The following is a summary of Ordinance No. 947, adopted by the City Council of the City of Eagle, Ada
County, Idaho, on July 22, 2025:
AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, AMENDING TITLE 7
"BUILDING REGULATIONS", CHAPTER 1 "BUILDING CODES", ADDING ARTICLE G
"INTERNATIONAL WILDLAND-URBAN INTERFACE CODE"; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
EAGLE, Ada County, Idaho:
A summary of the principal provisions of Ordinance No. 947 of the City of Eagle, Ada County, Idaho
adopted on July 22, 2025, are as follows:
Section 1: Enacts a new Article G to Title 7, Chapter 1 of the Eagle City Code adopting the 2018
International Wildland-Urban Interface Code (IWUI), including Appendices A and B, with amendments.
Establishes purpose and applicability within the Wildland-Urban Interface Overlay District, adoption of
IWUI provisions, amendments to enforcement, penalties, fire protection plan requirements, sprinkler
system provisions, and vegetation management standards. Provides exemptions for projects with City -
approved Fire Protection Plans prepared by a Certified Wildfire Mitigation Specialist or Fire Protection
Engineer.
Section 2: Provides that this ordinance shall be in full force and effect from and after its passage, approval,
and publication, according to law; provides for severability; repeals conflicting ordinances, resolutions, and
orders.
Section 3: Provides an effective date and for publication by summary.

WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating
under the laws of the State of Idaho; and
WHEREAS, the Mayor and Council have determined that good cause exists for
amending the Eagle City Building Code; and
WHEREAS, to protect the public health, safety, and welfare the Mayor and Council have
deemed it is in the best interest of the City of Eagle to establish standards to mitigate the risk to
life and property from wildland fire exposures within the Wildland-Urban Interface Overlay
District.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho;
Section 1: That Title 7, Chapter 1, Article G, be and is hereby added, to read as follows:

7-1G-1: PURPOSE:
The purpose of this article is to protect the public health, safety, and welfare by establishing
standards to mitigate the risk to life and property from wildland fire exposures, exposures from
adjacent structures and to mitigate structure fires from spreading to wildland fuels.
7-1 G-2: APPLICABILITY:
These regulations shall apply to new subdivisions, new construction, additions, alterations, and
moving or change of use of residential, commercial, or industrial structures within the overlay
district as identified on the Wildland-Urban Interface Overlay District Map, the limits of which
are adopted by Ordinance 947 on file at the office of the City Clerk, or as hereinafter may be
amended. Should any provision within this chapter conflict with any other provision of Eagle
City Code, then the more restrictive shall control.
Notwithstanding the foregoing, any project or development which includes a City -approved Fire
Protection Plan prepared by a Certified Wildfire Mitigation Specialist or stamped by a Fire
Protection Engineer shall be exempt from the regulations in this Article.
7-1G-3: INTERNATIONAL WILDLAND-URBAN INTERFACE CODE ADOPTED:
There is hereby adopted by the city the International Wildland-Urban Interface Code (IWUI),
2018 edition, as published by the International Code Council, as amended by the city herein,
including appendix A and B, for the purpose of prescribing regulations governing the mitigation
of hazard to life and property from the intrusion of fire from wildland exposures, fire from
adjacent structures and prevention of structure fires from spreading to wildland fuels. One copy
of the current edition of the 2018 International Wildland-Urban Interface Code, including
Appendix A and B, are on file in the office of the City Clerk and the same are hereby adopted
and incorporated as fully as if set out at length herein, and from the effective date hereof, the
provisions thereof shall be controlling within the limits of the IWUI overlay district.
7-1G-4: IWUI CODE AMENDMENTS:
IWUI Section 10 1. 1 is amended to read as follows:
10 1. 1 Title. These regulations shall be known as the Wildland- Urban Interface Code of the City
of Eagle, hereinafter referred to as "this code."
IWUI Section 103.1 is amended to read as follows:
103.1 Creation of enforcement agency. The City of Eagle Building Department is hereby created
and the official in charge thereof shall be known as the code official.
IWUI Section 108.5 is amended to read as follows:
108.5 Fire Protection Plan. (Commonly referred to as a Wildfire Safety and Mitigation Plan)

