A Resolution Of The City Of Eagle, Idaho, Adopting A New Fee For Solid Waste Collection
Services Identified As Commercial Overages; And Providing For Effective Date.
WHEREAS, the City of Eagle, Idaho ("City") is a municipal corporation operating under the laws
of the State of Idaho and is authorized to set or increase rates and charges and take such other
actions incidental to the collection and disposal of garbage; and
WHEREAS, notice of the proposed increase in fees was published in The Idaho Statesman, a
newspaper of general circulation within the City on February 12, 2025 and February 19, 2025, as
required by law; and
WHEREAS, pursuant to a public hearing on the proposed increase of fees held February 25,
2025, as required by Idaho Code §63-1311A, the City Council of the City of Eagle (the
"Council") desires to adopt fees as set forth below.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF EAGLE, IDAHO:
Section 1: That the new fee be established for solid waste collection services identified as
commercial overage, will be shown with underline and said fee shall be incorporated into the
solid waste collection fee schedule as attached as Exhibit A
Section 2: Commercial overage shall be defined as any items that are out, above, over, on top of,
near or next to a level full container shall be considered an overage.
Section 3: That the new fee for commercial overage shall be in full force and effect Nun Pro
Tunc on January 1, 2025.
ADOPTED by the Eagle City Council, Eagle Idaho.

Mayor and City Council,
I am an Eagle resident and business stakeholder. For testimony purposes, my business reference address is 325 E. Shore
Dr. in Eagle. I am writing regarding item 7.A listed on the February 25, 2025 City Council meeting titled A Public Hearing
to Consider New Solid Waste Collection Fee and the associate 7.A.1 Action Item identified as Resolution 25-02. Please
accept this email as written testimony for the record as I have a prior conflict that prevents me from testifying during
the scheduled meeting. To that, I have copied the City Clerk and ask that an email response verification of receipt of my
testimony be provided back to me so I know the City received this.
My concerns regarding the proposed fee are two -fold. One, I believe a better approach to address overage or overfilling
of carts is best left to the City and their solid waste ordinances, rather than giving deference to a contracted provider
inside of a fee schedule. I am not aware of other local cities in the Valley that leave the issue of "overfilling" of
containers or carts to the service provider. Rather, most seem to utilize the due process of ordinances in the event of
any violation. I do not think the proposal is a good approach for the City of Eagle to take with its business community.
Second, and more important in my mind, are the interpretations that are left vague which create ambiguity in the words
used. Trash providers understand and accept that, to some degree, trash being collected that extends beyond a top of a
bin is often acceptable. This is not a zero -sum game where anything "over" an undefined "top line", or the top of a
container constitutes an "overage". In fact, it is often a tacitly approved concept, even by Waste Connections
particularly when Waste Connections is charged at the local landfill by weight for their loads. Related, the associated fee
is stated as $8.31 per yard. There is no indication in this resolution to what "per yard" means. Is this charge applied
"per yard" of extra material? If so, who determines and measures the amount of overage, and what is the dispute
resolution process if someone disagrees? Is it per yard of the size of the container? If so, is it right to charge a three -
yard container more than $24 if a small, de minimis amount of trash is "over" the top of a container?
Additionally, It is unclear that the business community is sufficiently aware of this proposal, nor had adequate chance to
provide feedback, regardless of the public noticing efforts. Further, it is unclear to me if "commercial" services include
contractor -related businesses and whether the local building contractors associate and groups have been contacted for
input?
I appreciate all you do for the City, and ask that you not approve action item 7.A or the associated resolution pertaining
to Commercial Overage charges for Solid Waste as a new collection fee, unless and until these concerns can be clarified
and resolved, and the business community is made fully aware of the proposed changes and have had a chance to
discuss and weigh in as key stakeholders.
