The above -entitled design review application came before the Eagle Design Review Board for their action
on April 10, 2025. The Eagle Design Review Board having heard and taken oral and written testimony,
and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Landmark Pacific Investors, LLC, represented by Kate Watson with Superior Signs Idaho, is
requesting design review approval for a master sign plan for Eagle Point Commercial. The 2.84-acre
site is located on the northeast corner of West State Street and State Highway 44 (Parcels Nos.
S0507427890, S0507427880, and S0507427860).
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on March 3, 2025. Revised information (sign
elevation, master sign plan criteria, landscape plan) was received April 1, 2025.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On June 3, 2015, the City Council approved a rezone from A (Agricultural), A-R (Agricultural -
Residential) and R-2-DA-P (Residential with a Development Agreement — PUD) to MU-DA (Mixed
Use with a Development Agreement in lieu of a PUD, including a height exception) at 9.93-dwelling
units/acre and preliminary plat approval for Predico Eagle Pointe Subdivision (RZ-06-14 and PP-08-
14).
On August 15, 2015, the Design Review Board approved the common area landscaping, seven (7)
apartment buildings, caretaker's unit, and a clubhouse within Predico Eagle Pointe Subdivision (DR-
62-14).
On June 28, 2016, the City Council approved a preliminary plat extension of time for Predico Eagle
Pointe Subdivision to be valid until June 9, 2017 (EXT-06-16).
On June 21, 2017, the Zoning Administrator approved a lot line adjustment for Michael Wright
(LLA-07-17).
On August 24, 2021, the City Council approved a rezone from MU-DA (Mixed Use with a
development agreement) to R-p-DA (Residential with a development agreement [in lieu of a PUD],
and preliminary plat for Kingfisher Cove Townhomes, a 72-lot (63-buildable, 9-common) residential
Subdivision (RZ-06-14 MOD/RZ-14-20 & PP-07-20).
On January 25, 2022, the City Council approved a design review application for the common area
landscaping within Kingfisher Cove Townhomes Subdivision (DR-50-21).

On May 10, 2022, the City Council approved a design review application for the common area
structures (mailbox, pool equipment, pool restroom, and pool pavilion structures) within Kingfisher
Cove Townhomes Subdivision (DR-50-21 MOD).
On May 10, 2022, the City Council approved a design review application for eleven (11) townhome
buildings (63-units) within Kingfisher Cove Townhomes Subdivision (DR-50-21 MOD2).
On June 5, 2023, the City approved a design review application to modify the sidewalk along North
Elfin Way within Kingfisher Cove Townhomes Subdivision (DR-50-21 MOD3).
On June 13, 2024, the City Council approved a final plat for Kingfisher Cove Townhomes
Subdivision, a 71-lot (63-buildable and 8-common) residential subdivision (FP-11-22).
On February 27, 2024, the City Council approved a conditional use permit for a retail sales use within
a MU-DA (Mixed Use with a development agreement) zoning district (CU-07-23).
On November 26, 2024, the City Council approved a design review application for the common area
landscaping within Eagle Point Commercial (DR-2024-46).
D. COMPANION APPLICATIONS:
There are no companion applications.

The comprehensive plan designation for this site is Mixed Use.
F. ZONING DESIGNATION:

ANALYSIS PROVIDED WITHIN THE STAFF REPORT AND ADOPTS THE STAFF REPORT
AS PART OF THE DESIGN REVIEW BOARD'S FINDINGS OF FACT:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
• Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
• Eagle City Code Section 8-2A-2(B)
The general theme of the Design Review Overlay District is to specify desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment for
residents and visitors alike. The architectural designs, materials, and graphics set forth in this
article are complied to create a theme unique to the area called "Eagle Architecture".
• Eagle City Code Section 8-2A-6(A)(4)
Signage for any project shall provide for business identification and minimize clutter and
confusion on and off the site.
a. The "overall sign concept" for multi -tenant business centers to assure that it addresses the
continuity between tenant sign design and building design;
b. The reduction of hazards to motorists, bicyclists and pedestrians as may be caused by or
partially attributable to the distraction and obstruction of improperly located and designed
signs;
c. The provision for effective and necessary business identification systems adapted to the
building design;
d. The continued maintenance of signs throughout their life; and
e. The size, location, design, color, texture, lighting, landscaping, and hours of operations of all
permanent signs and outdoor advertising structures or features to ensure that any such

