MEETING MINUTES
April 8, 2025
1. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME.
A quorum is present.
3. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance.
4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA: None.
5. APPOINTMENT:
A. Appointment of City Treasurer: In accordance with Idaho State Code 50-204 and Eagle City
Code 1-6-1(A) Mayor Pike is requesting Council confirmation of appointment of Lori Waldemer
Lord as City Treasurer, effective April 14, 2025. The Oath of Office will be administered directly
after the motion. (BKP)

Gindlesperger moves to confirm the appointment of Lori Waldemer Lord as City Treasurer -

6. PROCLAMATIONS:
A. Child Abuse Prevention Month Proclamation: A proclamation for the City of Eagle
declaring April 2025 as Child Abuse Prevention Month in the City of Eagle, Idaho. (BKP)

B. Sexual Assault Awareness Month Proclamation: A proclamation for the City of Eagle
declaring April 2025 as Sexual Assault Awareness Month in the City of Eagle, Idaho. (BKP)
May reads the proclamation.
The proclamations are presented to representatives from Ada County Victim Services Center.
Gindlesperger moves to approve proclamations 6A Child Abuse Prevention Month and 611

7. REPORTS:
A. Mayor and Council:
May attended the BVEP Summit in Boise. She also met with legislators as a session wrap up.
COMPASS Executive committee meeting today.
Russell attended Valley Regional Transit meeting where they addressed contracts and bylaws.
Reports on the Beyond Access program.
Kvamme states that he has been participating in the PPRC interviews this week to fill a vacancy.
Mayor Pike has met with the Chamber of Commerce and how to better part with them in the future.
There was a Town Hall meeting last week, as well as a quarterly staff meeting. In addition, he has
met with several citizens on a variety of issues.

B. Department Supervisor: No reports.
1. City Treasurer, Financial Reports for February 2025. (KR/LL)
C. Eagle Police Department:
Chief Ruby introduces Deputy Derrek Thewer and reviews his work -related experience. Chief
Ruby introduces Sgt. Hessing who is being promoted to Lt. at the end of the week. He has served
the Eagle community for the last seven months. Sg. Savage will be replacing Sgt. Hessing.
D. Conservation Advisory Committee Presentation: The Conservation Advisory Committee
representative will present the Committee's recommendations for short-term and long-term goals
and objectives. (CK)
Mayor Pike introduces the item.
Charlie Baun, Chairman of the Conservation Advisory Committee (CAC), reviews their short-term
and long-term goals and objectives. They have split the projects to address both short-term and
long-term planning. Mr. Baun makes himself available to address questions. Kvamme inquires if
the Boise Foothills guide would be helpful for residents to be able to identify noxious weed
components. Baun confirms and states that there are a variety reporting options, one of which is an
App called Survey 123 that can be used. They are recommending expanding education and outreach
when it comes to noxious weeds. The Committee is recommending a couple of outreach options
utilizing the Boise Foothills guide. Baun discusses and reviews the other recommended projects.
Short term goals include Wildlife Signs, adoption of a WUI ordinance, Boise Foothills Plant Guide,
Invasive and Noxious Weed Education, Small Ag and Soils. Long-term goals include Charlie
Woods Park with several options, and Small Ag Preservation Programs. General discussion.
Kvamme feels that the Boise Foothills planning guide should be purchased immediately so we can
start getting them into the hands of the public. The Committee recommended 500. The council
concurs with the purchase of the guides. It is mentioned about having the booklets available at a
Saturday Market. Mayor Pike suggests collaborating on a podcast to get the word out.
8. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED
ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a Councilmember,
member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a
sequence determined by the City Council. Any item on the Consent Agenda which contains written
Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or
Design Review Board shall be adopted as part of the City Council's Consent Agenda approval
motion unless specifically stated otherwise.

H. Voluntary Reallocation of Idaho Opioid Settlement Intrastate Allocation to Central
District Health: The City of Eagle voluntarily reallocates the Opioid Settlement Allocation to
Central District Health. All funds will be utilized in accordance with criteria identified in the

I. Heritage Park Engineer Scope of Work Change: Changes to the scope of work with HECO
Engineer for the Engineering, Design and Bidding Services and an increase to not exceed $24,
250.00 to address park design changes as directed by Council on March 18, 2025. (NBS)
J. Findings of Fact and Conclusions of Law for the Approval of PP-2024-03 - Preliminary
Plat for Avimor Mcleod Subdivision No. 1 - Avimor Development, LLC: Avimor
Development, LLC, represented by Brad Pfannmuller, is requesting preliminary plat approval for
McLeod Subdivision No.l, a 375-lot (337-residential, 11-highway mixed use, 27-common)
subdivision. Portions of the 313.00-acre site are located within Ada County, Boise County, and

Deputy Zoning Administrator, Daniel Miller reviews the change of scope to reflect the changes
requested by the Council. Discussion for clarification regarding the additional trees along State
Street as well as the accessibility to the restroom facility.