Where required by the code official pursuant to Section 405, a fire protection plan shall be
prepared by a Certified Wildfire Mitigation Specialist or a Fire Protection Engineer and shall be
submitted to the code official for review and approved as a part of the plans required for a
permit. The Fire Protection Plan shall be incorporated into the CC&Rs and development
approvals for subdivisions to ensure adherence to these requirements.
Additionally, the code official may require lots or land that abut or are contiguous to the
Wildland Urban Interface Overlay District to have a Wildfire Safety and Mitigation Plan.
IWUI Section 110.4.7 is amended to read as follows:
110.4.7 Violations and Penalties. Persons who shall violate a provision of this code or shall fail
to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work
in violation of the approved construction documents or directive of the code official, or of a
permit or certificate used under provisions of this code, shall be guilty of a misdemeanor,
punishable as provided in Eagle City Code Section 1-4-1 (A). Each day that a violation continues
after due notice has been served shall be deemed a separate offense.
IWUI Section 114.4 is amended to read as follows:
114.4 Failure to Comply. Any person who shall continue any work after having been served with
a stop work order, except such work as that is directed to perform to remove a violation of unsafe
conditions, shall be guilty of a misdemeanor, punishable as provided in Eagle City Code Section
1-4-1 (A). Each day that a violation continues after due notice has been served shall be deemed a
separate offense.
IWUI Section 602.1 is amended to read as follows:
602.1 General.
An approved automatic sprinkler system may be required to be installed by the code official in
all occupancies in new buildings required to meet the requirements for Class 1 ignition -resistant
construction in Chapter 5. The installation of the automatic sprinkler systems shall be in
accordance with nationally recognized standards.
IWUI Appendix B is amended to read as follows:
Appendix B
B 101.2 Plan content.
Vegetation Management: This section shall describe all actions that will be taken to prevent a
fire from being carried toward or away from the structure(s), and shall include at least the
following information:

1. Methods and timetables for controlling, changing or modifying areas on the property to
create and maintain defensible space. Elements of the plan shall include removal of slash, snags,
vegetation that may grow into overhead electrical lines, other ground fuels, ladder fuels and dead
trees, and the thinning of live trees, landscaping plans, etc.
2. A plan for maintaining the proposed hazardous fuel -reduction and mitigation measures.
3. Maintenance & Cost: The Vegetation Management Plan shall be incorporated into the
CC&Rs and development approval(s) for subdivisions to ensure adherence to these requirements.
The CC&Rs shall also include a funding mechanism for the continued long-term maintenance
and implementation of the Vegetation Management Plan. The cost of plan preparation and
review shall be the responsibility of the landowner.
4. Audits: Each property or development may be subject to an audit every five (5) years to
ensure that they are in compliance with their approved Vegetation Management Plan by the City
of Eagle. The cost of any audits shall be the responsibility of the landowner. If it is determined
by the City that improvements are needed to mitigate wildfire risk, those costs shall be the
responsibility of the landowner. If the landowner does not take action to complete the necessary
improvements within sixty (60) days, the City or a duly authorized representative may complete
the necessary improvements at cost to the landowner.
5. Qualifications: The Vegetation Management Plan shall be prepared by a Certified
Wildfire Mitigation Specialist or Fire Protection Engineer.
6. Changes: Any vegetation management changes after certificate occupancy will be
required to resubmit any changes of any landscape vegetation to the CC&R board to verify
compliance with this code.
Section 2: The provisions of this ordinance are hereby declared to be severable and if any provision
of this act or the application of such provision to any person or circumstance is declared invalid
for any reason, such declaration shall not affect the validity of remaining portions of this ordinance.
Section 3: This ordinance shall take effect and be in force from and after its passage, approval, and
publication as required by law. In lieu of publication of the entire ordinance, a summary thereof in
compliance with Section 50-901A, Idaho Code, may be published.