proposals do not detract from the function of, or design of, buildings, structures, surrounding
properties, neighborhoods, or streets.
• Eagle City Code Section 8-2A-8(B): Definitions:
GRADE: The elevation or level of the street closest to the sign to which reference is made, as
measured at the street's centerline, or top of curb if one exists, adjacent to where the sign is to be
placed, or the relative ground level in the immediate vicinity of the sign if determined by the
zoning administrator to be an accurate determination for grade with regard to the intent of this
article.
HEIGHT OF SIGN: The vertical distance measured from the grade to the highest point of a sign
or any vertical projection thereof. Architectural elements used above any sign area may be
excluded from the maximum height measurement if the city determines that said architectural
elements add to the character of the sign and do not create an overbearing appearance in relation
to the sign, building and area.
ILLUMINATION, EXTERNAL: A sign that is affected by an artificial light source that is not
contained within the sign itself.
ILLUMINATION, HALO: Illumination of a sign from a light source that is not visible and is
concealed or contained within the sign or located between the sign and the structure/wall.
Illumination from the source of the light becomes visible in darkness when the light is reflected
off of the wall/structure upon which the sign is attached.
ILLUMINATION, INTERNAL: Illumination of a sign from any light source that is concealed or
contained within the sign and becomes visible in darkness through a translucent surface, except
for illumination, punch through letter signs. This includes characters, letters, figures, designs or
outline which is illuminated by gas filled luminous tubes, such as neon, argon or fluorescent.
ILLUMINATION, PUNCH THROUGH LETTER: A sign with letters, logos or other sign
graphics that are opaque (no light is permitted to shine through them), that are attached to a sign
cabinet or structure that allows light to shine through it. The distance between the letters, logos,
or other sign graphics and the background (surface of the cabinet or structure) is a maximum of
one-half inch (1/2"). The light source is concealed within the cabinet or structure and is not
visible except that illumination from the light source shines though transparent (nonopaque)
background material for no more than one-fourth inch (1/4") around the letters, logo, and other
graphics, creating a halo effect.
MASTER SIGN PLAN: A plan designed to show the relationship of signs for any cluster of
buildings intended for business occupancy, or any single building containing more than one
business or any arrangement of business buildings or shops which constitute a visual entity as a
whole. These include developments such as shopping centers, mini -malls, business parks, and
multi -tenant commercial, office or industrial buildings housing four (4) or more businesses.
Additionally, a master sign plan may be submitted for a single business if the owner chooses to
submit an application for a master sign plan for said business
MONUMENT SIGN: A freestanding sign with a solid base, including rock signs, or with
supports that are designed to be structurally similar to the sign construction, and which
incorporate architectural features which complement the sign construction. Pole type supports are
not permitted for monument signs, unless enclosed within the monument sign structure.
SIGN AREA: The entire area within a single, contiguous perimeter enclosing the extreme limits
of writing, representation, logo, emblem or any figure or similar character, together with any form
or other material or color forming an integral part of the display, or used to differentiate such sign
area from the background against which it is placed. The sign area shall not include the necessary
supports or uprights on which the sign is placed, and superficial, nonilluminated column covers,

ornamental trim and other such incidental objects attached thereto, or portions of the sign
structure which are not designed to convey a message.
• Eagle City Code Section 8-2A-8(C)(13) Sign Illumination:
a. The city must find that any illuminated sign permitted under the specific regulations within
this article is designed such that brightness levels are controlled to assure a soft, subtle
effective light in accordance with other city regulations intended to create and maintain the
Eagle architecture theme, while encouraging energy efficient lighting.
b. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise
deemed by the design review board and city council to be consistent with the Eagle
architecture theme.
c. Floodlighting is permitted only through the use of incandescent, LED and high pressure
sodium light sources.
d. Exposed neon is permitted when used to create the sign letter(s) or as an architectural element
as part of the sign design. A clear covering may be permitted for protection of the neon
element.
e. Halo illumination is permitted.
f. Metal halide is not permitted as a light source for signage.
g. All types of internal illumination is prohibited, except for automated signs and drive-
through/drive-up service menu board signs as regulated in this article.
C. DISCUSSION:
• The applicant is requesting design review approval of a master sign plan for Eagle Point
Commercial. Staff recommends the following changes to the document titled "Eagle Point Master
Sign Plan" with text shown with underline to be added and text shown with strikethrough to be
deleted.

