Minutes - 2025 - City Council - 06/10/2025 - RegularEAGLE CITY COUNCIL MEETING MINUTES June 10, 2025 1. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance. 2. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m. 3. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME. A quorum is present. 4. ADDITIONS. DELETIONS OR MODIFICATIONS TO THE AGENDA: None. 5. PROCLAMATION: A. Proclamation of Elder Abuse Awareness Month: A Proclamation for the City of Eagle declaring June 2025 as Elder Abuse Awareness Month in the City of Eagle, Idaho. (BKP) Mayor Pike reads the Proclamation of Elder Abuse Awareness Month and presents the Proclamation to representatives of the Ada County Victim Service Center. 6. REPORTS: A. Mayor and Council: Gindlesperger states that the Family Tie Dye Day is this Thursday. The Eagle Arts Commission is sponsoring a Christmas in July wreath competition. Russell reports on Urban Renewal Agency District meeting. A strategic plan for fiscal 2025-2026 was adopted and the projects that were prioritized within the plan. A Special Board Meeting for Valley Regional Transit was called to review a bidding protest. Kvamme attended the Sewer District Meeting. They are currently operating within budget and are in line with projections. Mayor Pike states that a podcast was recorded with COMPASS to provide information on what the agency does in the Valley and in Eagle specifically. This is the twelfth taxing district podcast. The Open House for the Jackson House reuse study is tomorrow at the Community Hall. The public is encouraged to attend and provide comments on the options. B. Department Supervisor: City Clerk, Tracy Osborn notes that 832 business license renewal reminders were sent out, along with 82 alcohol license renewal notices. These will all be processed by the end of June by our one and one-half personnel in the Clerk -Treasurer's Office. C. Eagle Police Department: Deputy Justin Elliot introduces Joe Wood the Community Service officer and reviews his law enforcement experience. Deputy Elliot reviews local law enforcement activities in the City of Eagle. D. City Attorney: No report. 7. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. The expiration date listed was erroneously identified as August of 2025. This action corrects the expiration date of Mr. McComber's Seat 4 term to be August of 2026. (BKP) E. Memorial Bench & Donation Request for the Cornforth Family: Request for Council approval for a memorial bench to be located on the Eagle Greenbelt in dedication to Fred Cornforth. (ELZ) F. Live Performance Agreement Between the City of Eagle and Scott Sweet: A Live Performance Agreement between the City of Eagle and Scott Sweet to perform during Harvest Festival. Compensation shall be at a rate of $500.00 for specified event. (JDH) G. Live Performance Agreement Between the City of Eagle and SpeakWrite LLC: A Live Performance Agreement between the City of Eagle and SpeakWrite LLC to perform during Harvest Festival. Compensation shall be at a rate of $700.00 for specified event. (JDH) H. Independent Contract Agreement Between the City of Eagle and Carrie Walker: An Independent Contract Agreement between the City of Eagle and Carrie Walker to provide educational and recreational opportunities. Senior Center Recreation Coordinator, Sean Tamburrino and Communication/Marketing Specialist, Laura Williams review the logo options. RZDA-2025-02/CUP-2025-01/PPUD-2025-01/PP-2025-01 - Rezone with a Development Agreement, Conditional Use Permit, Preliminary Plat, and Preliminary Planned Unit Development for Whitehurst Village Subdivision - Evans Development LLC: Evans Development LLC, represented by Becky McKay with Engineering Solutions, is requesting rezone from A-R (Agricultural -Rural) to R-3-DA-P (Residential with a development agreement — PUD) and R-1 (Residential), conditional use permit, preliminary development plan, and preliminary plat approvals for Whitehurst Village Subdivision, a 16-lot (12-buildable [I -existing], 4-common) residential subdivision. The applicant is requesting some waivers as the site has been a challenge due to the infill nature of the project. City Planner, Katelyn Davison, reviews the staff report and items for special consideration. Mayor Pike opens public testimony. Mark Hamilton, 3660 W. Flint Drive Eagle, Idaho, is an adjacent property owner. Mr. Hamilton has been working with Zach Evans during their development of their proposed development. It has a very amiable processes and appreciates being able to work with the Developer to discuss matters of concern. He is in support of the project. They would like to maintain their privacy; thus, a solid fence is being requested. Sky Hamilton, 3660 W. Flint Drive, Eagle, Idaho. She