Mayor Pike introduces the item.
Kvamme states that he has taken to heart the concerns of residents regarding the nuisance of rats
and thus is looking at development trash facilities with a critical eye. The development before
Council has a single trash enclosure that will serve14 multi -tenant spaces. Based on the size of the
development he does not believe it is sufficient. In addition, Kvamme makes inquiries regarding
the number of parking spaces. Kvamme also does not feel that vinyl fencing is adequate fencing
and believes a higher grade of fencing should be required.
City Planner, Emily Falco reviews the trash enclosure locations. The Design Review Board also
expressed concerns with the ability of the trash enclosures to accommodate the development. The
Developer felt that it would adequately meet their needs. Falco states Council may require different
fencing material if they wish.

Kvamme would like delay this item to another meeting and request more specific information
on the trash enclosure square footage allocation and also more specifics as to what the fencing

9. PUBLIC HEARINGS:
A. CU-10-23 -Conditional Use Permit for Industry (Custom and Limited) for 44 Iron Design
- Baserri, LLC: Baserri, LLC, represented by Walter Lindgren with Lindgren: Labrie Architecture
is requesting conditional use permit approval for "Industrial, Custom and Limited" for uses
including ornamental steel fabrication (44 Iron Design), cabinet shop, sign shop, upholstery shop,
and woodworking shop, and for waivers of Eagle City Code Title 8 regarding sidewalk installation,
driveway improvements, and landscape requirements. The 0.3-acre site is located on the north side
of East State Street approximately 232-feet west of the intersection of South Parkinson Street and
East State Street at 2372 East State Street. (HSD) This item was continued from the March 11, 2025
meeting.
Mayor Pike introduces the item and opens the public hearing.
Walter Lindgren, with Lindgren Labrie Architecture, 247 North Eagle Road, Eagle Idaho,
representing Baserri LLC, reviews the application.
Kevin Mahew, 2372 E. State Street Eagle, Idaho. Mr. Mahew is a long-term Eagle resident, a
graduate from Eagle High, he coached at Eagle High. His business specializes in steel fabrication
throughout the valley. Mr. Mahew hires an outside consultant to do weekly safety inspections, and
they also have several OSHA certified employees.
Lindren addresses trash collection plan.
Planner II, Hailey Durham reviews the staff report and items for special consideration.
Mayor Pike opens the public testimony.
Jeff Haas, 537 Mango Drive, Eagle, Idaho. He thinks it is a great use of the site. There are a number
of functions that would be contained within that might be impactful from a noise point of view.
Council may want to address operating hours as it does abut a residential area, in order to mitigate
the impact on neighbors.
Lindgren states that a new steel fence line is being proposed to be installed. Discussion regarding
sidewalk installation and potential partnership with the Urban Renewal Agency.
Discussion. Mayor Pike wishes to confirm that the Fire District has reviewed the types of
occupancies to ensure safety.
Mayor Pike closes the public testimony and hearing.
Kvamme is very comfortable with the safety plan that is in place and is in support of the iron
fencing. He would like the requirement of the sidewalk to remain. Russell is in agreement that the
waiver is not granted for the sidewalk but everything else is acceptable. May concurs it is a nice
facility and much needed. Discussion.
Durham provides site specific #9 language options for Council consideration. 9. The applicant shall
install a curb, gutter, and five (5) foot wide sidewalk along the frontage of East State Street and
East Dunyon Street adjacent to the subject property, in accordance with Eagle City Code Sections
9-4-1-3 and 9-4-1-6. The sidewalks shall be installed prior to the issuance of a Certificate of
Occupancy.