This signage criterion has been established for the mutual benefit of all tenants of the Eagle Point
shopping center at the corner of Highway 44 and West State Street (Parcel B, C, D-NEC).
Tenants shall be required to fulfill all the requirements of these criteria, and conformance will be
strictly enforced. Any non -conforming or unapproved signs must be removed or brought into
conformance at the expense of the Tenant.
A. GENERAL APPROVAL REQUIREMENTS
1 Each Tenant shall be required to submit signage plans to the building's Landlord or
Landlord's managing entity for written approval. A design review sign application
accompanied by the written approval of the Landlord, shall be submitted to the City of
Eagle for any proposed signs for City's review and approval. All signs shall be in
compliance with the criteria stated herein as well as Eagle City Code. In cases of any
conflict between Eagle City Code and the criteria specified herein, the more restrictive
requirements shall apply.
2. All permits for Tenant's signs and their installation shall be obtained by Tenant at
Tenant's expense and shall conform to all local building and electrical codes as well as
the criteria set forth hereafter.

3. All Tenant signs shall be designed, constructed, and installed at Tenant's expense by

5. All signs shall meet Underwriters Laboratories and National Electrical code requirements.
B. SINGLE TENANT BUILDING WALL SIGNS:
1. Building wall signs shall be placed within the approved sign areas as designated
by Landlord,-ef Landlord's managing entity, and as approved City of Eagle.
2. Single -tenant building shall be allowed a maximum of three building wall signs, provided
that each sign is on a different side of the building. Total sign area of any wall sign shall
not exceed 10% of the area of the building face (not visible from a state highway) or 20%

D. MISCELLANEOUS REQUIREMENTS:
1. Tenant or Landlord shall be responsible for the hiring of sign contractors to perform all
signage work.
2. Tenant shall be responsible for cost of maintenance, service, repair, or replacement of
Tenant's sign, time clock or electrical wiring, and shall be required to keep Tenant's sign
in working order with all surfaces to be maintained in good condition.
3. Upon termination of their lease, the Tenant shall also be responsible for any repair or
painting for the wall upon leaving of said space and shall neatly seal all penetrations of
the building structure in a watertight condition that matches the texture, color, and
material used in the construction of the building.
4. Multi -tenant buildings are required to have their own master sign plan.

• The applicant is proposing the monument sign to be 16' 3" high. Pursuant to Eagle City Code
Section 8-2A-8(C)(2)(f), the height of any such sign shall not exceed fifteen feet (15') adjacent to
a roadway that is not designated as a state highway. Pursuant to Eagle City Code Section 8-2A-
8(B), architectural elements used above any sign area may be excluded from the maximum height
measurement if the city determines that said architectural elements add to the character of the
sign and do not create an overbearing appearance in relation to the sign, building and area. Staff
defers comment regarding the height of the sign to the Design Review Board.
• The sign elevation shows "Eagle Point" copy on the base of the monument sign; however, the
material, color, and thickness of the letters was not provided. The applicant should be required to
provide a revised sign elevation showing the material, color, and thickness of the "Eagle Point"
letters on the base of the monument sign. The revised sign elevation should be reviewed and
approved by staff and one member of the Design Review Board prior to the issuance of a zoning
certificate.
• The sign elevation shows tenant panels with .10 aluminum faces; however, the dimension of the
returns was not provided. The applicant should be required to provide a revised sign elevation
showing the dimension of the returns for the tenant panels. The revised sign elevation should be
reviewed and approved by staff prior to the issuance of a sign permit.
• The night view of the monument sign shows the tenant copy to be internally illuminated;
however, the sign elevation states the copy is to be punch through illuminated. The applicant
should be required to provide a revised night view of the monument sign showing the tenant copy
punch through illuminated. The revised night view should be reviewed and approved by staff
prior to the issuance of a sign permit.
STAFF RECOMMENDATION PROVIDED WITHIN THE STAFF REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site specific
conditions of approval and the standard conditions of approval provided within the staff report.
PUBLIC MEETING OF THE BOARD:
A. A meeting to consider the application was held before the Design Review Board on April 10, 2025, at
which time the Board made their decision.
BOARD DELIBERATION:
Upon completion of the applicant's and staff's presentations, the Board discussed during deliberation that:
• The Board is in favor of the design, materials, and colors of the monument sign, including the
architectural elements on the sign that extend above the 15-foot height of the sign panels.
• The Board is in favor of the proposed master sign plan criteria.
• The Board had concerns with the type and quantity of the same type of plantings proposed around the
base of the monument sign. The Board recommended adding site specific condition number 10 to
require the applicant to provide a revised landscape plan that included a greater variety of plant
species and size for the shrubs.
BOARD DECISION:
The Board voted 3 to 0 (Grubb, Greer, Mihan, and Murphy absent) to recommend approval of DR-2025-
14 for a design review application for a master sign plan for Eagle Point Commercial, with the following
staff recommended site specific conditions of approval and standard conditions of approval with text
shown with underline to be added by the Board.

