EAGLE CITY COUNCIL MEETING MINUTES February 11, 2025 1. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, MAY, RUSSELL, KVAMME. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance. 4. ADDITIONS. DELETIONS OR MODIFICATIONS TO THE AGENDA: None. 5. REPORTS: A. Mayor and Council: Russell states that there is a special meeting tomorrow at 3:00 p.m. on the Capital Plan and has asked Nichoel Baird Spencer to speak on that further during reports tonight. The meeting is to bring forward the Capital Plan and receive public input. Kvamme reports on the Eagle Sewer District. Their portion on the Aikens Street extension is delayed for 2-3 weeks to allow for utility work by Veolia Water. B. Department Supervisor: City Clerk Osborn and City Treasurer Kellie Rekow provides a status update of the Clerk -Treasurer Department activities for the past calendar as well as the current fiscal year. The depth and scope of knowledge possessed by those department employees, as well as their selfless public servant hearts, make each of them an asset to the residents. In this fiscal year, 225 public record requests have been processed, 14,553 cash receipting entries, and over 1,700 invoice entries, 272 water service order requests and 159 assessment requests. These numbers give a brief glimpse of the breadth and scope of service provided by the Clerk -Treasurer Department personnel. Director of Long -Term Planning and Projects, Nichoel Baird Spencer states that there will be a series of five workshops regarding the Capital Plan in preparation for the budgeting process. In addition, she provides handouts on the ACHD Integrated Five Year Work plan and provides an overview of the process. Recreation Coordinator, Josh Herker, seeks Council consent to place the issuance of an open container permit for Eagle Fun Days on the next Council agenda. Eagle Fun Days activities will be held on the City Hall campus and thus require Council authorization to allow the service and consumption of alcohol on premises. Zoning Administrator discusses the Wildland Urban Interface Ordinance that will be placed on the February 251 Council meeting. In addition, he will be meeting with the Public Works Director tomorrow to start working through the request for proposal process for the park and trails master plan to bring that process forward. C. Eagle Police Department: Chief Ruby introduces Deputy Jeff Hazeur and provides a brief review of his law enforcement experience and expertise. Council Members and Mayor Pike expresses their gratitude for Deputy Hauzers service to Eagle. Chief Ruby discusses the various complexities associated with typical calls fielded by Eagle deputies. D. City Attorney: None 6. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. Mr. Butler will be continuing to serve as Seat 3 for the Agency for a third, and final, two (2) year term that will expire in February 2027. (BKP) C. Appointment to the Eagle Planning and Zoning Commission: In accordance with Resolution 23-17, Mayor Pike is requesting Council Confirmation of the appointment of Paul Oland to the Planning and Zoning Commission. Mr. Oland will be fulfilling a vacated term that will expire in February 2026. (BKP) D. Appointment to the Eagle Public Library Board: In accordance with Resolution 23-17, Mayor Pike is requesting Council Confirmation of the appointment of Nikki Hyer to the Eagle Public Library Board. Ms. Hyer will be fulfilling a vacated term that will expire in September 2026. (BKP) E. Appointment to the Eagle Public Library Board: In accordance with Resolution 23-17, Mayor Pike is requesting Council Confirmation of the appointment of Joanne Macomber to the Eagle Public Library Board. Ms. Macomber will be serving a five (5) year term that will expire in September 2029, nunc pro tunc. (BKP) F. Call for Artists - Eagle City Athletic Park Loco Design Winner Confirmation: The Eagle Arts Advisory Committee is seeking Council confirmation of their recommendation of Vina Domingo as the winning artist for the Eagle City Athletic Park Logo Design Contest and to award the $500.00 prize for their entry titled "The Eagle Rises". Addendum to Pricing Agreement Between the City of Eagle and SCORE Sports: An Addendum to Pricing Agreement between the City of Eagle and SCORE Sports for City of Eagle sports uniforms.