Minutes - 2025 - City Council - 04/28/2025 - RegularEAGLE CITY COUNCIL MEETING MINUTES April 28, 2025 1. CALL TO ORDER: Mayor Pike calls the meeting to order at 3:00 p.m. 2. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance. Russell makes a motion to move section 6 above Consent Agenda. Seconded by Gindlesperger. ALL AYE ... MOTION CARRIES. 6. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are excluded may be held, but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two- thirds (2/3) vote of the governing body. An executive session may be held: (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. ACTIONITEM.• Action Regarding Pending/Threatened Litigation. No action taken. 4. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. Temporary Water Delivery Agreement: An agreement between the City of Eagle and Todd and Anita Simonson for the temporary water service to property located at 1691 N. Eagle Road until the Simonson's construct a new well for water delivery to the property. (KA) Gindlesperger moves to approve Consent Agenda items A-B. Seconded by Kvamme. ACTION ITEM: Approval of the Eagle Fun Days Logo: Staff is seeking Council approval for the Eagle Fun Days logo that will be utilized moving forward for future Eagle Fun Days. (JDH) This item was continued from the April 22, 2025 meeting. Special Events Coordinator, Josh Herker provides an overview of the updated Eagle Fun Days logo. Gindlesperger makes a motion to approve Option B as modified. Seconded by Kvamme. ALL AYE ... MOTION CARRIES. B. ACTION ITEM.- City Fiber Optic Infrastructure: Staff will provide the history and current status of the fiber optic infrastructure and requests Council direction for a path moving forward. (ELZ) Public Works Director, Eric Ziegenfuss provides the history, current status and options to move forward with the fiber optic infrastructure. General discussion amongst the Council regarding the different options. Kvamme makes a motion on Unfinished Business Action Item B that the City fiber infrastructure, the City move forward with the public private partnership with an open access approach as we move forward. Seconded by May. KVAMME, AYE; RUSSELL, AYE; MAY, AYE; GINDLESPERGER, AYE. ALL AYE ... MOTION CARRIES. C. ACTIONITEM.• Friendship Park Play Structure Replacement Color Selection. (ELZ) Public Works Director, Eric Ziegenfuss provides an update on the Friendship Park play Structure replacement color selection. General discussion amongst the Council regarding play structure colors. May makes a motion to select the Spring Meadow color sample for the play equipment along with the jungle color rubber mulch.
