A RESOLUTION OF THE EAGLE. CITY COUNCIL TO VACATE A PORTION OF THE PUBLIC
AND PRIVATE UTILITIES, DRAINAGE, AND IRRIGATION FACILITIES EASEMENT LOCATED
WITHIN LOT 1, BLOCK 10 (LEXINGTON HILLS SUBDIVISION NO, 2) AS SHOWN ON THE
ATTACHMENT HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, William and Marie Zacharda requested a vacation to the final plat of Lexington
Hills Subdivision No. 2 to vacate a portion of the public and private utilities, drainage„ and irrigation
facilities easement (Exhibit "A") within Lot 1, Block 10 (Lexington Hills Subdivision No. 2); and
WHEREAS, On May 6, 2024, the Planning and Zoning Commission recommended approval of
the vacation (VAC-2024-01), to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacationwas published in the Idaho
Statesman on Julie 28, 2024, and July 12, 2024; and
WHEREAS, On July 23, 2024, the City Council held a public hearing en the proposed vacation
(VAC-2024-01), and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure', and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
WHEREAS, Relinquishment letters have been provided from all utility providers identified in
Idaho Code 50-1306A,
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO,
The Eagle City Council hereby vacates a portion of the public and private utilities, drainage, and
irrigation facilities easement (Exhibit `4.A") located within Lot 1, Block 10 (Lexington Hills Subdivision
No. 2) of the final plat of Lexington Hills Subdivision No. 2, as considered, beard and approved by the
Council at its July 23, 2024, public hearing for application number VAC-2024'-01, and as shown on the
attachments hereto.
This Resolution shall be in full force and effect inunediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 28tb day of January, 2025.

Ma County, Idaho.
An easement being a portion of said Lot 1, located in the NW1/4 the SW1/4 of Section 3, T. 4 Jul.,
R. 1 E., 8.M., City of Eagle, Ada County„ Idaho, more particularly described as Mows:
COMMENCING at a 5/8" rebar with cap PLS 3624 marking said northwest comer;
Thence S. 64°52'001' E., coincklent with north line of said Lot 1, distance of 6.17 feet;
Thence leaving said north line, S. 25°08V0" W., 5.00 feet to the POINT OF BEGINNING;
