 4035 North Hartley Road, Eagle, Idaho, provides an overview of the application and addresses questions from the Council. Kvamme suggests adding a basketball court or pickle ball court. Martin states that they are willing to include a basketball court or pickle ball court. City Planner, Emily Flaco, states that if Council agrees with Kvamme's request, Council can add condition number 21, to provide a revised landscape plan to include the basketball court and to work with staff. Fiscal Year 2025 - 2026 Budget Hearing: An Ordinance for Fiscal Year 2026 commencing on October 1, 2025, and ending September 30, 2026, appropriating sums of money to defray all necessary expenses and liabilities of the City of Eagle for said Fiscal Year. (LWL) Mayor Pike introduces the item and opens the public hearing. City Treasurer, Lori W. provides an overview of the FY 2025-2026 budget. The total budget for FY 25/26 is $68,002,382. The City plans to utilize the 1% foregone to help cover the deficit for the Police contract. Chief Ruby discusses the changes to the ACSO contract, the contract increases and the level of service study. Mayor Pike opens the public testimony. (LWL) Ordinance No. 953 - FY 26 Annual Appropriations Ordinance Gindlesperger makes a motion to approve item 9A.1, the Ordinance for FY 25-26 in the amount of $68,002,382. Seconded by Kvamme. Curtis Gonzales, 1435 North Willing Place, Eagle, Idaho, is the owner of the property and wanted to be available for questions. Nancy Merrill, 3268 West Skywood Lane, Eagle, Idaho, attended the Planning and Zoning Commission meeting and there was discussion on the strip on the west side of the road to make sure it has direct lot access to the road. Ensure they would be lined up directly and wants to make sure there is not a spike strip. Additionally, water and sewer should be stubbed to the west. Mayor Pike closes the public testimony. Planner Glaspell states that the concerns from Merrill have been addressed. Steve Arnold provides a rebuttal. Council states there are no issues with the shop located on the current lot but comply with the setbacks. Mayor Pike calls a 5-minute recess. Mayor Pike opens the public testimony. Josh Liddel, 1485 Artesian Road, Eagle, Idaho, states the project needs to comply with zoning and the vision of the City. It does not comply with the Comprehensive Plan and hopes that the Council will hold them to the Code and plan. Chris Picken, 480 Picken Lane, Eagle, Idaho, is in support of development. The utilities will be a benefit to the surrounding neighbors and the City. Vaughan states that Mr. Pickens is the property owner and applicant. Macky Sersum, 14450 North Artesian, Eagle, Idaho, states that this area should be protected by the City and the applicant shall comply with the Comprehensive Plan. He requests this application be denied. Elizabeth Olson, 5340 West Overland Road, Meridian, is in support of the development. Emma Isit, 2743 West Peacloud Way, Meridian, Idaho, is in support of the development and this development will allow people to live around the nature and beauty. Shelby Blackburn, 4314 North Pebble Creek Avenue, Meridian, Idaho, is a local realtor and is in favor of the development. There is a need for 1 acre lots. Hayden Blackburn, 4314 North Pebble Creek Avenue, Meridian, Idaho, is in favor of the development. It has been responsibly designed, and this fits what Eagle is looking for. Nancy Merrill, 3268 West Skywood Lane, Eagle, Idaho, is in favor of this application. This reduction of lots came into discussion at a last minute motion. They were never able to discuss it as an applicant. She has had discussion with the State Parks and Recreation Director, that this park remains as a pay and play park. She supports the pathway corridor and references the City Resolution. Traffic will be fine since not all residents will be leaving at the same time. Doug Atwood, 552 North Pebble Beach Way, Eagle, Idaho, owner of Legacy Homes. He states that there is a shortage of custom homes to this magnitude, and this subdivision represents Eagle. Colby Griffin, 8073 South Covey Ridge Lane, Boise, Idaho, is a landscaper in the valley. A development like this helps companies like his and provides better opportunities. He is in support of the development. He'd rather see this development go through rather than 5 years down the road it be more density. Chay Benjamin, 2241 West Whitelaw Drive, Meridian, Idaho, owns a landscape company in the valley. He believes they could provide landscaping that matches the surrounding area. The City is in need of larger lots. He is in support of the development and urges approval. Justin Griffin, 2988 Slay Creek Way, Meridian, Idaho, is