C. MONUMENT SIGNS:
1. One 16' 3" high, double faced, multi -tenant pylon monument sign is provided for use at
the northeast corner of State Highway 44 and West State Street, Parcel B, C, D-NEC.
2. Assignment and placement for Tenant panel is at the sole discretion of the Landlord and
must be authorized in writing by the Landlord.
3. As space allows, Tenants are permitted to use their text, font, and logo on the pylon
monument push through acrylic sign panels.
4. Tenant copy will be fabricated from punch through halo illuminated letters.
5. Tenant copy will be opaque white vinyl.
6. Tenant copy will use .10 aluminum faces with reverse cut for punch through 3/8" white
acrylic. No more than '/4" around the letters may be illuminated from the light source
shining through the transparent background material.
7. Background color of tenant panels will be SW 7048 Urbane Bronze.
D. MISCELLANEOUS REQUIREMENTS:
1. Tenant or Landlord shall be responsible for the hiring of sign contractors to perform all
signage work.
2. Tenant shall be responsible for cost of maintenance, service, repair, or replacement of
Tenant's sign, time clock or electrical wiring, and shall be required to keep Tenant's sign in
working order with all surfaces to be maintained in good condition.
3. Upon termination of their lease, the Tenant shall also be responsible for any repair or painting
for the wall upon leaving of said space and shall neatly seal all penetrations of the building
structure in a watertight condition that matches the texture, color, and material used in the
construction of the building.
4. Multi -tenant buildings are required to have their own master sign plan.
2. Provide a revised sign elevation showing the material, color, and thickness of the "Eagle Point" letters
on the base of the monument sign. The revised sign elevation shall be reviewed and approved by staff
and one member of the Design Review Board prior to the issuance of a sign permit.
3. Provide a revised sign elevation showing the dimension of the returns for the tenant panels. The
revised sign elevation shall be reviewed and approved by staff prior to the issuance of a sign permit.
4. Provide a revised night view of the monument sign showing the tenant copy punch through
illuminated. The revised night view shall be reviewed and approved by staff prior to the issuance of a
sign permit.
5. A sign permit is required prior to the installation of any signs on this site.
6. Provide a copy of the electrical permit (if applicable) for the sign installation prior to the issuance of a
sign permit.
7. Upon completion of the monument sign and required landscaping, the applicant shall be required to
request a site inspection to be completed by the Planning and Zoning Department. Upon verification
that the monument sign and required landscaping have been completed in compliance with the
approved plans, a certificate of completion will be issued.
8. Provide details for the brick veneer to be located on the base of the sign including size, color,
manufacturer. Provide a physical sample of the brick. The details and physical sample of the brick
shall be reviewed and approved by staff and one member of the Design Review Board prior to the

issuance of a sign permit.
9. If "Eagle Point" text located on the base of the sign is proposed to be illuminated, the applicant shall
provide a revised sign elevation showing how the sign is illuminated. The revised sign elevation shall
be reviewed and approved by staff and one member of the Design Review Board prior to the issuance
of a sign permit.
10. Provide a revised landscape plan showing a variety of plant materials (i.e. specie and size) around the
base of the sign. The revised landscape plan shall be reviewed and approved by staff and one member
of the Design Review Board prior to the issuance of a sign permit.
NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of
Approval contained herein the Site Specific Condition of Approval shall control.
STANDARD CONDITIONS OF APPROVAL:
1. A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and
construction shall be in accordance with all applicable City of Eagle Codes unless specifically
approved by the City Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and the City Council for review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, will require submittal of an application for modification and
approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or
other regulatory and legal restrictions in force at the time the applicant or its successors in interest
advises the City of Eagle of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify
the project to comply with the approved design review and/or result in the inability to issue a
certificate of completion for this project.
CONCLUSIONS OF LAW:
1. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-2025-14) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.

2. The Board reviewed the particular facts and circumstances of the proposed design review in terms of
Eagle City Code 8-2A-13(B)(2)(i), and has concluded:
i. The building wall signage will be required to be harmonious with the architectural design of the
buildings, and will not cover nor detract from desirable architectural features.