Russell moves to approve agenda item 9A with the following site specific #9 amended as stated
by Staff. Seconded by Kvamme. Discussion. Durham suggests language for site specific
condition # 1. Industry (Custom), specifically 44 Iron Design (ornamental steel fabrication), is the
only approved use with this conditional use permit. Any use change shall require a modification to
this conditional use permit in accordance with Eagle City Code Section 8-7-3-5(H). Russell
amends her motion to modify site specific condition #1 as stated by Staff. Seconded by

B. VAC-2024-04 — Vacation to the final plat of Eagle Ranch Subdivision No. 2 — Robert
DeShazo. Robert DeShazo, represented by Stephanie Hopkins with KM Engineering LLP: Robert
DeShazo, represented by KM Engineering LLP, is requesting a vacation of a plat note applicable
to Lot 2, Block 3, of the Eagle Ranch Subdivision No. 2 final plat. The applicant requests the word
PLAYGROUND be vacated to allow for the development of a future single-family residential
dwelling on the property formerly entitled as a common lot. The 0.98-acre lot is located on the
south side of E. Ranch Drive, approximately 1,000-feet east of the Eagle Road intersection. (ASG)
Mayor Pike introduces the item and opens the public hearing.
Kevin McCarthy with KM Engineering LLP, representing Robert DeShazo reviews the request for
vacation. Mr. McCarthy reviews the history of the lot. Mr. DeShazo has owned the lot since 1992.
They are asking that the word playground be vacated from the plat. This application was brought
forward in 2024 at which time it was approved by the Planning and Zoning Commission and
subsequently denied by the Council. The applicant has come forward to address development
concerns expressed by the neighbors. In response the applicant is proposing conditions in an
attempt to address them, including that the property would be limited to one single family
residential dwelling.
Planner I, Andrew Glaspell reviews the staff report and items for special considerations.
Mayor Pike opens public testimony.
Toni DeShazo, begins testimony, however, is asked to speak at the end as she is the applicant.
Ron DeRoost, 291 North Yellow Pine Place, Eagle, Idaho. Mr. DeRoost is speaking on behalf of
a number of residents within Eagle Ranch Subdivision. Mr. DeRoost reviews the timeline for the
property in question. (attached) Though a neighborhood meeting was held, the neighbors continued
to strongly oppose the change to the playground lot. Though undeveloped, the neighbors have used
this lot for their kids to play on. It has been used for a community garden, a homemade bmx track
and the neighbors have enjoyed building snowmen on it during the winter. No trespassing signs
have been erected since the denial in 2024. The lot has been used as a dumping area, and a code
enforcement complaint has been filed. The owner has not paid property taxes on the lot in a number
of years due to the designation of the lot as a playground. They implore the city to not reduce the
open space. While Friendship and OK Park are nearby, they are not conducive to flat play activities.
The neighbors have recently formed the Eagle Ranch Neighborhood Association. As the lot has
been used as a playground for 40 plus years and it should continue to be utilized as such. They
respectfully request the application be denied and that the no trespassing signs be removed.
Amy Haskin, 266 E. Mango Drive, Eagle, Idaho. Ms. Haskins property abuts the fence line of the
property in question. Her family has enjoyed the community garden and the open play area. She
would ask that the no trespassing signs be removed and that the space be used for open play. Ms.
Haskin reads a statement from her daughter, Zoey Haskins, in which she requests the lot remain
designated as a playground.

