A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAGLE:
• Making Findings; and
• Authorizing the Mayor and City Clerk to execute on behalf of
the City, the City's Grantee Acceptance of Deed of Recreational
Pedestrian! and Bicycle Pathway Easement and Maintenance
Agreement and Grantee Acceptance John Frederick Meier and
Svetlana Meier, Trustees of the Meier Family Trust U/T/A
Dated May 27, 2015, Grantor; and
• Authorizing the Mayor and City Clerk to execute on behalf of
the City, the City's Grantee Acceptance of Deed of Recreational
Pedestrian and Bicycle Pathway Easement and Maintenance
Agreement and Grantee Acceptance Weston Arnell and
Julianne Arnell, Trustees of the Weston & Julianne Arnell
Revocable Trust, Grantor; and
• Authorizing the Mayor and City Clerk to execute on behalf of
the City, the City's Grantee Acceptance of Deed of Recreational
Pedestrian and Bicycle Pathway Easement and Maintenance
Agreement and Grantee Acceptance Mace River Ranch Owners
Association, Inc., Grantor; and
• Directing the City Clerk; and
• Establishing an Effective Date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of. the City of Eagle,
Ada County, state of Idaho:
Section 1: Findings
1.1
It is hereby found by the City Council that:
The City of Eagle as a municipal corporation organized and existing pursuant to the
Taws of the state of Idaho has , pursuant to Idaho Code Section 50-1703(8). the authority
to: acquire, construct, reconstruct, extend, maintain or repair parks and other
recreational facilities ; and
RESOLUTION - Authorize Acceptance of Deeds of Recreational Pedestrian and
Bicycle Pathway Easements and Maintenance Agreements Page 1

1.2 Section 2 "Recitals" of the three (3) Deeds of Recreational Pedestrian and Bicycle
Pathway Easements and Maintenance Agreements [attached hereto and marked as
Exhibits A, B and C] sets forth the authority, intentions, purposes, consideration and
reasons of the City of Eagle City Council to authorize the Mayor and City Clerk to
execute the City's Acceptance as Grantee of the same and such Recitals are therefore
by this reference incorporated herein as if set forth at length.
Section 2: Action authorizing the Mayor and City Clerk to execute three
Recreational Pedestrian and Bicycle Pathway Easements and Maintenance
2.1 That the Mayor and City Clerk of this City are hereby authorized, as the
City, to execute the City's Grantee Acceptance of the following:

City the City's Grantee Acceptance of Deed of Recreational
Pedestrian and Bicycle Pathway Easement and Maintenance
Agreement and Grantee Acceptance Weston Arnell and Julianne
Arnell, Trustees of the Weston & Julianne Arnell Revocable Trust,
Grantor; and
• Authorizing the Mayor and City Clerk to execute on behalf of the
City the City's Grantee Acceptance of Deed of Recreational
Pedestrian and Bicycle Pathway Easement and Maintenance
Agreement and Grantee Acceptance Mace River Ranch Owners
Association, Inc., Grantor; and
a true and correct copy of which are attached hereto and marked Exhibit A, Exhibit B
and Exhibit C and by this reference incorporated herein, and thereby fully bind the City
to accept and abide by each of their terms and conditions.
Section 3: Directing the City Clerk
3.1 The City Clerk is hereby directed to retain this resolution in the official records of the
City and to certify a copy thereof and deliver the same to the Grantors; and
Section 4: Effective Date
4.1 This resolution shall be in full force and effect after its passage and approval.
