THIS TEMPORARY WATER DELIVERY AGREEMENT ("Agreement") is made as of
2025 (the "Effective Date"), by and between Todd and Anita Simonson, husband and wife, (collectively
"Simonson"), and City of Eagle, a municipal corporation in the State of Idaho ("City"). Simonson and City
may each be referred to as a "Party" and collectively as the "Parties."
RECITALS
WHEREAS Simonson owns a residence whose address is 1691 N. Eagle, Rd, Eagle Idaho 83616 and
legally described as Lot, 1 Block 1 Washum Acres Subdivision, Ada County Parcel R92398500100 (the
"Property")
WHEREAS the Property has received water through use of a well located on the Property, but that
well has recently become inoperable.
WHEREAS Simonson intends to construct a new well for water delivery to the Property, but in the
meantime requires water from another source.
WHEREAS City operates a municipal water system and can provide water to the Property.
WHEREAS Simonson desires for the City to provide temporary water service under the terms and
conditions of this Agreement.
AGREEMENT
NOW, THEREFORE, in consideration of the above recitals, the mutual covenants contained herein,
and for other good and valuable considerations, the receipt and sufficiency of which are hereby
acknowledged, the Parties agree as follows:
1. Incorporation of Recitals. The above Recitals are a material part of this Agreement and are
incorporated into the Services of this Agreement by reference as though they were fully set forth herein.
2. Temporary Water Service. City will provide water services to the Property starting on the Effective
Date of this Agreement and terminating on August 31, 2025.
3. Payment. Simonson will pay the ordinary user fees for water delivery to the Property during the
term of this Agreement. Payment may be made by the following:
City Hall:
Cash, checks and all major credit or debit cards across the counter at Eagle City Hall, 660 East Civic
Lane, Eagle, Idaho, 83616. Office hours are 8:00 AM to 5:00 PM Monday through Friday (excluding all
major holidays).

Online Payments:
From the City of Eagle webpage, www.citvofeagle.org/water, you can make online payments with any
major credit or debit card. Card processing fees will apply.
4. Permanent Connection to City Water Services. If Simonson is unable to construct a well on the
Property by the termination date of this Agreement, Simonson agrees to immediately connect to the City's
municipal water system, pay for all costs associated with such connections and terminate all connections
to any well on the Property which may create a cross connection with the City's water system. At no time
shall a connection to the City's water system also be connected to any use provided by a well on the
Property.
5. Indemnification. Simonson agrees to indemnify and save and hold harmless City from and for any
and all losses, claims, actions, judgment for damages, or injury to persons or property and losses and
expenses and other costs including litigation costs and attorney's fees, arising out of, resulting from, or in
connection with the performance of this Agreement.
6. Notice: All notices required to be given by either of the Parties shall be in writing and be deemed
communicated when personally served, or mailed in the United States mail, addressed as follows:

7. Compliance with Laws. Simonson shall comply with all applicable Federal, State and local laws and
regulations.
8. Further and Additional Documents. The Parties agree to execute such other, further, and
additional documents as may be required to carry into effect the terms and conditions of this Agreement.
9. Assignment. This Agreement may not be assigned or delegated by either party without prior
written consent of the other party.
10. Attorney's Fees. The prevailing party in any claims or disputes arising out of this Agreement shall
be entitled to recover reasonable attorney's fees in addition to other relief which a court of competent
jurisdiction may award.
11. Governing Law. This Agreement will be construed in accordance with the laws of the State of
Idaho.
12. Approval. The City and Contractor each acknowledge that this Agreement, even though agreed
upon by the City's representatives, is not binding upon the City until such time as the Eagle City Council
approves this Agreement and authorizes the Mayor to execute this Agreement on behalf of the City.