Ethan Cornell, 736 North Beachwood Drive, Eagle, Idaho. The development was originally
approved in the 1970's, the concern is the size of home that could be allowed if the vacation is
allowed. The existing homes were built in the 1980's and if an exceeding large home is allowed
how would that impact the existing homeowners. He suggests that the property be deeded to the
City and have it remain a flat park.
Jeff Hass, 537 Mango Drive, Eagle, Idaho. Mr. Hass feels that the open green space should be
retained.
Steve Croft, 363 Ranch Drive, Eagle, Idaho. Mr. Croft concurs with the statements made by Mr.
DeRoost.
Jeff Haskin, 266 Mango Drive, Eagle, Idaho. Mr. Haskins property abuts the lot in question. He
is opposed to the application. The lot should remain used as it has for the last 40 years. Mr. Haskins
feels that both KM Engineering and Mr. DeShazo are not genuine. The size of the lot and potential
home would negatively impact the neighborhood, and they would have to endure the noise
associated with construction if it were to be allowed. He asks that Council put themselves in the
shoes of the residents in Eagle Ranch.
Ray Mockli, 372 Mango Drive, Eagle, Idaho. Mr. Mockli states that anything is an improvement
of what it is currently.
Karen Veljkovic, 246 North. View Drive, Eagle, Idaho. Ms. Veljkovic is against the application.
The Mayor closes the public testimony.
Toni DeShazo, 33 Ranch Drive, Eagle, Idaho. They would like to build their home on the lot. It
would be a conservative home similar to the others in the neighborhood. While they empathize
with the neighbors, they would like to move ahead in relation to the property. They simply want
to build a small moderate home there. There has been a long history, and they would like to be able
to join the neighborhood.
Kevin McCarthy, does not have anything further to add. Discussion regarding water service to the
property. It had been previously watered using water from Eagle Water Company, but with the sale
to Veolia it has not been watered further.
May inquires if the DeShazo's were aware that the lot was designated as a playground when they
purchased it.
Mayor closes the public hearing.
Discussion amongst Council. Gindlesperger inquires how this matter can be put to rest so the
request to change the use does not come forward again.
City Attorney, Villegas, speaks to the ownership that the courts granted to Mr. DeShazo. However,
it did not waive the note on the plat. The City does have a weed abatement ordinance that would
address the status of the lot, however as it is privately owned, the no trespassing signs would be
allowed as it is privately owned.
Russell believes that the original intent was for a playground and is not inclined to grant the
vacation. May concurs, she is pleased that neighbors have gotten together to organize their efforts.
May is not inclined to vacate the plat. Kvamme states that homeowners bought with the hope that
a playground would be on the lot. It is his hope that the new HOA and the owners could come to
some type of agreement. He is not in favor of vacating the lot.

regarding the desire to review these fees annually.
C 1. Resolution 25-05 - Amending the Parking In -Lieu Fee: Resolution 25-05, Resolution of the
City of Eagle Amending the Parking In -Lieu Fee provided in Eagle City Code Section 8-4-4-5; and
provide an effective date. A Resolution to amend the Parking In -Lieu Fee from $5,700 to $18,000

Recreation Coordinator, Josh Herker reviews the changes to the Recreation Department fees. An
analysis was conducted comparing the rates charged by Eagle and would be comparable with other
entities. Herker makes himself available for questions.

D1. Resolution 25-06 - Updating the City of Eagle Recreation Department Fee Schedule:
Updating the City of Eagle Recreation Department Fee Schedule in accordance with Eagle City
Code Section 1-7-4; to update and establish new fees to be charged for services and provide an
effective date. A Resolution to amend the fee and deposit schedule for the Recreation Department
to provide for programs and facilities. (BLA)

REVISED SCOPE OF WORK
For
Heritage Park Improvements
City of Eagle, Idaho
April 2025
Description/Scope of Work
Based on the City Council approved motion on March 18, 2025, the following revised scope of work outlines
the necessary modifications to the project plans and specifications. Specific elements of the City Council
motion that influence the engineering design are presented below:
Proceed with the Heritage Park renovation project restroom upgrade/concession stand and
storage building with the following direction/conditions:
■ That all city parking spaces shall be retained with the exception of up to 5 spaces in the
southeast corner of the parking lot that may be removed in conjunction with the
bathroom remodel;
■ The existing splash pad will be retained and maintained;
■ The existing three -sided bulletin board will be retained and maintained;
■ The City will not pursue any of the other proposed changes or modifications, including but
not limited to expansion of the Park, fencing between the City Parking Lot and Smoky
Mountain, pavilion shade structure, gateway arch, or digital signage/reader boards.
Tasks
1. Revise civil site plans, utility plans, and details to reflect reduced scope
o The existing elevation of the site is approximately 1-foot lower than the finished floor
elevation. This will require elevation transitions with steps and a curb wall to allow for the
construction of the concrete slab in front of the restroom/concession area.
o Revise demolition plan to reflect areas/items not proposed for removal and to identify items
that will be affected by the new utility routing.
o Revise plans/details and grading adjacent to the building within the current parking area to
transition to the construction boundary.
o Revise plans/details to update site improvements consistent with Council direction.
o Revised site utility plans to reflect rerouting of utilities to the connection points along State
Street (water, electrical, audio, and fiber). Connection points to existing utilities (water,
electrical, irrigation) will be identified on the plans based on City Public Works research on
the locations of the utilities to remain.
2. Revise architectural plans to update details/items consistent with Council direction. Add details for
stairs/railing/curb wall to allow for proper transition from the building to existing site elevations.
3. Revise electrical plans to update site electrical improvements, modify electrical panel layout, adjust
the panel schedules to reflect connection to existing site electrical, and coordinate connection
points to the existing site electrical.

