JPA - 2019 - Law Enforcement Services - 3/19/2019AGREEMENT NO.12936-1-19 AMENDED JOINT POWERS AGREEMENT BETWEEN THE ADA COUNTY SHERIFF'S OFFICE AND THE CITY OF EAGLE RELATING TO LAW ENFORCEMENT SERVICES FY 2019 This Amended Joint Powers Agreement Between the Ada County Sheriff's Office and the City of Eagle Relating to Law Enforcement Services FY 2019 ("Agreement") modifies the Joint Powers Agreement Between Ada County, the Ada County Sheriff's Office and the City of Eagle Relating to Law Enforcement Services FY 2019 (Agreement No. 12936) (hereinafter "Original Agreement"), entered into on September 24, 2018, by and between ADA COUNTY, a duly formed and existing county pursuant to the laws and Constitution of the State of Idaho ("COUNTY"), the ADA COUNTY SHERIFF'S OFFICE (hereinafter "ACSO") and the CITY OF EAGLE, IDAHO (hereinafter, "CITY"), also referred to, collectively or individually, as "Party" or "Parties." WHEREAS, pursuant to the Original Agreement, ACSO provides law enforcement services to the CITY under the conditions and terms specified therein; and WHEREAS, the CITY desires to add one (1) additional full-time code enforcement specialist position to the current service level provided by the ACSO; and WHEREAS, the ACSO is willing to hire an additional full time code enforcement specialist and assign that person to work in the CITY to increase the current service level provided by the ACSO; and WHEREAS, the Parties agree to increase the contract amount due by the CITY to compensate ACSO for the costs of the added full time code enforcement specialist to be assigned to the CITY; and AMENDED JOINT POWERS AGREEMENT BETWEEN THE ADA COUNTY SHERIFF'S OFFICE AND THE CITY OF EAGLE RELATING TO LAW ENFORCEMENT SERVCIES (FY 2019) — PAGE 1 WHEREAS, the Parties desire to modify the existing Original Agreement to the extent necessary to effectuate this change. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, the Parties hereby agree that the Original Agreement is modified as follows: 1. Level of Service: The current level of law enforcement services provided by ACSO to the CITY under Paragraph 1 of the Original Agreement is modified by adding one (1) additional full-time code enforcement specialist position. The additional position will perform the services described in Paragraph 1.1.h of the Original Agreement. A job description for this position is attached hereto as Exhibit "A." 2. Cost Increase. To compensate ACSO for the additional code enforcement specialist position, the CITY agrees to pay to the ACSO as follows: a. VEHICLE COSTS: A one-time payment of $37,450.00 for the cost to ACSO of the vehicle used by the code enforcement specialist. To allow ACSO to acquire and prepare this vehicle for use in advance of the code enforcement specialist's starting date, payment of this amount is due and payable no later than 20 days after the execution of this Agreement. Although the CITY is reimbursing ACSO for the costs associated with this vehicle, COUNTY will retain ownership of this vehicle at all times. b. PERSONNEL COST AMOUNTS: The sum of $5,270.63 per month, in addition to the amounts currently due under Paragraph 1.4 of the Original Agreement, for the additional personnel costs of the above -referenced code enforcement specialist position. Except as provided in Paragraph 2(c), below, this amount will be due AMENDED JOINT POWERS AGREEMENT BETWEEN THE ADA COUNTY SHERIFF'S OFFICE AND THE CITY OF EAGLE RELATING TO LAW ENFORCEMENT SERVCIES (FY 2019) — PAGE 2 and payable, along with the current monthly installments due each month, under the Original Agreement. c. PERSONNEL COST ACCRUAL: The CITY's obligation to pay the additional monthly personnel cost amount will not arise until the start date of the additional code enforcement specialist employee to be hired by the ACSO. It is the intent of the Parties to have the new position filled as soon as possible. However, the Parties recognize that the uncertainties in the hiring process will make the exact start date impossible to calculate in advance. Accordingly, the ACSO will notify the CITY of the start date of the new employee as soon as the position is filled, and the CITY's monthly financial obligation referenced in Paragraph 2(b), above, will begin as of, but not before, the start date of the new employee. The payment for the first month will be pro -rated, as necessary, to accurately reflect the days worked in the first month. 3. This Agreement incorporates and includes all of the changes agreed by and between the Parties and supersedes and replaces any oral discussions, representations, or stipulations previously entered into by the Parties. 4. All other provisions of the Original Agreement are incorporated into this Agreement, as if set forth in full, and shall remain in full force and effect and shall not in any way be modified, changed, altered, or amended by this Agreement, except as provided herein. Routinely interfaces with property owners, occupants or the general public to gain willful compliance and cooperation as well as provide education on applicable codes, policies and procedures. Administers vehicle related violations and hazards such as abandoned vehicle, emergency/evidence towing and crash awareness program. May, on special request, support Patrol Division as required with traffic control, crime scene evidence collection, and documentation/processing. • Performs varied, moderately to extremely complex work under general supervision and according to pre -defined guidelines. ESSENTIAL FUNCTIONS: • Investigates public code complaints by conducting field inspections of premises, gathering evidence, researching sources, and determining violations; • Works with owners and others to educate them of zoning requirements and to gain compliance, develop solutions and recommendations for corrective actions; • Prepares