also is in support of the project. They have worked hard to upgrade their property and greatly value their privacy. They love the Eagle Community and have enjoyed the collaboration with the developer. The developer actually took their input into consideration, and it was appreciated. Mayor Pike closes public testimony. Kvamme inquires if the proposed composite fencing has been reviewed with the homeowners in the large lot. McKay confirms that they have discussed and reviewed the proposed composite fencing. Discussion to confirm that the ACHD turning radius has been approved. Kvamme believes the waiver requests are reasonable and likes that the lots. General discussion. Gindlesperger moves to approve item 9A RZDA-2025-02/CUP-2025-01/PPUD-2025-01/PP- 2025-01- Rezone with a Development Agreement, Conditional Use Permit, Preliminary Plat, and Preliminary Planned Unit Development for Whitehurst Village Subdivision - Evans Development LLC with the standard conditions and the site specific conditions of approval from Planning and Zoning. RZ-2008-12 MOD5 — Modification to Rezone with Development Agreement — Restored Community Church: Restored Community Church, represented by Bill Stovall, is requesting a modification to the rezone with development agreement associated with Restored Community Church to strike the requirement for the temporary building to be removed and to add "portable classroom" as a permitted use at the site. The 5.52-acre site is located approximately 1,055 feet east of the intersection of North Park Lane and West Floating Feather Road at 3633 West Floating Feather Road. (KRD) Mayor Pike introduces the item and opens the public hearing. Matt Moffett with Restored Church, 3633 Floating Feather Road, Eagle, Idaho, reviews the application. City Planner, Katelyn Davison, reviews the staff report and items for special consideration. Mayor Pike opens public testimony. No one chooses to speak. Mayor Pike closes public testimony and the public hearing. Kvamme would prefer that this not become permanent approval, a timeline that would give the church a number of years to come up with a more permanent solution than a modular building. Based on this concern he will not support the application. Russell moves to approve item 913 RZ-2008-12 MOD5 — Modification to Rezone with Development Agreement — Restored Community Church to amend the development agreement 3.4 and 3.5 as presented by staff. Seconded by Gindlesperger. THREE AYE; ONE NAY (KVAMME). MOTION CARRIES. 9. NEW BUSINESS: A. ACTION ITEM: DR-2024-29 - 269 East Idaho Mixed Use Buildine - Michelle Webb: Michelle Webb, represented by Julie Benintendi with BRS Architects, is requesting design review approval for a 6,910-square foot, three-story, mixed use building (four residential units and two office [business and professional]/retail) units). The 0.16-acre site is located on the south side of East Idaho Street approximately 78-feet west of the intersection of East Idaho Street and North 2nd Street at 269 East Idaho Street. (ERF) Mayor Pike introduces the item. City Planner, Emily Falco states that this item is being heard as new business due to a recommended denial by the Design Review Board. Falco states that both she and the applicant are available to provide presentations should Council so desire. Planner Falco reviews the staff report, and the reasons cited by the Design Review Board's denial. Mark Anderson with BRS Architects, 269 Idaho Street, representing Julie Benintendi. Mr. Anderson reviews the application process and timeline. Reviews what he believes are misunderstandings and errors made by the Design Review Board during their review of the application. Mr. Anderson reviews the precedents set by previous approval of projects. Discussion. Russell is in support of the denial. The information provided by the applicant did not change her mind on the matter. City Planner, Emily Falco states that with the denial of item 9A and it is associated with this Master Sign Plan, the Council may wish to make a motion to deny this as well as it becomes somewhat a moot point. ACTION ITEM: FP-2024-06-EXT1 - Final Plat Extension of Time for Stillwater Subdivision No. 2: Stillwater Development Partners, represented by KM Engineering, LLP, is requesting a six (6) month extension of time for the final plat for Stillwater Subdivision No. 2, a 10-lot (8-buildable, 2-common) commercial subdivision. The 5.49-acre site is located on the southwest corner of South Urban Gate Avenue and State Highway 44. (ASG) Mayor Pike introduces the item. Kory Elithorp, with Stillwater Development, 116 Carbon Ribet, Mr. Elithorp is requesting a 6- month extension for the final plat. Mr. Elithorp reviews the status of the project and tenants lined up