4. Revise mechanical plans to modify waste drain layout under the building to connect to existing
sewer service line.
5. Revise and update specifications to reflect changes approved by Council.
6. Project Design Meetings — Attend meetings necessary to coordinate revised scope of work,
coordinate connection to existing utilities, and design coordination with City for revised layout.
• Biddings tasks outlined in the original scope of work approved by the City on December 13, 2022,
remain unchanged with this revised Scope of Work.
Timeline
HECO recognizes that time is of the essence and will provide services with the following targeted
milestones.
✓ Complete Final Design — May 2, 2025
✓ Public Advertisement for Construction — May 4, 2025; May 11, 2025
✓ Bid Opening — June 3, 2025
✓ Bid Award — Council Meeting on June 10, 2025

HECO proposes completing the above services for a fixed fee in the amount of $24,250, which is in addition

City Council Members:
Subject: City of Eagle Conservation Advisory Committee (CAC) Funding Recommendations for
2025/2026 Projects (Short and Long-term).
As authorized by the CAC, I am pleased to submit this letter of recommendation on behalf of our
Committee members. The following projects have been identified by the CAC as priorities and are
recommended for funding in the fiscal year 2025/2026 Capital Budget. Funding could be derived
from Conservation and Education (CEP) funds, grants, general funds, or other funding sources. In
addition to funding, staff support for development, implementation, or oversight may be needed.
The following projects have been separated into short-term (projects taking one to two years) or
Long-term (projects taking more than two years). In addition to the estimated time frames, the
projects also include (if available or applicable) a description of the action, scope of work,
estimated budget, and estimated staff time.
Short-term Projects
o Wildlife Signs
■ Description: Work with IDFG, ITD, Planned Communities, or other sources to
purchase multiple electronic signs (like those on SH-55) to support wildlife
crossings, traffic issues, and emergency responses.
■ Timeline: Signs would be purchased as funding is available.
■ Estimated Cost: $20,000/sign plus annual maintenance and storage. It is
recommended that these are purchased in sets of two for traffic in both
directions. Optimal would be to purchase six to use on SH-16, 44, and 55.
■ Staff: Public works would likely house, place, and operate the signs as
needed throughout the community.
■ Note: These could be purchased under a FEMA grant via the State of Idaho's
Office for Emergency Management. This is a 25/75 match requirement.
o WUI Ordinance
■ The CAC is in support of the city developing and finalizing a WUI Ordinance.
o Boise Foothills Plant Guide
■ Description: purchase 500 plant guides to be sold or made available to
Eagle citizens. The intent is to increase awareness and educate citizens on
the native and non-native plant species found in the city and foothills.
■ Timeline: Books could be purchased as funding is available.
■ Estimated Cost: The cost is $3.00/book, and we recommend purchasing
500 copies ($1,500). These could be sold for $5.00 with the additional funds
added to the CEP fund.
■ Staff: Front office staff available for sales at City Hall.
o Invasive and Noxious Weed Education
■ Description: Coordination with Ada Weed and Pest, Wester Rangelands... to
provide residents and staff with education on impacts and
recommendations for monitoring and control of invasive and noxious weed
species in the city and foothills.
■ Timeline: Survey 123, educational pamphlets, and other literature could be
requested at any time and added to the Cities website. In -person classes
could be held at city hall at any time.
■ Estimated Cost: $0.00
■ Staff: Data organization and support from GIS, staff coordination with
agencies to put on education events.
o Small Ag and Soils
■ Description: Coordination with Ada Soil and water Conservation District
(ASWCD) to develop education materials and classes on small ag farming
and way to keep and enhance soils and implement sustainable practices
and uses for small ag lands.
■ Timeline: Initial coordination with ASWCD could happen at anytime.
■ Estimated Cost: Cost would be based on the number and type of classes
provided ($0-$2,000).
■ Staff: Staff coordination with agencies to put on education events.
Long -Term Projects
Charlie Woods Park (Included Adjacent Renison Area)
o Description: See proposed park plans submitted to the City of Eagle for the Charlie
Woods and Renison open space areas.
o Alternative Actions Identified:
■ No Action: Do nothing at this point. No timeline, cost, or staff anticipated.
Renison Alternative (CAC not in support): Renison to regrade both sites,
develop/install irrigation system, add topsoil, and seed with grass. A natural
pathway (gravel type mix) would be placed through the sites. The city to take
possession of the site and maintain.
CAC feels that this does not benefit the City, would create a
maintenance burden while also creating use issues with the pond
and neighbors (public use enforcement issues), and provides
minimal habitat value. High probability of continuous noxious
weeds issues and associated maintenance costs to the city with
little to no net benefit.
■ CAC Recommendations:
Option 1: Wetland banking was identified as the best value and use
of the area (Charlie Wood, Renison, and several other city -owned
properties). This concept was identified by the City in 2023, and a
concept plan and budget were developed with Ecosystem Science
(Nicoel Baird was city POC). This alternative would have an
economic ($200k+ per acre or used by the city) and intrinsic value to
the city, as well as increased education and outreach opportunities.
o Estimated Cost: $50,000480,000 for baseline reports,
permitting, and development of prospectus for Army Corp.
We cannot estimate the costs for engineering and
construction at this time. However, CAC would support the
use of CEP funds to support the process (baseline reports,
prospectus, engineering...).
o Timeline: 3-5 years
o Staff: Staff time would primarily be associated with RFP and
management of the project/contractor as staff does not
currently have the qualifications or experience to do this fully
in-house.
Option 2: If the wetland banking concept is not preferred based on
cost or timeline, the CAC also developed a conservation -based
alternative. It is recommended that the sites be graded (contour with
low points for accumulation points), supplemental irrigation,
coupled with added topsoil, seeding (native grass, forb, and shrub
species), and planting a significant number of trees. The trail would
be the same as the Renison alternative but connected through both
sites. The intent is to create a forested area for habitat that also
limits public use of the pond to designated sportsman access points
and the trail. This has mostly intrinsic value to the city as there
would be no economic benefit, and the city would have to maintain
the site.
o Estimated Cost: $50,000480,000 for baseline reports,
permitting, and development of prospectus for Army Corp.
We cannot estimate the costs for engineering and
construction at this time. However, CAC would support the
use of CEP funds to support the process (baseline reports,
prospectus, engineering...).
o Timeline: 1-2 years
o Staff: Staff time would primarily be associated with RFP and
management of the project/contractor.
Small Ag Preservation Program (Concept Only, Requires Additional Information)
o Work with ASWCD, DoA, and other partners to create a small ag program for
landowners interested in growing crops or livestock on their small ag lots 5-20
acres. This requires a considerable amount of coordination but gives the city and
residents an economically sustainable pathway to preserving and using ag lands to
grow viable crops, keep open space, and protect habitat.
The projects identified above were recommended based on the need for active conservation of
open space, agricultural lands, and habitat for wildlife. If you have any questions or need additional