(LKB) H. Cintas First Aid and Safety Cooperative Acceptance Agreement: Cintas Agreement for Services on First Aid Kits, PPE Cabinets, Body Fluid Cleanup Kits, Trauma Bags, Fleet Replenishment Center, and Eyewash Stations. The 3.26-acre site is located on the north side of East State Street approximately 386-feet east of North 2nd Street at 350 East State Street. (ERF) L. DR-2024-66 - Two Multi -tenant Buildines within Aspen Pointe Plaza - Aspen Pointe Plaza, LLC: Aspen Pointe Plaza, LLC, represented by Justin Schwartz with Regen, PPLC, is requesting design review approval of two, two story multi -tenant commercial buildings (5,841- square feet and 3,329-square feet). Inc.: Becky Yzaguirre is requesting final plat approval for Terra View Subdivision No. 3, a 40-lot (34- residential, 6-common) residential development. The 22.04-acre site is located at the northeast corner of State Highway 16 and West Beacon Light Road. (ASG) R. Appointment to the Eagle Public Library Board: In accordance with Resolution 23-17, Mayor Pike is requesting Council Confirmation of the appointment of Nikki Hyer to the Eagle Public Library Board. Ms. Hyer will be fulfilling a vacated term that will expire in September 2026. (BKP) Mayor Pike introduces the item. Gindlesperger expresses her appreciation of Ms. Hyer for her willingness to serve again on the Library Board. However, though Hyer is a fantastic candidate and qualified, Gindlesperger would appreciate a different candidate being selected, so that a fresh perspective can be placed Library Board. Gindlesperger moves to deny Consent agenda item 6D the appointment and remand back to the Mayor for another appointment. Seconded by Russell. Discussion. (NBS) Mayor Pike introduces the item. May seeks clarification regarding the inclusion of impact fees and the percentage of the City's overall budget for use for law enforcement contracts that was called out in the level of service study. Discussion for clarification on the travel reimbursement expenses. Director Baird Spencer provides clarification on requested items. Once the level of service is identified by the LOS, the law enforcement CIP will then be reviewed to determine if changes will be required to the plan. (ERF) Mayor Pike introduces the item. Kvamme states that recently Hardin Sanitation has come before Council to discuss commercial overage issues in Eagle. He would like confirmation that adequate trash facilities are in place for the projected site. Emily Falco, Planning Staff states that application was transmitted to Hardin Sanitation, however no response was received. The applicant is present to speak about the matter in more detail. Kevin Watson, 1055 S. Twin Lakes, Middleton, Idaho. Mr. Watson states that early on in the process they look at the trash needs of their store locations and it is a priority for the business. Heritage Park Renovations: Staff will provide the City Council an update on the design and engineering progress for the Heritage Park Renovation. (NBS) Mayor Pike introduces the item. Director Baird Spencer provides an overview of park history and the current renovation project. The project team is comprised of staff from Planning and Zoning, Public Works, IT, Recreation, the City Engineer, Mayor Pike and Council Member Gindlesperger as well as Director Baird Spencer. The council had directed staff to change the parking spaces to be redesigned programmed park space, the project is currently at 75% design. The City has set aside $3 million dollars to update the park to coincide with construction associated with the Downtown Mobility Improvements. Baird Spencer reviews the design, status to date and the next steps. Gindlesperger and the Mayor will be working on sponsors for various aspects of the project including the splash pad, larger caliber trees, and other elements of the design. Discussion. The council expresses their gratitude for all of the hard work by the entire design team. 8. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS. A. RZDA-2024-03/PP-2024-02 — Riverbend Commons Subdivision — McCauley Investments LLC: McCauley Investments LLC, represented by Dave Yorgason with Tall Timber Consulting, is requesting a rezone from A-R (Agricultural -Residential) to MU-DA (Mixed Use with a development agreement) [in lieu of a PUD and Conditional Use Permit (CUP)]), a development agreement modification, and preliminary plat approval for Riverbend Commons Subdivision, a 23-lot (21-buildable [20-commercial; 1-residential]; 2 common lot) mixed use subdivision. The 14.00-acre site is comprised of six (6) parcels and is generally located 1,500-feet southwest of the intersection of State Highway 44 and South Urban Gate Avenue at 2603, 2611, 2755 and 2785 West State Street. (DLM) Mayor Pike introduces the item and opens the public hearing. Dave Yorgason, representing McCauley Investment LLC. 13965 W. Chinden, Boise, Idaho, reviews the application and items in the staff report they are