for the project. Discussion regarding the mounds of dirt, the connex units and the requested sidewalk to be bonded for and installed at a later date. Discussion of timeline. Kvamme would be willing for a five -month extension, with a condition that that cargo containers be relocated within 30 days, the sidewalk could be bonded for. May concurs. Kvamme moves to approve new business item C FP-2024-06-EXT1 - Final Plat Extension of Time for Stillwater Subdivision No. 2 with the following conditions that the cargo containers be either disposed of or relocated within the first 30 days of the extension. The extension shall be for five months, not six months, and that we waive requirement to have the sidewalk completed until the 2"d commercial building due to construction concerns. Gindlesberger moves to approve DR-2025-10 - Office (Business and Professional) and Personal Improvement Building within Stillwater Subdivision - CrossFit E3. Seconded by Russell. ALL AYE ... MOTION CARRIES. E. ACTION ITEM. Crowfoot Ranze Inc. Presentation. (BKP) Mayor Pike introduces the item. Bill Godfrey President of Crowfoot Range. Mr. Godfrey provides an overview of the Crowfoot Range, from its inception to current status. Crowfoot is a 501(c)(3) which has support from multiple law enforcement agencies. Provides an overview of the Crowfoot Board and Management, all of whom have multiple decades of law enforcement, military or management experience. Reviews the legal challenges which they have faced and overcome. Discusses the next steps forward and presents a proposal to the City to partner with the range that would allow all Eagle residents a $50 reduction annual range membership dues, the same as offered to Avimor membership dues. Discussion amongst Council and representatives from Crowfoot Range. Russell expresses her concern regarding roadway safety when accessing the range location off of Pearl. Gindlesperger seeks clarification regarding range management. Crowfoot Range is a 501(c)(3), discussion regarding funding and current secured donations for range construction. May thanks them for the presentation. The proposal appeals to her as the liability would not lie with the City, and the range would also meet a need of those in the Eagle Community that desire a shooting range. Kvamme feels it is much better to have private sector operate something rather than government. Government should be involved in something that is too costly or too risky for the private sector. This would alleviate the responsibility of running, operating and monitoring the range from the City. It is a timely proposal due to the challenges the City is currently facing at the site the City had been pursuing a shooting range. He believes the timing is correct. Russell has questions regarding other instances the City has provided sponsorships for non -profits, she is also concerned with the safety of the location. She believes that public input sought prior to moving forward. Gindlesperger believes that the request should be incorporated into the Capital Plan for weighing against other projects so that the public could weigh in on the item. May doesn't feel that it is either/or from the shooting park the City has been pursing or this proposal by Crowfoot but that this request could meet an immediate need. Gindlesperger finds that an interesting perspective, however, would like this to go into the Capital Plan and seek public input prior to the Council making a decision. Mayor Pike discusses access locations for the Crowfoot Range site, as well as traffic safety matters. Mayor Pike would like additional information as to previous sponsorships that the City may have entered into and the legalities associated with the same. City Attorney Villages discusses the City's ability to become a sponsorship or make monetary donation. General discussion. Kvamme concurs with Council Member May that this provides an operational shooting facility in a reasonable time, while not necessarily abandoning the City's proposed range. The request from Crowfoot is not small, however compared to a city built, owned and operated facility it is significantly smaller than those ongoing costs. Russell would still like to have community outreach for this. Gindlesperger would still like the amount placed in the capital plan. Placement on a Council agenda is requested to be done in the near future. Gindlesperger moves to approve action item 10 Crowfoot Range Inc. Presentation for a public hearing on July 8' with a presentation by Nichoel Baird Spencer. Seconded by May. Discussion. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are excluded may be held, but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two- thirds (2/3) vote of the governing body.