case files and provides complete documentation to support legal action and/or revocation of permits and issues verbal or written notices of violations; • Investigates selected areas to ascertain compliance with zoning regulations and illegal commercial use in residential areas to include educating owners to gain compliance; • Participates in legal proceedings by gathering evidence, interviewing witnesses/suspects, documenting cases for submission into legal proceedings then interfacing with prosecuting attorney, attends court hearings and testifies in jury or court trials; • Must be able to assume 24/7 on-call coverage responsibilities and work special events that include nights, weekends, and holidays; • Must be able to undergo use of force training along with certify on reactive impact weapons, oleoresin capsicum (OC) spray and/or conducted energy devices; • Receives and responds to calls and inquiries regarding abandoned or impounded vehicles, tags the vehicles and arranges for towing; • Processes the abandoned vehicle paperwork pursuant to Eagle City Code, Ada County Code, Idaho Code and Idaho Transportation Department (ITD) procedures; • Conducts Vehicle Identification Number (VIN) inspections and determines vehicle ownership; • Coordinates activities with other departments to ensure consistent enforcement of zoning and development in subdivision ordinance requirements; • Survey selected areas to ascertain complaints in general categories such as portable signs, compliance with conditional permit, temporary businesses, home occupations, and illegal uses in residential areas; • Assist in preparation of documentation to update ordinances in research in plats/records using available resources to determine ownership of property for notification by certified mail; • Serves as a resource to department staff concerning problems encountered by contractors, businesses in homeowners do to prevent conditions zoning ordinances in building requirements. Additional functions: • Receives phone calls and provides general assistance to the public inquiring into planning and zoning related issues, code enforcement procedures, city planning/zoning regulation and ordinances, and other programs and services within the community; • Attends some city council meetings to provide code enforcement status reports and provide necessary information related to code enforcement proceedings; • Assists with the collection of data to identify areas that require emphasis efforts; • Performs related duties and supports Patrol Division as required including but not limited to; traffic control, crime scene management and evidence collection. Qualifications: • Knowledge of investigative techniques; • Knowledge of due process requirements; • Knowledge of location of VIN on all types of vehicles; • Knowledge of use of all types of office equipment; • Skill in verbal and written communications to include conflict resolution in tense situations that may be highly emotional in nature; • Skill in the operation of a personal computer and use of Microsoft Office programs; • Ability to learn code enforcement practices and zoning ordinances and determine how to gain compliance; • Ability to accurately record, document and prepare case files for use in legal action; • Ability to learn and retain information concerning the law and adapt to changes; • Ability to gather and protect evidence during an investigation; • Ability to read and understand blueprints and architectural plans; • Ability to research owner and title information using a variety of sources; • Ability to operate a motor vehicle while pulling a trailer. Summary: This position requires a person to have excellent reasoning/problem solving and an ability to solve problems with the city, agency and community stakeholders in mind. Must have the ability to read, analyze, and interpret general business periodicals, professional journals, technical procedures and government regulations. Also, employee must possess the ability to write reports and to effectively present information and answer question from city officials, customers and the general public. This position requires the ability to work without supervision and make informed thought-out decisions with the interests of the stake holder, the agency, and city in mind. Frequently requires the ability to receive detailed information and direction through oral communication and act upon the information. The employee must possess and maintain a valid Idaho driver's license and proof of insurance to be approved by the city clerk. Safe and responsible driving is required. JOB REQUIREMENTS: • Minimum three years' experience in reading, understanding and enforcing laws, codes and zoning rules, property maintenance and inspections or an equivalent combination of education and/or experience, and a high school diploma or equivalent; • Must undergo a polygraph examination, background check, and pass an oral examination; • Must be deputized and wear the uniform of a non-commissioned deputy sheriff; • Must possess and maintain a valid Idaho driver's license; • This position has been designated safety sensitive and therefore the incumbent is subject to random drug testing. WORK ENVIRONMENT AND PHYSICAL DEMANDS: • Approximately 80% of the time the incumbent will work in the field and will be subject to outside weather conditions; the remainder of the work will be performed in an office setting; • At times, the work requires the incumbent to negotiate fences and/or various types of terrain (hilly, steep, rocky, rough, wet and/or slippery surfaces); • The work requires the incumbent to conduct inspections and post notices concerning zoning violations; DISCLAIMER: To perform this job successfully, an individual must be able to perform the essential job functions satisfactorily with or without reasonable accommodation.