requesting to alter. Mr. Yorgason reviews conditions within the development agreement including a15% reduction in parking requirements, an alteration in setbacks and lot coverage, and a height exception for the Sports Plex. The applicant is not seeking any changes to the conditions listed in the staff report. It has been an excellent interaction with staff, and they are seeking Council's approval tonight. Kvamme inquires as to the logic behind the 15% reduction in parking rather than the 396 identified spots. Yorgason states that it allows the developer flexibility when phasing construction. Discussion regarding the office building option vs the two sports plex buildings. Percy Chan, 103 Pinedale Way, Eagle, Idaho. Mr. Chin is an Eagle resident and an Eagle High School tennis coach. His initial concern was traffic and appreciates the applicants right in and right -out entrance. He has been coaching in Eagle and at Eagle High School for several years. There is a great need for an indoor facility. When the indoor facility in Eagle opened there was a direct impact on the increase in State Championships for Eagle High School. He is in support of the application. Rod Poison, 70 N. Pinedale Way. HOA President of Timberland Estates which is directly across from the proposed development. The Homeowner's Association is not opposed to the proposal; however, they are concerned with traffic safety. They are seeking a condition of approval added to move the access point to the western side of the property instead of the eastern side. They believe it would increase safety for traffic both those of this development and Timberland Estates. Trina Tadje, 3400 N. Timber Ridge Lane, Eagle, Idaho. Ms. Tadje is a long-time resident of Eagle and a long-time tennis player. They have been able to build an outdoor tennis court on their property, however having an indoor facility is vitally important. It provides recreation in all weather for both physical activity as well as social activities of both youth and adults. They are in support of an indoor facility. Dawn Bryson, 4107 W. Pine Meadows Drive, Eagle, Idaho. Ms. Bryson states that they have been Eagle residents since 2002 and are long-term tennis players. They were members of Eagle Tennis Club and are truly feeling the void of the closure of that facility. They would welcome a new indoor facility. Tracy Garner lives on Ballentyne Road. Ms. Garner has children that are tennis players and are in support of the tennis facility. Ms. Garner discusses the social isolation that is occurring in today's society. The importance of community engagement is vital to today's youth. Mark Prince, 1050 N. Purple Sage Way, Eagle, Idaho. He is in favor of the application and appreciates the McCauley family for bringing this forward for Eagle and the Eagle community. It will be a great legacy for the City. Nancy Merrill, Eagle, Idaho. This is a scenic corridor, and the building has been very thoughtfully placed to not negatively impact the view corridor. The height of the building and the set back from the street will serve to mitigate the impact. The applicant has conducted traffic studies as required by ACHD and ITD to ensure safety. Traffic safety has been addressed by the adherence to conditions placed by the regulatory agencies. Mayor Pike closes the public testimony. Dave Yorgason rebuts testimony. Mr. Yorgason discusses the location of the eastern entrance, and that the location is a condition that was established by ITD and the intent for it address traffic safety. General discussion. Russell thanks the applicant for the thoughtful presentation of the application. The relationship with existing residents has been very well thought out. May expresses her appreciation of the internal circulation, and the traffic plan in general the development will be a great asset to Eagle. Gindlesperger inquires as to the potential for tennis facilities and if they would be open to the public. Kvamme asks questions about the dwelling unit options of the plan. Discussion. The HOA would be responsible for the maintenance of the area regardless of the reduction is granted or not. Discusses road A construction options and timeline. Mr. Weaver addresses the WUI that has been previously submitted and approved the developer. Those conditions are evaluated for compliance for landscape materials and home building requirements. ACTION ITEM: Fiscal Year 2025-2029 Capital Plan Modification Number 2: A modification to the FY 2025-2029 Capital Plan to move $13,650.00 in unutilized funds from LIB CM-3: Library Concrete Maintenance to PW CM-17: Jackson House Adaptive Reuse Study.