Eagle Ranch Playground Timeline
1972 - Eagle Ranch Subdivision No 2 was platted
1985 - DeShazo builders and their property is foreclosed on by Old National Financial
Services. This includes the "Playground" lot which also includes the Eagle Water
Company well
1986 - Robert and Elizabeth DeShazo re -purchase the lot as individuals
1987 - Robert DeShazo requests permission from the City of Eagle to redevelop the lot
and build 4 homes
1989 - Residents in Eagle Ranch band together to fight the development and create the
Eagle Ranch Property Owners Association (an HOA)
1989 - Robert DeShazo once again is denied permission from the City of Eagle to
redevelop the lot and build 4 homes.
1992 - Robert DeShazo files a Quiet Title action on the "Playground" lot which confirms
he is the owner of the lot. It does not alter the legal use of the lot.
1992 - After stopping further development, the Eagle Ranch Property Owners
Association is dissolved.
1997 - A letter from City of Eagle Zoning Administrator to Robert DeShazo states that
this lot can only be developed as a "Park"
2008 - DeShazo performs an illegal subdivision of the lot to carve out a separate lot for
the Eagle Water Company Well.
2017 - A representative of DeShazo contacts the Ada County Assessor to state that the
lot is a common lot and should have ZERO value. After some research and contact with
the City of Eagle, the Assessor agrees and lowers the value to ZERO.
2024 - Eagle City Council denies the vacation of the "playground" note on the plat.
Shortly after, I reached out to Stephanie at KM Engineering. The purpose of my call
was to try to come up with a solution. She said she would contact the owner and get
back with me. I never heard back.
2024 - No Trespassing signs are placed throughout the Playground lot
2024 - KM Engineering held a Neighborhood Meeting on 10/29/24. In a nutshell, the
plan was the same, no changes or compromise. The meeting was well attended and
the neighbors expressed their continued opposition.
2025 - On February 18th, 2025 Eagle Planning and Zoning voted to recommend the
vacation. This meeting was well attended by neighbors even though we weren't
allowed to testify. The commissioners made note of the large attendance and made the
correct assumption that we were all there to oppose the application. Former Mayor
Grueber mentioned having strong feelings about the application, and since he
previously lived in the neighborhood, recused himself from the conversation and vote.

