Minutes - 2019 - Design Review - 03/28/2019 - RegularDESIGN REVIEW BOARD MINUTES The Design Review Board met in regular session, March 28, 2019, Vice -Chairman Schafer presiding. 1. CALL TO ORDER: Vice -Chairman Schafer calls the meeting to order at 6:00 p.m. 2. ROLL CALL: The following members were present: GRUBB, SAYER, SCHAFER, BAER, GERMANO, KOCI. ABSENT: BRASHER. A quorum is present. Grubb moves to move the public comments to after item 6A. Seconded by Sayer. ALL AYE... MOTION CARRIES. 3. PUBLIC COMMENT: This time is reserved for the public to address the Design Review Board regarding concerns or comments they would like to provide to the Board regarding subjects not on the agenda. This is not the time slot to give formal testimony on a new business item or pending application or proposal. Out of courtesy for all who wish to speak, the Board requests each speaker limit their comments to three (3) minutes. 4. CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless a Design Review Board member, City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. • Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Design Review's Consent Agenda approval motion unless specifically stated otherwise. A. Findings of Fact and Conclusions of Law for DR -13-19 — Two Multi -tenant Commercial Buildings within Piccadilly Village Subdivision No. 2 — Old Town 1, LLC: Old Town 1, LLC, represented by Mark Butler, is requesting design review approval for two (2) multi -tenant commercial buildings within Piccadilly Village Subdivision No. 2. The 1.75 -acre site is located on the southeast corner of North Echohawk Lane and East Hill Road at 220 South Echohawk Lane within Piccadilly Village Subdivision No. 2 (Lot 14, Block 1). B. Findings of Fact and Conclusions of Law for DR -06-93 MOD — Change of Use from Retail to Retail and Indoor Commercial Entertainment Facility, Including a Building addition for Golf Your Way — Golf Your Way: Golf Your Way, represented by Joe Rausch with Wright Brothers The Building Company, is requesting design review approval to change the use of the building from retail to retail and indoor commercial entertainment facility, including the construction of a 2,300 -square foot indoor training and club testing facility. The 0.30 -acre site is located on the north side of East State Street approximately 585 -feet west of the intersection of North Parkinson Street and East State Street at 2250 East State Street. Findings of Fact and Conclusions of Law for DR -14-19 — Common Area Landscaping and Pool House within Truman Cove Sub No. 3 — Rennison Companies: John Rennison with Rennison Companies is requesting design review approval for the common area landscaping and pool house within Truman Cove Subdivision No. 3. The 4.03 -acre site is located on the south side of State Highway 44 approximately 705 -feet south of the intersection of State Highway 44 and South Ancona Avenue at 2035 East Riverside Drive. Sayer moves to approve the consent agenda. Seconded by Grubb. ALL AYE...MOTION CARRIES. 5. UNFINISHED BUSINESS: None. 6. NEW BUSINESS: A. ACTION ITEM: DR -20-19 — Common Area Landscaping within Lakemoor Subdivision Nos. 9 and 10 — DA Land, Inc.: DA Land, Inc., represented by Rodney Evans with Rodney Evans + Partners, PLLC, is requesting design review approval of the common area landscaping within Lakemoor Subdivision Nos. 9 and 10. The 7.34 -acre site is located on the southeast corner of East Colchester and East Fishing Creek Road. Rodney Evans, 1014 S. La Pointe, Boise Idaho reviews the application. City Planner Lauerman addresses the Board. Board discussion. Schafer moves to approve DR -20-19 — Common Area Landscaping within Lakemoor Subdivision Nos. 9 and 10 — DA Land, Inc. with the site specific and standard conditions of approval. Seconded by Grubb. ALL AYE...MOTION CARRIES. 7. PUBLIC COMMENT: This time is reserved for the public to address the Design Review Board regarding concerns or comments they would like to provide to the Board regarding subjects not on the agenda. As a reminder, Chairman Schafer states that the Design Review Board does not make recommendations regarding land use or density, the Design Review Board is a recommending body to the Council in regard to design and landscape only. Jon Scott, 3353 Holl Drive, Eagle. Questions about Piccadilly and what is on the Design Review Board agenda tonight. Debra Michael, 522 W. Back Forty Drive, ADA microphone should be in the building so that people with disabilities such as herself have an easier time of testifying. She has questions about gravel pathways. Pathways should be accessible to everyone, loose gravel is not what we should be using. Paul Villaret, 1855 N. Groveland Place states has issues with the Molinari project. Cherry Bello Drive, has not seen the design for the apartment project, but is sure that they do not fit in with Eagle and they will look shabby. Jon Scott, 3353 Holl Drive, addresses the board again. Would like to know why doesn't this board have purview over the height of the building? Judy Dahl, 735 N. Echohawk Way, why is Mark Butler getting preferential treatment on his projects? Because he worked for the City previously? His development looks like a prison. Debra Mayhew, 1840 Woodvalley St., has a question for the committee, are you concerned with the amount of retail, the amount of green space, things like that that are leading to higher density? Mark Butler, 1675 E. Bishop Way, the information on Next Door is fake garbage. The apartment complex being built is right behind his home, the information on Next Door about these apartments in incorrect. The Design Review Board enforces the code, Mr. Butler appreciates what the Board does and is taking this opportunity to stand up for this Board and what they do. Explains about the many projects he has done in Eagle. Rick McGee, 3030 W. Champagne Ct., feels everything is rubber stamped, maybe the citizens should sue the city. We are tired of the development, tired of the growth. You are approving projects that do not follow the comprehensive plan — you violate the rules. Judy Dahl, would like to apologize to Mr. Butler, was not aware of his contribution to the City. Eagle should stick to what Eagle always has been, we don't want to change the look of Eagle. Stephanie Kellermann, 820 Eagle Hills Way, not in favor of more apartments, been in Eagle six years, Eagle is beautiful, keep it that way. Reads what is on the web page about the Design Review Board, asks that the Board keep all of these things in mind. Micah Colby, 742 Palmetto Drive, seeking clarity from the Board in regard to the decisions they make on applications and what council does with those decisions. We don't want Eagle to become unpalatable. Frank Wright, 1396 W. Powder Court, moved to Eagle for quiet and ambiance over 20 years ago. What's happening with the Molinari project is not in line and against what Eagle is all about. James McLean, 3057 E. Shadow Eagle, wondering about the open patios that have grass on top of them in Molinari Park, what is this? Public comment period is closed. The Board would recommend that all of you get involved, get on Boards or council to make your opinions heard. 8. REPORTS: A. Design Review Board: Lou will not be at the April meetings. B.
