Minutes - 2025 - City Council - 05/27/2025 - RegularEAGLE CITY COUNCIL MEETING MINUTES May 27, 2025 1 PLEDGE OF ALLEGIANCE: 2. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:37 p.m. 3. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME. Absent: A quorum is present. 4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA 5. PRESENTATION: A. Eagle Sewer District: General Manager, Neil Jenkins, with the Eagle Sewer District will Provide an Update on the Water Reuse Project. Mayor Pike introduces Neil Jenkins, General Manager with Eagle Sewer District. Mr Jenkins provides an overview of the services and service area of the Eagle Sewer District. Reviews the Water Reuse Project. General discussion. 6. REPORTS: A. Mayor and Council: Gindlesperger reports on the Historic Preservation Commission meeting. She notes that that the adaptive reuse study is approximately half completed. The Downtown Historic survey phase one has been completed. There is a local group of metal detector enthusiasts who are interested in walking in Avimor to see if they can locate indicators of the Oregon Trail. Reports on the Eagle Fire District meeting. May attended the Eagle Police Team and Tax Commission Workshop meetings. Reports that ACHD has begun their chip sealing season. The ACHD website has a map showing areas they are targeting and is an excellent source of information. Russell reports on the Eagle Urban Renewal Agency. Due to recent state legislation, the Eagle Fire District was able to request removal from the Agency District. The Urban Renewal Agency denied the request. Had they allowed to withdraw from the Urban Renewal District, it would have reduced URA revenue drastically. Kvamme also attended both the Tax Commission Meeting, and the Eagle Polic Department Team meeting. He compliments Chief Ruby on his leadefship of the Eagle Deputies. Kvamme also provides kudos to Eagle Sewer District Niel Jenkins and his staff for their expertise and professionalism. Mayor Pike attended the Tax Commission Workshop. He also mentions that there is a Podcast on the City's website with the former City Treasurer that provides great information on where their tax dollars go. Mayor was able to celebrate a residents 100' birthday, and it was a special time to be able to honor her. Provides a brief statement honoring members of the US Military that gave the ultimate sacrifice for their country. B. Department Supervisor: 1. City Treasurer, Financial Reports for the month of April 2025. (LL) Zoning Administrator, Bill Vaughan, provides a status update on the Parks, Trails and Open Space Request for Proposal. States that with minor edits the plan will be provided to PPRC for comment and recommendations to Council, we anticipate it going before them at either their June or July meeting. Following that it will be presented to Council for final approval before release. City Clerk Tracy Osborn gives a brief update on the tree rebate program. Also notes that Deputy Clerk Holly Csencsits is finalizing the City's Title VI plan with ITD. Upon approval it will be implemented and staff training city-wide will take place. Everyone is grateful for the investment in the department's staff. C. Eagle Police Department: Chief Ruby introduces Deputy Fitzpatrick and reviews his law enforcement experience and the great asset he is to the Eagle Team. Kvamme, May and Mayor Pike express their gratitude to Deputy Fitzpatrick for his service to the City. Chief Ruby reviews recent law enforcement activities in the City of Eagle. 7. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. Independent Contract Agreement Between the City of Eagle and Valerie Schwers: An Independent Contract Agreement between the City of Eagle and Valerie Schwers to provide educational and recreational opportunities. Compensation shall be at a rate of 70% of the total revenue generated by registration. (LKB) F. Independent Contract Agreement Between the City of Eagle and Karla Thoegersen dba Amazing Athletes of Boise: An Independent Contract Agreement between the City of Eagle and Karla Thoegersen dba Amazing Athletes of Boise to provide educational and recreational services. Second Amendment to Independent Contractor Agreement Between the City of Eagle and Fred Fritchman: Second Amendment to Independent Contractor Agreement between the City of Eagle and Fred Fritchman to include a new completion date of December 31, 2025, to construct the Founding Families case exhibit.(ACD) H. Resolution No. 25-10 - Comprehensive Plan Text Amendment for Chapter 4: Utilities, Facilities, and Services: A Resolution of the City of Eagle to amend Chapter 4: Utilities, Facilities, and Services of the Eagle Comprehensive Plan for the addition of Chapter 4.11 Ada County Services. (KRD) 1. Public Art Program "Christmas in July" Wreath Design Competition: The Eagle Arts Advisory Committee is seeking Council approval to proceed with a call for artists for "Christmas in July" a wreath design display and competition, and to authorize funding for the prize money in an amount not to exceed $600.00. (BLA) J. Findings of Fact and Conclusions of Law for the Approval of A-2025-01/RZDA-2025-01 - Annexation and Rezone from RUT to BP-DA and a Rezone from A-R and BP-P to BP-DA - LZL Ventures, LLC: LZL Ventures, LLC/Chad Longson, represented by Stephanie Hopkins with KM Engineering, LLP, are requesting annexation and rezone from RUT (Rural -Urban Transition - Ada County Designation) to BP-DA (Business Park with a Development Agreement) and a rezone from A-R (Agricultural -Residential) and BP-P (Business Park with a PUD) to BP-DA (Business Park with a Development Agreement) in lieu of a conditional use permit for an Indoor Storage Facility for Peak Condo Storage. The 65.52-acre site is located at the southeast corner of West Beacon Light