Project Summary
• In 2024 we submitted this application and it was approved by P&Z and denied by the
City Council.
• Numerous neighbors came out in opposition at City Council.
• Prior to this new application we held a neighborhood meeting to get input from the

History associated with subject property
• On March 10, 1987, the applicant brought the request before the Eagle City Council to
further develop the common area parcel into additional residential parcels. The Council
at the time stated the issue should be taken to a public hearing.
• On April 25, 1989 the City Council heard a request from the applicant to vacate the
playground note from the plat and to subdivide the parcel into four (4) lots. The Council
denied the application due to legal questions regarding whether the homeowners in the
subdivision have legal right to the common area and it was determined the issue should
be resolved legally before coming back before the City.
• On June 18, 1990 the Planning and Zoning Commission recommended denial of Eagle
Ranch No. 5, a subdivision of the Eagle Ranch No 2 playground lot.
• On July 10, 1990, the City Council approved Eagle Ranch No. 5, a re -subdivision of the
Eagle Ranch No. 2 playground lot with a condition that an indemnification agreement be
established to absolve the City of any liability due to the legal question of whether all the
homeowners have a legal right to the lot as common area still not being resolved.
History associated with subject property
• On May 12, 1992, a lawsuit was filed with the plaintiffs being the current
applicant and the defendants being the Eagle Ranch Property Owners
Association. The intent of the lawsuit was to remove a restriction on the
title for the subject parcel regarding it being developed as a playground.
• On February 28, 1997, staff provided written correspondence to Robert
DeShazo outlining the history and property status of the subject property.
• On February 27, 2024, the City Council heard a request from the applicant
to vacate the playground note from the plat. The Council voted 4-0 to deny
the application.

Discussion (include or omit this slide?)
• As part of the original approval of Eagle Ranch Subdivision, this lot was
designated to be a playground which the developer was required to
provide. The applicant was the developer of Eagle Ranch Subdivision.
If the vacation is approved, it would grant the owner the full rights of the
already entitled R-4 (Residential) zoning district, pursuant to ECC Section 8-
2-3, including the ability to construct a single-family dwelling on the
subject property. The applicant's narrative states their intention to
construct only one single-family dwelling on the property.
• As a result of the applicant's neighborhood meeting held on October 29, 2024. the
applicant is requesting a condition of approval that only one residential building
permit be allowed.

Discussion
During the applicant's tenure as the owner of the Eagle Water
Company, a water service building was constructed on the property.
The Ada County Assessor's Office website notes that the property was
divided into two parcels on December 17, 2008, assumably to
separate the portion of the property that the building was on from
the remaining undeveloped portion of the property, however, a
preliminary plat application was never submitted to the city for
approval.
• The city does not recognize the division as a legal separation of the
property and the building is now under the ownership of Veolia
Water (formerly Eagle Water Company).

3 The site shall have a minimum of 8 parking spaces.
4 The applicant shall be required to submit a design review application to be reviewed and approved by the Design Review

5 The applicant shall be required to submit revised building elevations which show a building facade that conforms to one of
the approved architectural styles within the Eagle Architecture and Site Design Book to be reviewed and approved by the

Site Specific Conditions of Approval (modified):
The applicant shall enter into a license agreement with Ada County Highway District for 25-feet of the right-of-way located on the
6 south side of the site to allow for parking. If the applicant is unable to secure a license agreement for this portion of the site, the
applicant shall be required to provide a revised site plan showing adequate parking for the most restrictive use proposed in this
application (Industry, Limited). The applicant shall provide an executed copy of the license agreement for the parking area and
landscaping located within the ACHD right-of-way prior to issuance of a zoning certificate.
A waiver of Eagle City Code Section 8-2A-7(J)(2)(a) is granted with this application, and the required landscape buffer is reduced to 5-
7 feet (5') wide along the western perimeter of the property (between the existing building and the western P` I' Landscaping

a Certificate of Occupancy.