a native and would love to live in this development and is in support of this development. Jason Lee, 3072 N Bowknot Lake Avenue, Star, Idaho, is a local landscaper and this development would provide opportunities for him and is in support of the project. This should be two acre lots. This is one of the only areas left for residents wanting large lot. If Council approves the application, approve it with a Development Agreement with a Residential Estates zone. Jason Miller, 2050 Artesian Road, Eagle, Idaho, is not in support of the application. He doesn't understand the math on how they can get 50, 1 acre lots on 45.88-acres. The Council needs to listen to the Eagle residents and not the people who don't reside in Eagle. Todd McCauley, 3151 West State Street, Eagle, Idaho, is associated with the project and is on the PZ Commission but did recuse himself from the PZ public hearing. It is not possible to bring this project in with a septic or a well. City services can be used by surrounding neighbors. Mayor Pike closes the public testimony. Mike Williams provides a rebuttal to the concerns addressed tonight and answers questions from the Council. Mayor Pike closes the public testimony. Planner Durham answers questions from the Council. Russell asks the Council since there are unknowns and not having all of the information to make a decision, would the Council like to defer the application to a future date to gather more information. Gindlesperger has additional concerns that go beyond the flood plain. She is not in support of the application. May concours with Gindlesperger, there are too many outstanding concerns, private streets, main access and gating. Too many concerns to move forward. Kvamme believes it could be a good development for Eagle but at this point there are too many unanswered questions to make sure this is going to be a safe development that this will not flood at some point. Gindlesperger makes a motion to deny item 9D, CPA-2025-04/A-2025-03/RZDA-2025- 04/CUP-2025-02/PPUD-2025-02/PP-2025-03 - Comprehensive Plan Amendment, Annexation, Rezone with a Development Agreement, Conditional Use Permit, Preliminary Planned Unit Development, And A Preliminary Plat for Evian Subdivision. Review of the Request for Proposal (RFP) to Update the Parks, Recreation, and Open Space Plan: Staff will present the draft request for proposal to the Commission prior to taking it to City Council for final direction and action. The focus for the City should be balancing and protecting the interests of the public ownership, recreational access, private landowners, and the environmentally sensitive areas (wetlands, habitat, and floodway) located on the island. The subdivision as designed will not reduce recreational access within the area and reestablish the wetlands and habitat areas located within the property. B. With a large state park and thousands of annual visitors the City should work with IP&R to ensure that the park and surrounding areas are not loved to death. The City should review options that ensure the preservation and enhancement of the sensitive areas by promoting wetlands banking, habitat restoration, and conservation easements instead of "active" open space. The applicant is proposing to enhance the existing wetland areas and restore those habitat areas. The applicant is proposing gated private streets so that the public will not utilize the newly created streets for alternative parking and access to Eagle sland State Park. During a meeting with Idaho Parks and Recreation staff they requested that no access from the residents of the subdivision be allowed. B. Justification for the development agreement; The applicant is requesting a development agreement to define and limit the uses and residential density of the site. The applicant has provided a proposed development agreement inclusive of conditions of development (see attached). C. How does the proposed rezone relate to the comprehensive plan? The comprehensive plan states in 6.9.1(8) that "Due to the sensitive nature of the planning area and the limited availability of utilities and sanitation services, residential uses should be limited to large lot residential (1-2 acre lots) and/or clustered residential lots at the same overall density to preserve areas of special concern." The site will be annexed to the Eagle Sewer District, and sewer infrastructure will be extended to the site by the applicant. Emergency services will be available through the Eagle Police Department and Eagle Fire District. The site abuts Hatchery Road, which has adequate capacity for the development and extends to Linder Road, which is planned to be expanded in the near future.