Road and North Palmer Lane between West Beacon Light Road and West Floating Feather Road at 6397 West Beacon Light Road and 6868 West Floating Feather Road. (ERF) M. FP-2025-01 — Final Plat for Terra View Subdivision No. 5 — Ardurra: Dave Sterling with Ardurra is requesting final plat approval for Terra View Subdivision No. 5, a 50-lot(42-buildable, 8-common) residential development. The 27.1-acre site is located at the northeast corner of State Highway 16 and West Beacon Light Road. (KRD) N. FPUD-2025-01/FP-2025-02 — Final Planned Unit Development and Final Plat for Torrente Secco Subdivision No. 2 — Toll Southwest, LLC: Toll Southwest, LLC, represented by Becky McKay with Engineering Solutions, LLP, is requesting final planned unit development and final plat approval for Torrente Secco Subdivision No. 2, a 64-lot (49-buildable, 15-common) residential development. The 19.83-acre site is located at the northeast corner of North Palmer Lane and West Floating Feather Road at 6868 West Floating Feather Road. (KRD) Mayor Pike introduces the item. DR-2025-17 - Childcare Facility for Avimor Academy - Dillon Ludlow: Dillon Ludlow, represented by Erik Knudsen with Hillside Architecture, is requesting design review approval of a 9,900-square foot daycare facility for Avimor Academy. The 0.67-acre site is located on the southwest corner of North McLeod Way and West Avimor Drive at 18551 North McLeod Way (Lot 1, Block 11, Avimor Subdivision No. 1). (BAW) Mayor Pike introduces the item. Kvamme has questions about the floor plan, and expresses concern with the food preparation and food safety based on the proposed plan. The floor plan shows access to the laundry room, which would require dirty laundry being moved through a food preparation area. City Planner III, Barb Williams displays the floor plan in question, and notes that the applicant is in attendance should Council wish to bring forward to address concerns expressed. Erik Knudsen with Hillside Architecture, states that the floor plan that is proposed was utilized in another facility that is currently in use in Meridian and there hasn't been a problem. However, a door could be added for access. Kvamme states that he understands the floor plan is not what is being acted on tonight, but asks that his concerns be considered when building plans come forward. PP-2024-08 - Preliminary Plat for Valnova Estates Subdivision No. 2 - Clyde Capital Group: Clyde Capital Group, represented by Kendall Hancey from Horrocks, is requesting preliminary plat approval for Valnova Estates Subdivision No. 2, a re -subdivision of Lot 29, Block 1, Spring Valley Subdivision No. 1, a 154-lot (139-residential, 15-common) subdivision. The 121.44-acre site is generally located on the north side of Aerie Way approximately 1/4-mile west of the intersection of Big Gulch Parkway and the future Linder Road extension within PUMP No. 1 of the Valnova development. (HSD) Mayor Pike introduces the item and opens the public hearing. Kendall Hancey with Horrocks 2775 W Navigator Meridian Idaho, representing Clyde Capital Group, reviews the preliminary plat application. City Planner Hailey Durham reviews the staff report and items for consideration. Staff provides site specific condition #6 proposed language. The applicant shall place a note on the face of the final plat that states, "The easement for the public access trail to be built on Lot 1, Block 2; Lots 20, 21 and 39, Block 3; and Lot 30 Blot 4, shall be recorded upon completion of construction and submitted to the City." Kvamme questions why the applicant did not want to install a landscape island as noted. Mayor Pike opens testimony. No one chooses to speak. Mayor Pike closes testimony. Nick Weaver 1045 S. Arbor Island Way Eagle, Idaho. States that the topography made the installation and ongoing maintenance challenging and thus the applicant has requested remove the requirement. Discussion regarding the timing of the creation of a conservation advisory committee that will manage and implement the invasive and noxious weed program. Weaver estimates that the end of summer will be a realistic timeline. They have reached out a couple of groups that assist developers set up these conservation committees. One of which is a former Council Member with the City and have been in discussion with the needs of the development. Discussion. Russell moves to approve agenda item 8A PP-2024-08 - Preliminary Plat for Valnova Estates Subdivision No. 2 - with all the site specific and standard conditions as recommended by Planning and Zoning with the exception of revising condition 6 as show in the staff presentation. Seconded by May. ALL AYE ... MOTION CARRIES. 9. NEW BUSINESS: A. ACTION ITEM.- Staff is seeking Council approval of four images to be utilized for the City's penny pressing machine that will be located in the foyer area of the museum. (ALD) Mayor Pike introduces the item. Museum Director, Alana Dunn reviews the project to purchase a penny press machine for the museum and presents images for consideration. May states she likes the logos, the museum and the gazebo. Russell states she too likes the museum and gazebo, and perhaps the pedestrian bridge might be considered Gindlesperger does not feel that the gazebo would translate well for the penny press. She also likes the city logo. Kvamme prefers the arch design and museum. General discussion. Dunn will ask that the vendor mockup examples and bring them back for final review. We have been asked to choose 4 engravings. The company I am working with takes the photos we would send, and photoshop out the background focusing on the main building or sculpture. She stated she can hand engrave what is needed to finish the template. So, the photos you will see are not going to be the exact picture pressed into the penny.
